Home My WebLink AboutRESO 2021I· ~ "' 450 that R ~ S 0 L U T I 0 N ----------N 0 • 2021 ORDERING ACQUISITIONS AND IMFROV'.IMENTS A.ND CONFIRMING ASSESSMENT PROJECT No. 50-5 EMBARCADERO ROAD, ET AL ACQUISITION AND IMPROVEMENT RESOLVED, by the Coune11 of the City of Palo Alto, California, WHEREAS, the Council did on the 14th day of Auguet, 1950, adopt ita :Resolution or Intention No. 2017 to order r.:erta1n acqu1aitione and improvements to be made 1n said City, under and pursuant to Article V of Ordinance No. 644 of said City, a~opted January 13, 1941, entitled 11 Pal9 Alto Improvement Procedure Code", and to 1seue bonds pursuant to Part 4, Bond Plan C of Article IV of said Ordin- ance No. 844, reference to which resolution is hereby made for a particular description of the acquisitions and improvements to be made, the boundaries of the assessment district and the bonds to be issued; WHEREAS, said Resolution of Intention No. 2017 has been duly published twice in the Palo Alto Times, a newspaper or general cir- culation printed and published in said City, wherein all persons interested, having any object1ona to the proposed acquisitions and improvements or against the district to be assessed for the costs and expenses thereof, or to the Engineer's estimate or the costs and expenses thereof, or against the grades at which said work shall be done, or against the diagram or assessment, were notified or the t1mea and places or the hearings as contained in said resolution of intention, said resolution of intention was duly published within the time and in the manner provided in said Improvement Procedure Code, and as directed by said resolution or intention, as appears from the affidavits or publication on tile in the office of the City Clerk of said City; WHEREAS, at the times and places fixed for sa1d hearings no protests or objections were made or presented to the proposed acquisitions and improvements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonds to be issued to pay the costs and expenses thereof, or to the Engineer's estimate of the costs and expenses the:-eof, or aga:i.nst the diagram or assessment,' and all persons interested de- siring to be heard were given an opportunity to be heard, and all matters and things pertaining to aaid proposed acqu1s1t1ona and improvements were duly heard and considered by said Council, and were overruled, and said Council has acquired .Jurisdiction to order said acquisitions and improvements and the confirmation or said assessment to pay the costs and expenses thereof; NOW, THEREFORE, said Council does hereby FIND, DETERMINE and ORDER, as follows: · l. That the plans and specifications for street improvements under said Resolution of Intention be, and they are hereby, finally adopted and approved as the plans and spec1f1cat1ons to which said work and improvement shall be doneas called for 1n aa1d Resolution of Intention. 2. That the Engineer's estimate of the itemized and total estimated cost and expenses for said acquisitions and improvements, be, and it is hereby, finally adopted and approved as the Engineer's total and detailed estimate of the costs and expenses of said acqu1-si t1ona and improvements. 3. That the maps and deaer1pt1one ot the lands and easements to be acquired be, and they are hereby finally adopted and approve~:. 5. That the public interest and convenience require, and said Council does hereby order the a~quisitions and improvements to be made as described in and 1n accordance wlth said Resolution or Intention, on file in the office of the City Clerk or said City, reference to which is hereby made for a more particular description of said acquisitions and improvements and also for further particulars, pursuant to the provisions or Article V of said Improvement Proceduce Code. 6. That the map ~r the assessment district be, and the same is hereby, finally adopted and approved as the map or the assessment district, and the boundary of said assessment district as tihown thereon is.hereby determined and established to be the boundary or the assessment .district to pay tor the costs and expenses or said acqu1a1t1ons and improvements. 7. That the assessment and diagram for the cost and expenses or the acqu1si tions and improvements described. in said Resolution or Intention be, and the same is hereby, ratified, approved and confirmed a3 the assessment and diagram to pay the cost3 and ex-penses or aa1d acqusitiona and 1mprovements. 8. That the City Clerk of said City shall deliver said dia- gram and assessment to the Superintendent of Streets or said City, together with a certified copy of this resolution thereto attached, and sa1d Superintendent of Streets shall thereupon reco~d such assessment and diagram in h1a office in a .suitable boov to be kept tor that purpose and append thereto l:1s certificate of the Gate of such reco:rd1ng and such record shall be the assessment roll to pay t•or the co3ts and expenses of said acquis1 t1ons and improvements. 9. Immediately upon such recordation said Supe1·1ntendent of Streets shall glve notice thereof by two publicationa :tn the Palo Alto Time5~ a newspaper printed and published in said City, which notice shall cet forth, among other things, that all sums asse~sed there1t) are due and payable at his office :l.mmediately, and that payment thereof ia to be made to r1m within thirty days after the date or recording sa1d assessment, which date shall be stated in said notice, and. auch other matters as are required by Section 7 of .Artir..:le V of said Improvement Procedure Code. * * * * * * * I hereby certify the foregoing to be a true copy or resolution adopted by the City Council of the City of Palo Alto, California at a regular meeting thereof held on the 28th day of August, 1950, by the following vote of the members thereof: AYES, and in favor thereof,, Councilmt:.;1: Blois, Bolander, Bowden, Bower, Cashel, Cathcart, Freedman, Oas-par, Hill, Mitchell, Montro1111, Wicl<ett.
