R E S 0 L U T I O N ----------N O • 2017
OR INTENTION TO MAKE ACQUISITIONS
AND IMPROVEMENTS
PROJECT NO. 50-5
EMBARCADERO ROAD, ET AL
ACQUISITION AND IMPROVEMENTS
R.ESOLVED, by the City Council of the City of Palo Alto,
California,, that in its opiriion the public interest and. con-
venience require, and that it 1s the intention or said City Council
to order the followi·ng work to be done and improvements to be made
1nsa1d City, to-wit:
1. The improving of Embarcadero Road for 1ts full width
from Newell Road to Wildwood Lane and the southerly side thereof
!'rom W:tldwood Lane· to the easterly line or Lot 9 in Block 361,
St. Francis '1,errace Subd1 vision by a.cq\.11ring eight 1'eet on the
southerly aide thereof only as necessary to obtain un1for:n
eighty-six foot width for widening,, by grading and removal of trees
and existing structurea, constructing or reconstru~t1ng Portland
Cement Concrete curbs, gutters, sidewalks, driveway aprons, storm
water drain pipe and catch basins complete with cast iron frames
and gratings and brick manholes complete with cast iron frames
a.nd covers and galvanized wrought iron steps, constructing crushed-
rock base pavement and asphaltic concrete wearing surface between
gutter lip and edge of existing center strip pavement with
feathering to meet existing pavement where required, 1nstallir1g
electroHera complete with concrete bases and lum1na1res and
conduit and conductor cable, and constructing vitrified clay pipe
sanitary sewer services, copper pipe water services and wrapped
steel pipe gas services.
2. The improving of the northerly one-half' of Channing
Avenue from westerly line of Lot 4, Greer Partition, to the
westerly line of Crescent Park Addition and from the easterly line
of J..ot 13, Block 185~ Crescent Park Addition, to Greer Road, the
westerly one-half of Greer Road from Channing Avenue to Hamilton
Avenue, the southerly cne-half of Hamilton Avenue from Greer Road
to the easterly '\.ine of Lot 1, Block 185, Crescent Park Addi t1011,
and Alee.ter Avenue throughout its entire length by grading, remo·.ra.l
of trees and existing structures, constructing or reconstru.cting
Portland Cement Concrete curbs, gutters, sid9walka, storm water
drain pipe &nd catch basins complete w1th cast 1ron frames and
gratings, constructing crushed-rock base pavement and asphaltic
concrete wearing surface, installing electroliers complete with
concrete bases and lum1na1res and conduit and conductor cable, and
constructing vitrified clay pipe sanitary sewer aervices, copper
pj,pe water services and wrapped steel p1pe gas services, and the
1m~rov1ng of Bn ~na Avenue for its entire length by constructing
therein all the improvements described in this section plus
driveway aprons.
Installing electrolier on the south side of Channing
Avenue opposite Rhodes Drive, and on the north side of Hamilton
Avenue appro~1mately 350 feet west of Greer Lane.
3. Whenever any public way is herein referred to as run-
ning between two public ways, or from or to any public way, the
intersections of the public ways referred to are included to the
extent that work shall be aholn~ on the plans to be done thereon.
4. Said streets, avenues 1 roads, courts, and rights or
way are more particularly shown 1n the records of the office or

Clerk of aa1d City.
5. All or sa1d work and improvements are to be conetruc-

ted at the places and in the particular locations, or the forms,
sizes, dimensions and mater1ale, and to the lines and grades, and
at the elevations, as shown and delineated upon the plans, profiles,
and apec1f1cationa made therefor and preliminarily approved by the
City Council or said City at a regular meeting thereof duly held on
the 12th d~y of .rune, 1950,, and on file 1n tho office of the Cj. ty
Engineer in the City Hall of said City, ref,erence to which 1a
hereby made for a full and detailed description of said proposed
work and for further particulars.
6. There is hereby excepted from the work above described
any of such work already done to line and grade, and marked
excepted or shown not to be done on the plans, profiles and
apec1f1cat1ons.
7. Said City Council does hereby adopt and establish a3
the grades for said work the grades and elevations shown upon
sa1d. plans and profilea, to which reference 1s hereby ma.de for a
descr:tpt1on thereof. All such grades and elevations are in fPet
and dectmala the;:-eof in reference to the official base and datum
of said City. In many cases aald grades are new or different
from the surface of the ground.
8. All or said work and improvements shall be done under
the s~pervislon of the City Engineer of the City or Palo Alto,
and all said work and materials shall be done and furnished to
his aat1sfact1on.
9. Notice ~Lf{ hereby given that, pursuant to Section 2 of
Article V of O~dinance No. 844 of said City, commonly designated 11 Palo Alto Improvement Procedure Code", adopted January 13, 1941,,
the City Engineer or said City has filed with the City Clerk of
said Clty, accompanying the plans and apec1f1cat1ons above re-
ferreQ to, a statement of the total and itemized estimate cost
or said improvements, inclusive of incidental costs and expenses
of this proceeding, stating therein separately the estimated coat
of each class of construction proposed, and the incidental ex-
penaes such as engineering and inspection, and the cost of pre-
par1n$ proceedings, the total est1mat~d cost or which is stated
as $98,003,.77, which is open to public inspection.
10. Sald contemplated work and :l.mprovements, in the
opinion o.r this Council, 1s of more than local or ordinary public
benefit, and the cost and expense or doing said work and the
expense 1nc:tdental thereto·, shall be made chargeable upon the
dietrict benefited thereby, which district shall consist or the
consolidated and composite areas or all of the parcels of pro-
perty fronting on said work, together with all properties front-
ing on any street within one-half .block of any intersection which
is being j,mproved hereunder,, and the exterlor boundarlea of said
district are hereby declared to be the coterminous boundaries
of said composite and consolidated area. The properties so
benefited, and the boundaries thereof, are more particularly
shown on the map of said assessment district on file in the
office of the City Engj,neer of sald Cl ty to which reference is
hereby made for a more detailed description thereof.
ll. Notice is further given that there :l.s on f1le with the
City Engineer a diagram of the asee~sment district showing each
lot or aubdivis:.i.on or land to be assessed and the dimensions
thereof, and an assessment of the estimated cost of said work
and improvements upon said lots and parcels according to bene-
f1 ts to be received from said work and improvements, each of
which have corresponding numbers of each such lot or parcel.

12. All publicly owned property in said assessment dis-
trict, shall be assessed ror !ts share or the cost of said bene-
fits and the amount thereof paid in cash by the City. All pub-
lic streets, alleys and ways 1n uae in the performance of the
public function shall be omitted from the assessment here1narter
to be made to cover the c~at of said improvement.
13. Notice 1s hereby given that aerial bonds to represent
the unpaid assessments and bear interest at the rate of not to
~xceed four per cent (4~) per annum, will be issued pursuant to ~art 4, Bond Plan C of Article IV of the Palo Alto Improvement
Procedure Code, the last installment of wM.ch shall mature nine
(9) years from the second day of July next succeedlng ten months
from their date.
1-4. Except as herein otherwise provided for the ir;suance
or bonds, all of the above proposed work shall be done 1n pur-
suance of the provisions of Article V of said Palo Alto Im-provement Procedure Code.
15. Proceedings h;;i.ve been had and taken by said Council
ln full compll&nce w.tth the provisions of Art:tcle I of said Palo
Alto Improvement Procedure Code.
16. Notice ls hereby given that Monday, the 28th day of
August, 1950 at the hour or 7:30 O!clock P.M. at the Council Ch.amber, or the City Counc11, City Hall, Palo Alto, California, is hereby
fixed as the tlme and place when and where any and all persons having
any objections to the proposed improvements or against the d1etr1ct
to be assessed for the costs arid expenses thereof, or to the City
Engineer's estimate or the costs and expenses thereof, or against
the grades at which sa.id work shall ·be done, or against the diagram
or assessment, may appear before said Council and show cause why
said proposed improvements should not be carried out in uccorda11ce
with this Resolution of Intention.
17. The Clerk vf said City shall caase this Resolution of
Intention to be publ:lshed twice 1n the Palo Alto Times, a daily
newspaper, pub11sh~d and circulated in the City of Palo Alto, which
said paper ls hereby designated for that purpose, and which is hereby
designated as the newspaper in which all further notices required to
be made ::-ierein shall be published.
I hereby certify the foregoing to be a true copy of resolution
adopted by the City Councll of the Clty of Palo Alto, California,
at a regul~r meeting thereof held on the 14th day of August, 1950,
by the follow:1.ng vote of the members thereof:
