RBSOLVE:D, by the Council or tbe 01ty ot Palo Alto, Cal1tor-
n1a, as follows:
1. The Council doee hereby prel111l1nar1ly determine that
the public convenience and necessity require, and that it intends
to order the following a~qu1e1t1ons to be bad, work to be done
and 1nrprovements to be made in and for eaid City, to wit:
A. The 11lJ)rov1ng of Third Street between Page Mill Road and
Fernando Avenue by acquiring eleven feet on each aide thereof
from Page Mill Road to Lambert Avenue, and six feet on each side
thereof from Lambert Aveni.le to Fernando Aver1ue, by grading, remov-
ing trees and existing etructurea, conetructing or reconstructing
Portland Cement concrete curba1 gutters, sidewalks, driveway
aprons, storm water catch basins and drain pipe, constructing
crushed rock base pavement with asphaltic concrete wearing sur-
face between gutter lips, conatru.ct1ng vi tritied clay pipe sani-
tary sewer aerv1cea, copper or galvan,.zed iron pipe water ser-
vices, and wrapped steel pipe gas aerv1cea.
B. The improving of Lambert Avenue between 'l'hird StNet and
El Camj.no Real, Cheetnut Avenue between First Street and Third
Street, First Street and Second Street between Lambert Avenue and
Pernando Avenue, and Rose Avenue between Lambert Avenue and
First Street by grading, removing treea and ex1at1ng structures,
constructing or reconstructing Portland Ce8*nt concrete curba,
gutters, sidewalks, driveway aprons, storm water catch baa1ne
and d~a1n pipe, constructing crushed rock base pavement with
asphalt1e concrete wearing surface between gutter lips, construct-
ing v1tr1t1ed clay pipe sanitary eewer aerv1cea, copper or gal-
vanized iron pipe water eervieea and wrapped steel pipe gas ser-
·ricea.
c. The 1mprov1ng or Second Street between Sheridan Avenue
and Page Mill Road by acquiring ten f~et on each side there~r, by
grading, r~moving trees and ex1et1ng structures, conatruct1ng or
reconstructing Portland CeMent concrete curbs, gutterB, sidewalks,
driveway aprons, storm water catch basins and drain pipe, con-
strnct1ng crushed rock base pavement and aephaltic concrete wear-
ing surface between gutter lips, constructing v1tr1f1ed clay
plpe sanitary sewer services, copper or galvani::::ed 1ron pipe wa-
ter services, and wrapped steel pipe gaa services.
D. The improving· :O:f' 1'1rst Street and Second Street between
California Avenue and Sherman Avenue by acqu1r1ng ten feet on
each aide thereof, by grading, removing treea and exiat~ng
structures, constructing or reconstructing Portland Cement con-
crete curbs, gutters, aidewalka, driveway aprons, base pavement
between new gutter 11pa and ~xiet1ng concrete pavement. storm
wAter catch basin and drain pipe, constructing aephalt1c concrete
wearing surface between gutter lipa,and constructing v1tr1f'1ed
clay p!pe sanitary sever aerv1cea, copper or galvanized iron pipe
water aerv1cea, and wrapped steel pipe gae services.

rrom California Avenue to Alley S-2 between P1ret Street and Third Street by grading, removing trees and ex11ting atructuree,
and constructing Portland· Cement concrete B1dewalk.
G. The acquiring or an easement tor pedestrian lane purposes
approximately seven feet wide extending from the Southweaterly end
of Alley s~1 to Bl Camino Real and the improving of said easement
by grading, removing trees and existing structures, and construct-
ing Portland Cement concrete sidewalk.
H. The acquiring or an easement tor alley purposes twenty
feet wide extending f'rom College Avenue to Cambridge Avenue rough-
ly paralleling Kl Camino Real approximately 100 feet Northeasterly
theretrom and the improving ot aa1d aaeement by grading, removing
trees and existing structures, conatruot1ng Portland Cement con-
crete alley aprons, storm water catch baa1n1, manhole and drain
pipe~ and constructing crushed rock baae pavement with asphaltic
concrete wearing surtace.
I. The improving of Cambridge Avenue between 11 Camino Real
and Park Boulevard and Second Street between Cambridge Avenue and
California ivenue by installing electrol1era complete w1th
Portland Cement concrete bases and with underground conduit and
conductor cabl~.
2. All or d&1d work and 1mprov&menta are to be constructed
at the places and in th• particular locations, or the forms,
sizes, dimens1one and materials, and to the lines, grades, and
elevations aa shown and delineated upon the plans and apec1f1ca-
t1ona prepar.d therefor, and on tile 1n the office or the City
Engineer in the City Hall or said C1tyJ reference to which 18
hereby made for full and detailed deacr1pt1on or said proposed
work and for turther part1culara.
3. There is hereby excepted trom the above work that which
1e alread7 done to line and grade and marked excepted or shown
not to be done on the plane, profiles and spec1f1cat1ona.
4. The Council does hereby adopt and establish as the
orr1c1a1 grades tor said work the grades and elevations shown
upon said plane, profiles and apee1t1cat1ons. All such grades
and elevations are in feet and decimals thereof 1n reference to
the ott1c1al base and datum or said City.
5. All or aaid work shall be done under the supervision
of' the City Engineer or the C1 ty ot Palo Alto, and all or said
work and materials shall be done and furnished to his satisfac-
tion.
6. A map or plat or the land1 and 1mprovemente necessary
or convenient to be ta.ken tor euch proposed improvement haa been
filed lf'ith the City Clerk and approved by the Co-uncil, to which
reference 11 he:reb7 made ror turther part1cularu.

8. S&id contemplated acquisitions and 1mprovewenta, in
the opinion or th.ts Counoil, are or more than local or ordinary
public benefit, and the cost and expense or doing sa1d work and
the expensee incidental thereto, shall be ude t.:ia.rgeable upon
the d1str1c·t benef'1 ted thereby, which district shall consists of
the consolidated and compoa1te area.a ot all or the parcels o!'
prop•rty fronting on said acqu.1ei.t1.on and work, together •1th
all properties fronting on an1 etreet within one-half block of
an 1nteraect1on which 1s being improved, and the e~ter1or boun-
daries of said district are hereby declared to be the coterminous
boundarieact' said composite and consolidated area. The properties
eo benefited, and the boundaries thereof, are more particularly
shown on the map or said aeeeaament district on tile in the orr1ce
or the Clty Clerk or said C1ty, to which reference 1s hereby
made for a more detailed description thereof.
9. All publ1o streets, alleys, and ways 1n use in the
performance or the publ1o tunct1on shall be omitted from the
assessment hereinafter to be made to cover the coat or said im-
provement.
10. Notice is hereby given that serial bonds to repreaent
the unpaid·aseessment and bear interest at the rate or not to
exceed four per cent (4~) per annum, w111 be issued pursuant to
Part 4, Bond Plan C of Article IV of the Palo Alto Improvement
Procedure Code, the last installment of which shall mature n1n~
(9) yeara from the second day of July next oucceed1ng ten months
from their date.
11. Bxcept a.a herein otherwise provided for the 1ssuanoo o~
bonda, all or the above proposed work ahall be done in pursuance
of the provisions or Article V of said Palo Alto Improvement
Procedure Code.
12. Said acquisition and improvement proceedings are anal-
ogoue and similar in effect to those provided in the MUn1o1pal
ImproTement Act or 1913 and said bond proceedings are analogous
and similar 1n ertect to those provided in the Refunding AsaeA~
ment Bond Act or 1935, and, excepting as herein otherwise pro-
vided, these proceedings shall respectively b~ deemed taken
pursuant thereto.
13. Notice is hereby given that Monda~, the 26th day or
February, 1951, at the hour of ?:30 o!tHock P.M., at the Council
Chambers in the City Hall are hereby r1xed as the time and place
when and where any and all persons interested may appear and show
cause, if any they have, why the Council should not find and deter-
mine that the public convenience and necessity require the acq,uj.-
e1t1ons and improvements described and referred to in this
resolution, without further compliance with the Special Assessment
Investigation, Limitation and Majority Protest Act or 1931, as pro-
vided in Article I of sa1d Ordinance.
14. The City Clerk shall give notice of the adoption of
this resolution by publishing a Notice of Proposed Local Improve-
ment once in the Palo Alto Times, a daily newspaper published
and circulated in said City, and by posting same on or near the
Council Chamber door or said Council, said posting and publ1ca-
t1o~ to be had at leaet ten days before said date or hearing.
