OF INTENTION TO MODIPY PROCEEDINGS
BARTLEY TRACT AUZ'!
ACQUISITIONS AND IMPROVKMElt"TS
PROJBCT MO. 48-12·
RESOLVED, by the Council or .the City or Palo Alto, Calif-
ornia, that 1t !s the intention of said Council to change and
modify the pr1:>ceed~.nga under 1 ts Reeolut1on ot Intention No.
1712 adopted by said Council on July 12, 1948, ae follows:
1. That the publio convenience and necessity require and
it 1~ the intention of this Council to change and modify the
proceedings by consolidating with the acquisitions already
ordered herein the following work and improvements, to-wit:
(a) The improving of unnamed alleys proposed to be
acquired in. Blocks 5 and 7, between Fernando Avenue and the
center line of Block 71 Bartley Tract, all as· more particularly
described in mapa and diagrams on tile 1n these proeeed1nga, by
grading, removal or existing trees and structures, c~nstruct1on
or crushed rocl{ base pavement with aaphal tic concrete wearing
surface between property lines, and constructing Portland cement
concrete approach aprons at street 1ntersect1ona and across sidewalks.
(b) The 1mprov1ng of an existing unnamed alley in
Block 7, 11 and 12 or Bartley Tract as shown on Bartley Tract ~..ap No. 3, recorded in the office of the Recorder or Santa Clara
County on February 26, 1915, in Book 0 at Page 66 1 extending
from the center 11ne of Block 7 of. said Bartley Tract to the
southerly city l1m1ta or the City or Palo Alto, by grading
removal of existing trees and structuree~ constructing crushed
rock base pavement with asphaltic concrete wearing surface be-
tween property lines, and constructing Portland cement concrete
approach aprons at street 1nteroect1ons and across a1dewalka.
2. That the public conv•n1ence and neceBsity require and
it is the intention or this Council to change and modify the
"' ~atimate of costs for said acqu1.s1t1ons an.~ · 1mprovemente to not to exceed $10,000.00.
3. The public convenience and necessity require and it is
the 1ntent1on.of this Council to change and modify the assess-
ment by increasing it by the cost of the improvement work and
1ncrea.s1ng the 1nd1 vidual assessments by their prorata share of the bener1ts.
4. That said changes and modit1cat1on3 be made by the City
Eng::l.neer upon the race of the plans and estimate cif costs on
f1le w1 th the City Clerk, or by f:Uing amended copies thereof or amendments thereto.
5. That reference be, and 1a hereby made, to the amended
plans and amended estimate of costs on file in the office of
the City Clerk o.f said C1ty, to which reference ls hereby made
for further paPticulars.
6. All or said work and improvements are to be constructed
at the places and in the particular locations, or the forms,
aizea, dim~nsions and materials and to the lines, grades and
elevations as ahown and delineated upon the plane, p~of1les and

apec1f1cat1ona prepared therefor and on flle in the offices of
the City Engineer in the City Hall or said City, reference to
wni.ch 1e hereby made for further a·nd deta1le<l description of
said proposed acquisition and work and fo::.-further particulars.
7. There is hereby excepted from the above work that
·whlch 1s already done aa to line and grade and marked excepted or 3ho~-n not to be done.
8. Said 5treets, avenues, roads, courts and rights of way
are more particularly shown 1n the records or the office or the
County Record.er or Santa Clara County, California, and are ~hewn on the plans herein referred to and filed with the City
Clerk or said City. The City Council does hereby adopt and
establish as the official grades for ea1d work the grades and
elevations shown upon said plans and profiles, to which ref-
erence is he~eby made for descriptions thereof. All ouch grades
and elevat1on3 are in feet and decimals the~eor in reference to the official base and datum of said City.
9. All of said work and 1mprovementa shall be done under the supervision of the City Engineer of the City of Palo Alto,
and a.11 of Ba1d work and material shall be done and .f'urn.1shed to h1a satisfaction.
10. A map or plat of the lands and improvements necessary
or convenient to be taken for such proposed improvement hae bee:1
f1led with the City Clerk and approved by the City Council, to
which reference is hereby made tor further particulars.
11. Notice ia hereby given that pursuant to Section 2
or Article V of Ordinance 844 or said City, commonly designated 11 Palo Al to Improvement Procedure Code'' adopted January 13,.
1941, the Clty Engineer or said City has f11ed with the City
Clerk or said City, accompanying the plane and specifications
above referred toj a 5tatement or the total and itemized esti-
mated cost of said acqu1e:t t:tons and improvements, excluai ve or
incidental costs and expenses of this :i:-roceed1ng stating therein
separately the estimated cost of each class or construction pro-
posed and or each parcel or land or improvement proposed to be
acquired» the incidental expenaee such Rs eng1neer1ng, 1napect1on
and the cost of preparing proceedings, which is open to ppbl1c inapection.
12. Said contemplated acquis:1.t1ons and improvements 1n the
opinion of' this Council are or more than loca.1 orcrd1nary pub-
lic benefits, and the costs and expenses or said work and
acquisitions and the expenses incidental thereto~ shall be made
chargeable upon the d1atr!ct benefited thereby, wh1ch district
ahall consist of the consolidated and composite areas of all of
the parcels of property fronting on said acquisitions and 1111-
provements 1 and the exterior boundaries of said district are
hereby determined to be the coterminous boundaries of said com-
posite and coneol1dated areas. The property so benefited, and
the uoundar1es thereof, are more particularly shown on the map or said assessment d1str:1.ct on file 1n th~ office or the City
Clerk of said City to which reference is hereby made for a more detailed cleecr1pt·1on thereof.
13. All public streets, alleys and ways 1n uae in the
per:!'ormance of the public function shall be omitted from the
aaaeaament hereinafter to be made to cover the costs of said acquisitions and improvements.
14~ Notice 1a further given that there is on file ~~th
the City Clerk a diagram of the assessment district showing each
lot or aubd1v1sion of land to be assessed and the dimensions

thereof, and assessment of the estimated costs or said work,
acqu151t1ons and improvements upon na1d lots and parcels accord-
ing to benefits to be received from said work, acqu1s1t1ono and
improvements, each or which has corresponding numbers for each
such lot or parcel.
15. Notice is hereby given that serial bonds to represent
the unpaid assessments and bear interest at the rate or not to
exceed four per cent (4~) per annum will be issued pursuant to
Part 4, Bond Plan C of Article IV of the Palo Alto Impr~qement
Procedure Code, the last installment or which shall mature n1ne (9) years from the second day of July next succeeding ten months
from their date.
16. Except aa herein otherwise provided for the issuance
of bonds all of the above proposed work and acqu1s1tion.s shall
be done in pursuance or the provisions or Article v or sa~Ld
Palo Alto Improvement Procedure Code.
17. Said acquisition and improvement proceedings are
analogous and similar ln effect to those provided in California
Statutes of 1913 at page 421, et seq., as amended, and said bond
proceedings are analogous and similar in effect to those provided
1r1 :Di v1a1on 10 of the California Streets and Highways Code, and,,
excepting as herein otherwise provided, these proceedings shall
respectively be deemed taken pursuant thereto.
18. Proceedings have been adopted and taken by eaid
Council in full compliance w1th provisions of Section 8, Artlcle
I or said Palo Alto Improvement Procedure Code.
19. Notice is hereby given that Monday, the 8th day of
nay, 1950, at the hour of '(:30 o'clock P. M. at the Council
Chambers, City Hall, Palo Alto, California, 1s hereby fixed
as the time and place, when and where any and all persor1s
having any objections to the proposed acquisitions or
improvements or against the district to be assessed for the
costs and expenses thereof, or to the City Engineer's estimate
of the coats and estimate thereof, or against the grades at
which sa.16 work shall be done, or against the diagram or assess-
ment, may appear before said Council and show cause why said
proposed :lmproveme,nts shall not be carried out in accordance
with this Resolution or Intention to modify.
20. That a copy of this Resolution be published once in
~he Palo Alto Tlmes and posted on the bulletin board at the
City Hall, the publication and posting to be at least ten (10)
days before t~c date set for hearing.
