RISOLVRD, by the Council or the City of Palo Alto, California, as to!lows:
1. The Council does hereby preliminarily determine that
the public convenience and neceaaity require, and that it intends
to order the following acqu:ta1tion to be had, work to be done and
1mprovemen·te to be made 1n and for sa1d City, to wl t:
A. The eonntruct1on or v1tr1f1ed clay pipe sanitary sewer
mains, wye branches, risers and house laterals~ together with
standard mar.holes and cast iron manhole and riser frames and
covers 1n Roso Road from the southeasterly city 11m1te, as es-
tabl.1ehed pr1or to completion or the annexation approved by the
Council by Ordinance No. 1317 adopted January 22, 1951, south-
eaeterly ror its entire length; Middlefield Road from the south-
easterly e1 ty 11:n1 ts, ae establ:'-shed prior to the said annexation,
to the present city lim1 te; Grove Av'enue for 1 t!S entire length;
Cowper Street from the southeasterly city limits, as established
prior to the said annexation, to Dry Creek; Alma Street from
Charleston Road to the present city limits; DieeRoad from
Santa Clara Avenue northeasterly to a point approximately 200
feet northerly or Waverley Street and from Middlefield Road north-
easterly to a point approxmiately 300 feet northeasterly of Ros8
Road; Mayview Avenue from Grove Avenue to Rosa Road; Charleston
Road from Alma Street to the present city lim1te, Leghorn Street
from San Antonio Avenue to the present city limits; and San
Antonio Avenue from a point approximately 450 reet eoutherly from
BayBhore Highway to Alma Street.
B. Th~ acquisition of the following easements and the
cone truetion therein or v:t tr1f:1.ed clay pipe san1 tary sewer mains.•
wye branches, risers and house laterals, together w1th standard
manholeu and cast j,ron manhole and riser frames and covers:
{l) Along the southeasterly prolongation of Greer Road to
Adobe Creek, thence paralleling Bayshore Highway .to San
Antonio Avenue.
(2) From the southeasterly terminus or Greer Road in a
straight line southerly to the northeasterly terminus or
Diss Road.
(3) From the 1ntereect1on of Diss Road and Middlefield
Road &long the southwesterly prolongation of Diss Road to
a point approximately 200 feet northerly of the intersec-
tion of Dlas Road and Waverley Street.
( 4) In Greer Road :rx·om Colorado Aven•1e southerly for its
entire length, and Louie Road from the aoutheaeterly city
limits, as established prior to completion or the annexa-
tion approved by the Council by Ordinance No. 1317, adopted
January 22, 1951, for 1ts entire length, as said Greer Road
and Louie Road appear on the map of the C. M. Wooster Com-
pany's Subdivision or the Clarke Rahch, recorded November
11, 1912, in Book "o" or Maps at page 16, Santa Clara County
Records.

C. The construction or a sewage pumping Btation, 1nclud1ng
pump structure and building, pipes, valves, fittings, mechanical
equipment and electrical wiring, together w1th all appurtenances,
at a point on Greer Road approximately 175 feet northwesterly
from Loma Verde Avenue.
2. All or said work and improvements are to be c.onstruct-
ed at the places and in the particular locat1on8, or the forms,
s1zes1 d1mena1ona and material!!, and to the lines, grades, and
elevations as shown and delineated upon the plans and apec1f1ca-
t1ons prepared therefor, and on file 1n the office of the City
Engineer in the City Hall or said City, reference to which is
hereby made tor full and detailed description or said proposed
work and for further particulars.
3. There 1s hereby excepted from the above work that
wM.ch 1s already done to line and grade and marked ctxcepted. or
ohown not to be done on the plans, profiles and spec1f1cat1one.
4. The Council does hereby adopt and establish as the
official grades for sa1d work the grades and elevations shown
upon sa1d plans, profiles and specifications. All such grades
and elevations are in feet and decimals thereof 1n reference to
the official base and datum of said City.
5. All of said work shall be done under the supervision
of the City Engineer or the City or Palo Alto, and all or said
work and materials shall be done arJd furnished to his satisfac-
tion.
6. A map or plat of the lands and improvements necessary
or convenient to ·be taken for such proposed improvement has been
filed with the City Clerk and approved by the Council, to which
reference 1r. hereby made for further particulars.
7. A statement of the total estimated cost of said im-
provement, atat:.ng separately the estimated coat or each class
of construction proposed, and of each parcel of land or improve-
ment proposed to be acquired, and of the incidental expenses of
said proceedings and of said acqu1s1t1ons and improvements has
been filed with the City Clerk and approved by the Council, to
which refe~ence 1s hereby liade for further particulars.
8. Said contemplated acqu1s1t1ons and improvements, in
the opinion of t~1s Council, are of more than local or ordinary
public benefit, and the cost and expense or doing said work and
the expenses incidental thereto, shall be made chargeable upon
the district b~nef1ted thereby, the exterior boundaries or
wh1ch are as described in the San Antonio Road Annexation pro-
ceedings approved by this Council by Ordinance No. 1317, adopted
January 22> 1951, except that portion of the territory annexed
within the I.as Encinas Sanitary District. The properties so
benefited, and the boundaries thereof, are more particularly
shown on the map or said assessment district on file in the
office of the City Clerk or said City, to which reference is
hereby made for a more ~eta1led description thereof.
9. All public streets, alleys and ways in use in the per-
formance of the public function shall be omitted from the
assessment hereinafter to be made to cover the cost or said
improvement.
10. Notice is hereby given that serial bonde to represent
the unpaid assessments and bear interest at the rate of not to

exceed rour per cent (~~) per annum, will be issued pursuant to
Part 4, Bond Plan C ot Article 'I'll ot the Palo Alto Iaprovement
Procedure Code, the last install~nt or which shall mature n1ne
(9) years from the second day or July next euoeeed1ng ten months from the1r date.
11. Except as herein otherwise provided for the issuance or,
bonds, all of the above proposed work shall be done in pursuance
of the provisions of Article V or aaid Palo Alto Improvement Procedure Code.
12. Said. acquis1 t1on and improvement proceeding;s are anal-
ogous and similar 1n effect to those provided in the M'Lmicipal
Improvement Act of 1913 and said bonda proceedings are analogous
and e1m1lar in effect to those provided in the Refunding Assess-
ment Bond Act or 1935, and, excepting a.a herein otherw1ee pro-
Tided, these proeeed1ng8 shall respectively be deemed taken purau.ant thereto.
13. Not1ce is hereby given that Monday, the 26th day of
February, 1951, at the hour or 7:30 o'c.lock P.M., at the Council Chambers
in the City Hall aro hereby fixed as the time a~d place when and where
any and all persons interested may appear and ehow cause, if any they
have, why the Council should not find and determine that the public
convenience and neceas1ty require the acquisitions and improvements
deocribed and referred to in thls resolution, without further com-
pliance with the Special Assessment Invest!gation, Limitation and
Majority Protest Act or 1931, as provided· in Article I or said Ordinance.
14. The City Clerk shall give notice of the adoption or
this resolution by publishing a N~t1ce of Proposed Local Improve-
ment once 1n the Palo Alto Times, a dally newspaper published
and circulated in said City, and. by posting same on or near the
Council Chamber door of said Council, said posting and publica-
tion to be had at least t.en days before said date of hearing.
