OVDRULIJfG PRO'l'BSTS ARD Dl'l'JraMINING TO MllCE IMPROV'BMINTS AD MODIPICA!IGIS WITHOUT COMPLWlCB WITH IMVISTIOATION ACT PROJECT NO. 51-1 THIRD S'l'RDT, et al ACQUISITION A.ND IMPROVBM&NT RESOLVED, by the Council or the City or Palo Alto, California, WH.DBAS, on February 26, 1951, this Council adopted its Reso- lution No. 2075 ot Intention to llod1fy Preliminary Proceedings under Resolution No. 2067 ot Preliminary Determ1nat1on, adopted February 13, 1951, and did t1x therein this date as the time and place when and where any and all persons interested may appear and show cause, 1r any they have, why the Council should not find and determine that the public convenience and necessity require the improvements described and referred to in said Resolution, without compliance with the Special Assessment Inveat1gat1on, Limitation and Majority Protest Act of 1931; WHEREAS, notice of the adoption or said preliminary Resolu- tion No. 2075 and or said time and place or hearing wae given by the City Clerk by publication and posttng ror the time and 1n the manner provided 1n said Resolution and Article I or the ?alo Alto Improvement Procedure Code, aa appears from affidavits on file with the City Clerk; WHEREAS, no written objections to the undertaking or sa1d proceedings Without r1ret complying w1th the prcv1s1one of ea1d Investigation Act ha.ve been filed with the City Clerk at or before the time fixed for this hearing by pepeona interested, owning or having an interest in real property within the proposed asaeesment district, bearing their nignature, a description or their property, and a statement of the riature of their interest therein; and WHEREAS, all persons interested. have been given an opportunity to be ar1d were fully heard, and said Counc11 has duly considered any and all objections and protests made, and the said propoeed improvements, and the public convenience and necese1ty for 1111!.king same. NOW, 'l'HXREPORE, IT IS POUND, DR'l'ERMIN!J) and ORDERED, as follows: 1. The public eonvP.nience and necessity require the im- provements described in iaid Resolution No. 2075 of Intention to Modify Preliminary Proceedings. 2. Any and all objections &nd protests made pursuant to the said Resolution are hereby, overruled and denied. 3. The Preliminary Proceedings under Resolution Ne. 2067 of Preliminary Determ1nat1on are hereby modified to include the improvements and mod1r1cat1ona described in said Resolution No. 2075 or Intention to Modify Preliminary Progeealngsk and shall be inade under and pursuant to the provisions or the Palo Alto im- provement Procedure Code more particularly referred to in said Resolution No. 2o67 or Preliminary Determination, and the Special Assessment Inveat1gat1on, Limitation and Majority Protest Act or 1931 shall aot apply to sa1d proceedings.
