OF INTENTION TO CONSTRUCT IMPROV'.!MB..'fr PROJECT NO. .50-l STREIT LIOH'rINO RECONSTRUCTION DISTRICT OD RESOLVED, by the City Council of the City of Palo Alto, Cal1.forn1a, that :l.n ita opinion the public lnterest and conven- ience require, and that it is the intention or s~id City Council to order the following work to be done and improvements to be made 1n sa1d City, to-wit: 1. The improving of Middlefield Road from San Francisquito Creek to Forest Avenue by the installation of suspended lumina:tres complete with overhead wiring, ·guy strand, poles and appurtenant equ1pment and fixturee. 2. The improving of University Avenue from Middlefield Road to the westerly line of Crescent Park Subdivision, Palo Alto Avenue from Alma Street to Marlowe Street, Poe S.treet and Bryant Court from Bryant Street to Waverley Street, Ruth¥en Avenue frOQ Waverley S~eet to Webster Street, Hawthorne Avenue from Alma Street to Middlefield Road, ·Everett Av·eni.l.e from.. Whenever any public way 1s herein referred to as running between two public ways, or from or to any public way, the inter- sections of t:-ie public ways referred to are included to the extent that work shall be shown on the plans to be done thereon. 5. Sa1d streets, avenues, roads, courts and rights of way are more partic11larly shown 1n the records of the office of the County Recorder of Santa Clara County, Cal1!'ornia, and are shown 1;.pon the plans herein referred to and filed with the City Clerk of said City. 6. Allor said work arid improvements are to be constructed at the places and in the particular locations, of the forros, s:l..zes~ dimensions, and materials, and to the 11nes and gradeo, and at the elevations, as shown and delineated upon the plans, pro- files and speeif1cat1ons made therefor and preliminarily ap- proved by the City Council of said City at a regular meeting thereof duly held on the 13th day of March. 1950, and on file :i.n the office of the C1 ty Engineer 1n the City Hall or said City, re:terence to which is hereby made for a full and detailed deecr1pt1on of said proposed work and for further part1culara. There is hereby excepted from the work above described any of such work already done to l1ne and grade, and marked excepted or shoWl"l not to be done on the plans, profiles and 3peciflcations. 8. Sald City Council doe3 hereby adopt and establish as the grades for said work the grades and elevations shown upon naid plans and profiles, to which reference 1s hereby made for a description thereof. All such grades and elevations are in feet and decimals thereof in reference to the official base and datum of said City. In many cases said grades are new or different from those formally established by the Council, and from the surface of the ground. 9. All of said worJ( and improvements shall be done under the supervision of the City Engineer of the City of P~lo Alto, and all 3aid work and materials shall be done and furnished to his satisfaction. 10. Notice is hereby g:'l.ven that, pursuant to Section 2 of Article V of Ordinance No. 844 of said City commonly deslb- nated "Palo Alto Improvement Procedure Coded 1 ·adopted January 13, 1941, the City Engineer of said City has filed with the City Clerk of said City, accompanying the plans and spec1f1cat1ons above referred to, a statement or the total and itemized estimated cost of said improvements, inclusive of incidental costs and ex- penses of this proceeding,stating therein separately the esti- mated cost or each class of construction proposed, and the 1nc1- dental expenses such as eng1neer1ng and inspection, and the coet of preparing proceedings, the total estimated cost of which ls stated as $55,754.00, which 1e open to public inspection. 11. Said contemplated work and ·improvements, in the opinion of this Council, is of more than local or ordinary public "bene- r1 t, and the cost and expense of doing said work and the expenses incidental the:r-eto, ::3hall be made chargeable 1..i.pon the district benefited thereby, which district shall conslat or the consoli- dated and composite areas of all of the parcels or property frontlng on said work, together with all properties fronting on any street within one-half block or an intersection which 10 being improved hereunder, and the exterior boundaries of said district are hereby declare·d to be the coterlilinous boundar1ea of said composite and consolidated area. The properties so benefited, and the boundaries thereof. are more particularly shown on the map of' said assessment district on file in the office of the City Engineer or said City to which reference is hereby made :f.or a more deta:l.led description thereof. 12. Notice is further given that thereia on file with the City Englneer a diagram or the assessment district showing each lot or subdlvieion of land to be assessed and the dimensions thereof, and an assessment of the estimated cost or sa:td work and improvements upon said lots and parcels according to bene- fits to be rece:tved from said work and improvements, each of wh:Lch have corresponding numbers of each such lot or parcel. 13. All publicly owned property in said assessment dis- trict, shall be assessed for 1ta share or the cost of said benefits and the amount thereof paid in cash by the City. All public streets, a1J.eys· and ways in use 1n the performance of the p11bl1c function shall be omitted from the assessment hereinafter to be made to cover the cost or said improvement. 14. Notice ia hereby given that serial bonds to represent the unpaid assessments and bear interest at the rate of not to exceed four per cent (4%) per annum, w111 be issued pursuant to Pa~t 4, Bond Plan C of .Article IV of the Palo Alto Improvement _J J _J ~ f I i ! M. at the Council Chambers of the City Col).nc11, City Hall, Palo Alto, California, is hereby fixed as the time and place when and where any and all persons having any objections to the proposed improve- ments or against the district to be assessed for the costs and expenses thereof, or to the City Engineer's est:tmate of the costs and expenaes thereof, or against the grades at which said wor~~ shall be done, or against the diagram or assessment, may appear bef orc said Council and show cause why said proposed im- provements should not be carried out 1n accordance with this Resolution of Intention. 18.
