EMBARCADERO ROA.D, ET AL
ACQUISITION AND IMPROVEMENT
RESOI.'llED, by the Council of the City of Palo Alto,
California, that 1t does hereby prel1m1nar1ly determine that the
public convenience and necessity require, and that it intends to
order the following acquisitions be had, work to be done and
improvements to be made in and for said City, to-wit:
1. The improving of Embarcadero Road for its full
width frorn Hewell Road to Wildwood Lane and the southerly side
thereof 1'rom Wildwood Lane to the easterly line of Lot 9 1n Block
361, St. Francis Terrace Subdivision by acquiring eight feet on
the southerly side thereof only as necessary to obtain un1rorm
eighty-six foot width for widening, by grading and removal of trees
and existing structures, constructing or reconstructing Portland
Cement Concrete curbs, gutters, sidewalks, driveway aprons, storm
water drain pipe and catch basins complete with cast iron frames
and gratings and brick manholes com~lete with cast iron frames
and covers and galvanized wrought iron steps, conetruct1ng crushed-
rock base pavement and asphalt1c concrete wearing surface between
gutter lip and edge of existing c.enter atrip pavement with
feathering to meet ex1st:l.ng pavement where required, installing
electro11ers complete with concrete bases and luminaries and
conduit and conductor cable, and constructing vitrified clay pipe
sanitary sewer services, copper pipe water services and wrapped
steel pipe gas services.
2. The improving of trenortherly one-half o~
Channing Avenue from the westerly line of Lot 4, Greer Partition,
to the westerly line of Crescent Park Addition and from the
easterly line of lot 13, Block 185, Crescent Park Addition, to
Greer Road, the westerly one-half of Greer Road from Channing
Avenue to Hamilton Avenue, the southerly one-half of Hamilton
Avenue from Greer Road ·to the easterly line of Lot 1, Block 185,
Crescent Park Addition, and Alester Avenue throughout its i?ntire
length by grading, removal of trees and existing structures, con-
structing or reconstructing Portland Cement Concrete curbs,
gutters, sidewalks, storm water drain pipe and catch basi.ns com-
plete with cast 1ron frames and gratings, constructing crushed-
rock baoe pavement and asphalt:tc concrete wearing surface,
install:l.ng electroliers complete w1 th concrete bases and luminaries
and conduit and conductor cable, and constructing v1tr1fied clay
pipe sanitary sewer services, copper pipe water services and
wrapped steel pipe gas services, and the improving of Enc1na
Avenue for its entire length by c\nstruct1ng therein all the
improvements described 1n this section plus driveway aprons.
3. All of sa1d work and improvements are to be con-
structed at the places and in the particular locations, or the
.forms, sizes, dimensions and materials, and to the lines, grades,
and elevations as shown and delineated upon the plans, profiles,
and spee1f1cat1ons prepared therefor, and on file 1n the office
of the City Engineer in the City Hall of said City, reference to
which is hereby made for full and detailed deacr1pt1on of said
proposed work and !'or further particulax-s.
4. There is hereby excepted from the above work
that which is already done to line and grade and marked excepted
or shown not to be done on the plans, profiles and apec1f1cat1ons.

,,-. . 5. The City Council does hereby ad.opt and es\;ablish
as 'l;tie official grades for said work the grades and elevations
shown upon sa1d plans, profiles and specif1caticns. All such
grades and elevations are in feet and decimals thereof 1n
reference to the official base and datum of said City.
6. All of aaid work shall be done under the super-
vision of the City Engineer or the City of Palo Alto, and all or
said work and materials shall be done and furnished to his satis-
faction.
7. A map or plat of the lands and improvements
necessary or convenient to be taken for such proposed improvement
has been filed with the City Clerk and approved by the City
Council, to which reference is hereby made for further particulars.
8. A statement of the total estimated cost or said
improvement, stating separately the estimated cost of each class or construction proposed, and of each parcel of land or improve-
ment proposed to be acquired, and or the indidental expenses of
sc1d proceedings and of sa1d acqu1a1t1ons and improvements has
been filed with the City Clerk and approved by the City Council,
to which reference is hereby made for further particulars.
9. Said contemplated acquisitions and improvements,
in the opinion or this Council, are of 1.10re than local or ordinary
public benefit, and the.balance or the cost and expense of doing
said work and the expensee incidental thereto, shall be made
chargeable upon the district benefited thereby, which d1str1ct
shall consist of the consolidated and composite areas or all of
the parcels of pro~erty fronting on aaid acquisition and work,
together with all properties fronting on any street with1n one-
half block or an intersection which is being improved~ and the
]
exterior boundaries of said district are hereby declared to be ·
the coterminous boundaries of said composite and coneol1dated area. j
The properties so benefited, and the boundaries thereof, are more '
particularly shown on the map of said aa~essment district on file -
in the office of the City Clerk of said C1ty, to which reference
is hereby made for a more detailed description thereof.
10. All public atreets, alleys, and ways in use 1n
the performance of the public function shall be omitted from the
assessment hereinafter to be made to ~over the cost of aa1d
improvement.
11. Notice 1s hereby given that serial bonds to
represent the unpaid. assessments and bear interest at the rate of
not to exceed four per cent (4~) per annum, will be issued pur-
suant to Part 4, Bond Plan C of Article rv or the Palo Alto
Improvement Procedure Code, the last installment of which shall
mature nine (9) years fX'Om the second day or July next succeeding
ten mo~ths from their date.
12. Except as herein otherwise provided for the
issuance of bonds, all of the above proposed work shall be done in
pursuance of the provisions of Article V of said Palo Alto
Improvement Procedure Code.

13. That said acquisition and improvement proceedings
are analogous and similar in effect to those provided in California
Statutes of 1913 at Page 421 et seq., as amended, and said bond
proceedings are analogous and s1m11ar in effect to those provided
in D1v1s1on 10 of the California Streets and Highways Code, and,
excepting as herein otherw1oe prov1ded1 these proceedings shall
respectively be deemed taken pursu~nt thereto.

14. Not1ee is hereby given that Monday, the 10th
day or July, 1950, at the hour or 7:30 o'clock P. M., at
the Council Chamber of the City Council or said C1ty in
the Cl.ty Hall of sa.1d C:tty are hereby fixed as the t1me and place
when and where any ar'd all persons tnterested ma.y appear and show
cauee, if any they have, why the City Council should not find and
determine that the public convenience and necessity require the
improvements described and rerer~d to in this resolution, without
further compliance with the Special Assessment Investigation,
Limitation and Majority Prote3t Act or 1913, ae provided in
Article I or said Ordinance.
15. The Clerk of the City of Palo Alto shall give
not!ce of the adoption of th1s reaolut1on b:r pub11eh1ng a Notice
of Proposed Local Improvement once in the Palo Alto Times, a daily
newspaper published and circulated in said City, and by posting
same on or near the Council Chamber door of sa1d Council., said
posting and. publication to be had at least ten days be.fore said
d.ate of. hearing.

I hereby certify the foregoing to be a true copy of
resolution adopted by the City Council or the City or Palo Alto,
California, at a regular meeting thereof held on the 12th day or
June, 1950, by the following vote of the mlmbere thereof:
