OF PRELIMINARY DETERMINATION
PROJECT NO. 50-1
STREET LIGHTING RECONSTRUCTION
DISTRICT 01'."E
RESOLVED, by the Council of the City of Palo Alto, Cal11·orn1a,
that it does hereby preliminarily determine that the public conven-
ience and necessity require, and that it intends to o~der work to
be done and improvements to be made in and for said City, to-wit:
1. The improving or University Avem.\e from Cowper Street to
Chaucer Street by the installation of mast-arm supported lumina.iree
complete with overhead wiring, appurtenant equipment and fixtures
and/or electrol1ers complete with appurtenances, fixtures and underground conduit and cable.
2. The improving of Middlefield Road from San Franc1squ1to
Creek to Forest Avenue by the installation of suspended lun1ma1res
c0mplete with overhead wiring, guy strand, poles and appurtenant equipment and fixtures.
3. The improving of Palo Alto Avenue from Alma Street to
Chai.leer Street; Poe Street 11nd Bryant Court fro:n Bryant Street to
Waverley Street; Ruthven Avenue from Waverley Street to Webster
Street; Hawthorne Avenue from Alma Street to Middlefield Road;
Everett Avenue from Alma Street to Palo Alto Av~nue; Lytton Avenue
from Cowper Street to Seneca Street; Hamilton Avenue from Cowper
Street to Chaucer Street; Forest Avenue from Cowper Street to Hale
Street; Chaucer Street from Palo Alto Avenue to Hamilton Avenue;
Hale Street, Seneca Street, Guinda Street, Fulton Street and
Webster Street from Palo Alto Avenue to Forest Avenue; Byron Street
from Palo Alto Avenue to Lytton Avenue and from University Avenue
to Hamilton Avenue; Tasso Street from Palo Alto Avenue to Hawthorne
Avenue and from Lytton Avenue to University Avenue: Cowper Street
from Palo Alto Avenue to Lytton Averiue and from Hamilton Avenue to
Forest Avenue; Kipling Street, Ramona Street and High Street from
Hawthorne Avenue to Lytton Avenue; Waverley Street, Bryant St1•eet,
Emerson Street a.nd Alma Street from Palo :Uto Avenue to Lytton
Avenue by the installation therein of suspended a"'.d/or mast-arm
supported lum1r1aires complete with overhead wiring, guy strand,
poles and app1..irtenant equipment and fixtures.
4. All of said work and improvements are to be constructed at
the places and in the particular locations, of the forms, sizes, and
cl1mensions and materials, and to the 11nes, grades, and elevations
as shown and d.elinea:ced, upon the plans, pro.files and specii 1cat1ons
prepared therefor, and on file 1n the office of the City Engineer
in the City Hall of said City, reference to which is hereby made
for full and detailed description of said proposed work and for further particulars.
5. There is 'hereby excepted from the above w()rk that which is
already done to lir.e and grade, and mark·ed "excepted'' or shown not
to be done on the plans, profiles and specifications.
6. The City Council does hereby adopt and establ.$h as offi-
cial grades for said work the grades and elevations shown upon said
plans, profj.les and specifications. All such grades and elevations
are in feet and decimals thereof 1n reference to the official base and datum plane of said City.

7. All o!' said worl< shall be done under the supervision of
the City Engineer of' the City of Palo Al to, and all or said worl<
and materials shall be done and furnished to his satisfaction.
8. A statement of the total estimated cost of said improve-
ments, stating separately the estimated cost of each class or con-
struction proposed, and of the incidental expenses of said pro-
ceedings and improvement has been filed with the City Clerk and
approved by the City Council, to which reference :ts hereby made for
further particulars.

9. Said contemplated improvements, in the opinion of this
Council, are of more than local or ordinary public benefit, and thP.
cost.a and expenses o!' doing said work and expenses incidental there-
to, ehall be made chargeable upon the district benefited thereby,
the bmmdaries of which are ruore particularly shown on the map of
3a1d assessment district on file in the offj.ce of the 01ty Bnsineer
of satd City, to which reference 1a made for more detailed des-
cription thereof.
10. All public streets, alleys, and ways in use in the per-
formance of public functions shall be omitted from the assessments
herea!'ter to be made to cover the cost of said improvement.
11. Notice is hereby given that serial bonds to represent the
unpnid assessments to bear interest at the rate of not to exceed
four per cent ( lJ.%) per annum s ha 11 be 1 s sued pursuant to Part 4,
Bond Plan C of Article IV of the Palo Alto Improvement Procedure
Code, the last !ostallment of which shall mature nine (9) years
from the second day of July next succeeding ten months from their
date.
12. Except as herein otherwise provided for the issuance of
bonds, all of the above proposed work shall be done in pursuance of
~he provisiong of Article V in said Palo Alto Improvement Procedure
Code.
13. Said improvement proceedings are analogous and similar in
effect to those provided in California Statutes 1913 at page 421,
et seq., as amended, and said bond proceedings are analogous and
similar in effect to those provided in Division 10 of the California
Streets and Highways Code, and, except:.tng as herein otherwise pro-
~ v1ded, these proceedings shall respectively be d~emed to be taken
pursuant thereto .

1950, at the hour of 7:30 o'clock P.M., at the Council Chambers
of the City Council of said C1ty 1n the City Hall of sa1d City
are hereby fixed as the time and place when and where any and all
persons interested may appear and show cause, if any they have,
why the City Council should not f1nd and determine that the public
convenience and necessity require the improvement described and
referred to in this Resolution, without further compliance with the
Special Assessment Investigation, Limitation and Ma,jority Protest
Act of 1931, as provided in Article I of said ordinance .
15. The Clerk of the City of Palo Alto shall give notice of
the adoption of th1s resolution by publishing a notice of proposed
local improvement once !.n the Palo Alto Times, a daily newspaper
published and circulated in said City and by posting same on or
near the Council Chamber door of said Council, said posting and pub-
lication to be had at least ten days before said date of hear1:1g.

I hereby certify the foregoing to be a true copy of resolution
adopted by the City Council of the City of Palo Alto, California,
at r.i. regular meeting thereof held on the 13th d.ay or March, 1950,
by the following vote of the members thereof:
