BARTLEY TRACT ALLEY
ACQUISITIONS AND IMPROVEMENTS
PRO,J'ECT NO. 48-12
RESOLVED, by the Council or the City of Palo Alto, California,
WHERltAS, pursuant to Resolution or Intention No. 1712,
adopted by this Council on .7uly 12, 1948, and subeeq1.lently modified,
the acqu.1s1t1on or certain casements and the relocation of improve-
ments thereon bas been ordered;
WHEREAS, on further consideration this Council does find
and determine that the public interest and necessity will be best
served by further modifying the aforesaid proceedings by consoli··
dating improvements of the alleys with their avqu1o1tj.on.
NOW, THEREFORE, IT IS HEREBY PRELIMINARILY DUTBRMINED that
the public convenience and necess1 ty require and 1 t 1a the 1ntenM.on
of thi~ Council to order as follows:
1. That the following work be done and 1mp:~ovements be
made 1n and for said City, to-wit:
a. The 1mprov1ng or unn~roed alleys proposed to be
acquired 1n Blocks 5 and 7, between Fernando Avenue and
Center line of Block 7, Bartley Tract, all as more par-
ticularly described in maps ~nd d1agra.ms on file in
these proceedings, by grading, removal of ex1st1ng trees
and structures, constructing crushed rock base pavement
with asphalt1c concrete wearing surface between property
11nes, and constructing Portland cement approach aprons at
street intersections and across sidewalks.
b. The improvi.ng of an existing unnamed alley in Blocks
7, 11,and 12 of Bartley Tract as shown on Ba~tley Tract map
No. 3, recorded in the office of the Recorder of Santa
Cla:t·a County on .February 26, 1915, 1n Book O at page 66,
extending from the center line of Block 7 or said Bartley
Trac c to the southerly c:1 ''.y lim1 ts of the City of Palo
Al to, by grading .•. removal or existing trees and structures,
constructing crushed rock base pavement with asphaltic
concrete wea.:r1ng surface between property lines, and con-
structing Portland cement concrete approach aprons at
street intersections and across sidewalks.
2. All of said work and improvements are to be constructed
at the places and 1n the particular locat1ona, of the forms, sizes,
and dimend1ons and materials, and to the lines, grades, and elevations
as shown and delineated, upon the plans, profiles and spec1f1cat1ons
prepared therefor, and on file in the off'1ce of the City Engineer
ir1 the City Hall of said City, rererew:e to which is hereby made
for full and detailed description of said worl< and for further particulars.
3. There 10 hereby excepted from the above work 'that which
1s already done to line and. grade, and marked •iexcepted" or shown not
to be done on the plans, profiles and specifications.

lf.. The City Council does hereby adopt and establish as offi-
cial grades for said work the grades and elevations shown upon said
plans, profiles and specifications. All such grades and elevations
are 1n feet and decimals thereof 1n reference to the official base
and datum plane of said City.
5. All of said work shall be done under the su,perv1eion of
the City Engineer of the City of Palo Alto, and all of said work
and materials shall be done and furnished to his ::iat1sfact1on.
G. A map or plat of the lands and improvements necessary and
convenient to be ta:.<en t'or such pr\''>posed. improvements has been
filed wl th the C.1.. ty Cle:i."'k and the acqu:l.s1 t1ons ordered by the City
Council, to which reference 1B hereby made for further particulars.
7. A statenent or the total estimated cost of said improve-
ments, stating separately the estimated cost of each class of con-
struction proposedt and of each parcel of land or improvement pro-
posed to be acquired and of the, incidental expenses of said pro-
ceedings and improvement has beer1 filed with the City Clerk and
approved by the City Council, to which reference is hereby made for
further particulars.
8. Said contemplated lmprovements, in the opinion of this
Council, are of more than local or ordinary public benefit, and
the costo and expenses of doing said work and expenses incidental
thereto, shall be made chargeable upon the district benefited there-
by, the boundaries of which are more particularly shown on the map of
said assessment district on ~ile in the office or the City Engineer or said City, to which reference is made for more detailed descrip-
tion thereof.
9. All public streets, alleys, and ways in use in the perfor-
mance of pu.bllc 1\mctlons shall be omitted from the assessments
hereafter to be made to cover the cost of said improvement.
10. Notice is hereby given that serial bonds to represent the
unpaid assessments to beRr interest at the rate of not to exceed
four per cent (4~t) per annum shall be issued pursuant to Part 4.
Bond Plan C of Article IV of the Palo Alto Imnrovement Procedure
Code, the last 1;'lstallment of which shall mature nine years (9)
from the second day of July next succeeding ten months from their
date.
11. Except as herein otherwise provided for the issurance of
bonds, all of the above proposed work shall be done in pursuance of
the provisions of Article V in sa1d Palo Alto Improvement Procedure
Code.
12. Said improvement proceedi.ngn are analogous, and &milar in
effect to those provided in California Statutes 1913 at page 421,
et seq., as amended, and said bond proceeding~ are analogous and
similar in effect to those providea in Di~ision 10 of the California
Streets and Highways Code, and, excepting as herein otherwise pro-
vided, these proceedings shall respectively be deemed to be taken
pursuant thereto.
13. Notice is hereb~r g1 ven that Monday, the 10th day of
April, 1950, at the hour of 7:30 o!clock'P~M., at 1;he
Council Chambers of. tLe City Council of said City 1n the City Hall
of saiO. City are hereby fixed as the time and place when and where
any and all persons interested may appear and show cause, if any
they have, why the City Council should not find and determine that
the public convenience and n.ecessity require the improvements des-
cribed and referred to in this Resolution, without further compliance

with the Special Asaessm~nt Investigation, L1m1tat1on and Majority
Protest Act or 1931, as provid.~d in Article I of said ordinance.
14. The Clerk or the City or Palo Alto Sl.all give notice of
the n.doption of this resolution by publishing a notice of proposed
local improvement once in the Palo Alto Times, a daily newspaper
published and circulated in said City and by posting same en or
near the Council Chamber door or said Co1.mc11, said posting and pub-
lication to be had at least ten days before said date of hearing.
