DETERMINING TO MAKE IMPROVEMENT WITHOUT
COMPLIANCE WITH INVESTIGATION ACT
BARTLEY TRACT ALLEY
ACQUISITIONS AND IMPROVEMENTS
PROJECT NO. 48-12
RESOLVED, by the Council of the City 01' Palo Alto,
Califor·nj.a,, that
WHEREAS, on ~.arch 13, 1950, thls Counc1.l adopted its Resolu-
tion of P~eliminary Determination No. 1960 to make the public
improvements more particularly described therein,, and did f1x
therein this date as the time and place when and where any and
all persons interested may appear and show cause, 1.f any they
have, wh~ the City Council should not find and determine that the
public convenience and necessity require the improvements describ-
ed and referred to in said resol~t1on, without compliance with
the Special Assessment Investigation, L1mitc;:i.t1on and Majority
Protest Act of 1931;
WHEREAS, notice of the adoption of said preliminary resolu-
tion and of said tlme and place of hearing was given by the City
Clerl\ by publ1cat1on and posting for the time and in the manner
provided in sa:1.d Resolution of Preliminary Determination and
Artlcle I of the Palo Alto Improvement Procedure Code, as appears
from affidavits on file with the City Clerk;
WHEREAS, no written objections to the undertaking
of said proceedings without f1rst complying with the provisions
of said Investigation Act have been filed with the City Clerk at
or before the time fixed for this hearing by persons interested,
own.1.ng or having an interest in real property w1 thin the proposed
assessment dietrict, bearing their signature, a description of
their property, and a statement of the nature of their interest therein; and
WHEREAS, all persons interested have been given an oppor-
tunlty to be and were fully heard, and said Council has duly
considered any and all objections and protests made, and the
said proposed improvements, and the public convenience and neces-sity for making same.
NOV, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows:
l. That the public convenience and neceasi ty require the
improvements described in said Resolution of Prel.minary Determ-ination.
2. That any and all objections and protests made pursuant
to said Reoolut1.on of Preliminary Determination be, and the
same are hereby, overruled and denied.
3. That the improvements described 1n sa1d Resolution be
made under and pursuant to the provisions of the Palo Alto Im-
provement Procedure Code more particularly referred to 1n said
Resolution, and that the Special Assessment Investigation,
Limitation and Majority Protest Act or 1931 shall not apply to
said proceedings.

I hereby certify that the above and foregoing resolution
was duly and regularly adopted by the City Council of the City
of Palo Alto, Californla, at a regular meeting thereof held on
the 10th <1ay or April, 1950, by the following vote of the members thereof:
AYES, and in favor thereof, Councilmen:
Blois, Bolander, Bowden, Bower, Cashel, Cathcart, .Freedman,
Gaspar, Linder, Mitchell, Montrot1.11, Morten, Wickett.
NOES, Cvuncilmen: None.
