R!SOLVKD, ~Y the Council or the City ot Palo Alto, ca11rorn1a~
VHBRKAS, on Jebruary 13, 1951, this Council adopted 1ts Reso-
lution Ho. 2069 ot Prelim1n&l'Y Determination to make certain
acqu1e1t1ons and improvements more particularly described therein
and did fix therein Monday, February 26, 1951, at the Council
Chambers in the City Hall, as the time and place when and where
any and all persona interested may appear and show aaus~, 1f any
they have, Why the Council should not .find and determine tha·t the
public convenience and necessity require the aoqu1s1t1ona and
improvements described and referred to in said resolution, without
cpmpliance with the Special Assessment Investigation, Limitation
and Majority Protest Act ot 1931;
WHEREAS, notice of the adoption or said preliminary resolu-
tion and of said time and place of hearing waa glven by the City
Clerk by publication and posting for the time and in the manner
provided in said Resolution of Preliminary Determination and
Article l or the Palo Alto Improvement Procedure Code, as appears
from affidavits on file with the City Clerk;
WHEREAS, no written objections to the undertaking of said
proceedinge without firat complying with the provisions of said
Investigation Act have been filed with the City Clerk at or before
the time fixed ror this hearing by persons interested, owning or
having an inte~est in real property within the proposed assessment
district, bearing their signature, a description or their property,
and a statement or the nature of their interest therein; and
WHEREAS, all persons interested have been given an opportunity
to be and w~re fully heard, and said Council has duly considered
any and all objections and protests made, and the said proposed
a.cqu1s1 t1on and 1mprovementz;, an.d the public conv•n1enca and
necessity for making same.
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as
t'ollowa:
1. The public convenience and necessity require the acqu1sit1one
and improvements described 1n said Resolution of Preliminary Determina-tion;
2. Any and all objections and protests made pursuant to:
aaid Resolution or Preliminary Determination are hereby, overruled
and denied; ~
3. The aequ1sitions and iaprovements:; described in sa:td
Reeolut1oD ahall be made under and pursuant to the provisions of
the Palo Alto Improvement Procedure Code more particularly re-
1°'erred to 1n said Resolution, and the Special Assessment Inv•stiga-
tion~ Limitation and Majority Protest Act of 1931 shall not a~ply
to said proceedings.
