Intention No. 1990 tt) order certain improvements to be ma.de 1n said City, under and pursuant to Article V of Ordi- nance No. 844 of said City, adopted January 13, 1941, entitled "Palo Alto Improvement Procedure Code", and to issue bonds t?Ursuant to Part 4, Bond Plan C of Article IV of said Ordinance No. 844, reference tc which resolution 18 hereby made for a particular des- cription of the improvements to be made, the boundaries of the assessment district and the bonds to b~ issued; WHEREAS, said Resolution of Intention No. 1990, wherein a11 persona interested, having any objections to the proposed improvements or against the district to be aseesaed for the coats and expenses thereof, or to the Engineer's estimate or the costs ~nd expenses thereof, or against the grades at which said work shall be done, or against the diagram er assessment, were r.ot1f1ed cf the time and place of the hearing as contained in said resolution or 1P.tention, was duly published within the time and in the manner provided in said Improvement Procedure Code, and as dir~cted by sald resolution. 1.'f intention, as appears from the arr1dav1 ts of publication on file in the office of the City Clerk of said City; WHEREAS, at the time and place fixed for said hearing protests or objections were made or presented to the proposed improvements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be 1osued to pay the costs and expenses thereof, or to the Englneer'a estimate of the costs and expenses thereof, or against the diagram or aeseasment, and all persons interested desir.ing to be heard were given an oppoi:-tuni ty to be heard, and all matters and things pertaining to said proposed improvements were duly heard and considered b~ said Council, and were overruled, and said Council has acquired jurisdiction to order said improvements and to confirm said assessment to pay the costs and expenses thereof; NOW, THEREFORE, said Council does hereby FIND, DETERMINE and ORDER, as follows: 1. That the plans and specif1cat1ons for street improvements under said Resolution of Intention be, and they are hereby, finally adopted and approved as the plans and specifications to which said work and improvement shall be done as called for in said Re~olution of Intention. 2. That the Eng1neer1 s estimate of the itemized and total estimated cost and expenses for said improvements, be, and it is hereby 1 finally adopted and approved as the Engineer's total and detailed estimate of the costs and expen~es of said improvements. 3. All p~1blic streets, alleys a.nd way 1n use in the perfor- mance of the public function shall be omitted from the assessment hereinafter to be made to cover the cost of seid 1mpro\ement. • .. •'.:;· ,,, T :.. '.rha t the public 1nterea t and convenience require, and ea1d Council does hereby order the improvements to be made as deec:1"ibed 1n and in accordance w1th said Resolution of Intention, on file in thP. office or the City Clerk of sai.d City, reference to which 1s hereby made for a more particular description of said improvements and also for further particulars, pursuant to the provisions or Article V of said Improvement Procedure Code. 5. That the map of the a3sessment district be, ana the same 1s hereby, finally adopted and approved as the map of the assess- ment d1str:1.ct, and the boundary of said assessment district aa ehown thereon ls hereby determined and established to be the boun- dary of the assessment district to pay for the costs and expenses of said improvements. 6. That the assessment and diagram for the cost and expenses or the im~rovements described in said Resolution of Intention be~ and the same 1a hereby, ratified, approved and confirmed as the assessment and diagram to pay the coats and expenses of said improvements. (. That the City Clerk of 3a1d City shall deliver aa1d dia- gram and assessment to the Superintendent ot Streets of said City, together with a certified copy of this resolution thereto attached, and said Superintendent of Streets shall thereupon record auch aaseasn1ent and diagram in his office in a su1 table book to be kept for that purpose and append thereto hia certificate of the date of such recording, and such record shall be the assessment roll to pay for the costs and expenses of said improvements. 8. Immediately upon such recordation said Super!ntendent of Streets shall give notice thereof by two publications in the Palo Alto T1mea, a newspaper printed and published in said City, which notice a hall set f'ot-th, among other things, that all sums asoessed therein are due and payable at hia office immediately, and that pay- ment thereof is to be made to him within thjrty days after the date of recording said assessment, which date shall be 3tated 1n said notice, and such other matters as are required by Section 7 of Article V of said Improvement Proc~dure Code. * * * * * • * I hereby certify the foregoing to be a true copy of resolution adopted by the Council or the City of Pa.lo Alto, California, at a regular ~eet1ng thereof held on the 11th day of September, 1950, by the following vote of the members thereof; AYES, and 1n favor thereof, Councilmen: Blois, Bolander, Bowden, Bower, Cashel, Cathcart, Freedman, Gaspar, Hill, Linder, Montreuil, Morten, Wickett. NOES, Councilmen~ None.
