' --.. -,. ___ ""1 RESOLVED, by the Council or the City of Palo Alto, California, WHBREA.S, on February 13, 1951, this Council adopted its Reso- lution No. 2067 or Preliminary Determination to make certain acquisitions and illJ)rovemente more particularly described therein and did fix Monday, February 26, 1951, at the Council Chambers 1n the C1tyHa.lli as the time and place when and where any and all persona interested ma,· appear and ehow cause, if any they hsve, why the Council should not find and determine that the pub- lic convenience and necese1ty require the ac~u1s1tions and improve- ments described and referred to 1n aa1d resolution, without com- pliance with the Special Assessment Investigation, Limitation and Majority Protest Act of 1931; WHEREAS, notice of the adoption of said preliminary resolu- tion and of sald time and place of hearing was given by the City Clerk bJ publication and posting for the time and in the manner provided j,n sa1d Resolution or Preliminary Determ1nat1on,and Article l or the Palo Alto Improvement Proeedure Code, as appears from aff1dav1ta on file with the City Clerk; WHEREAS, no written objections to the undertaking of said proceedings without first complying with the provisions of said Investigation Act have been filed with the C1ty Clerk at or before the time .fixed for this hearing by persona interested, owning or having an interest in real property within the proposed assessment district, bearing their signature, a description of their property, and a statement or the nature of their interest therein; and WHEREAS, all pereone interested have been given an opportunity to be and were fully heard, and said Council has duly considered any and all objections and protests made, and the said proposed acqu1e1t1ons and improvements, and the public convenience and necessity for making same. NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follOlf'B: l. The public convenience and necessity require the aequ1s1- t1ons and improvements described 1n sa1d Resolution of Preliminary Determination; 2. Any and all objections and protests made pursuant to said Resolution or Preliminary Determination are hereby, overruled and denied; 3. The acquisitions and improvements described in said Reso-J. lut1on shall be made under and pursuant to the provisions of the Palo Alto Improvement Procedure Code more particularly referred to in said Resolution, and the Special Aaeeasment Investigation, Limitation and Majority Protest Act or 1931 shall not apply to said proceed1nge. * * * * * * .
