HomeMy WebLinkAboutRESO 1958• ............... -......... .. :144 H E S O L U T l...0 N 1LQ • ~ ORDERING ACQUISITIONS AND IMPROVEMENTS AND CONFIRMING ASSESSMENT CALIFORNIA AVENUE DISTRICT ACQUISITIONS AND IMPROVEMENTS PROJECT NO. 48-9' RESOLVED, by the City Council of' the City of Palo Alto, ca:1rorn1a, that WHEREAS, the City Council did on the 26th day or July, 1948, adopt its Resolution of Intention No. 1721 to order certain acquisitions and improvements to be made in said City, under and pu.rsuant to Article III or Ordinance No. 844 or aa1d City, adopted J.':muary 13, 1941, entltled "Palo Alto Improvement Procedure Code", and to issue bonds pursuant to Part 4, Bond Plan C of Article IV of said Ordinance No. 844, and did on November 14, 1949, adopt Resolution No .. 1914 of Intention to Modify Proce~dings, and did on December 12, 1949, adopt Resolution No. 1924 Ordering Change and Modification or Proceedings, and did on J.anuary 9, 1950, adopt Resolution No. 1933 of Intention to Modify Proceedings, reference to which resolutions is hereby made for a particular description of the acquisitions and improvements to be made, the boundaries of the ~ssessment d1str1ct, and the bonds to be issued; WHEREAS, said Resolution of Intention No. 1721 has been duly published twice and Resolutions of Intention Noe. 1914 and 1933 have been published once in the Palo Alto Times, ~ newspaper or general circulation printed and published in said C:l.ty, wherein all persona interested, having any ob:ections to the proposed , acquisitions and improvements or against the district to be assess- ed for the costa and expenses thereof, or to ·the ~ng1neer's esti- mate of the costs and expenses thereof, or against the grades at which said work shall be done, or againet the diagram or asseasment 1 were notif1ed of the times and places of the l'ieal:'ings as contained in said resolutions of intention, said resolutions of lntentlon were duly published wlthin the time n.nd in the manner provided in said Improvement Procedure Code, and as directed by said resolu- tions or intention, as appears from the affidavits or. publico.t1on on file in the office of the City Clerk of sard City; WHEP.EAS, at the times and places fixed ror said hearingn protests or abJ~on were made or presented to the proposed acquisi t:l.ons and improvements, or to the dintr:tct to be a3sessed, or to the grades at which said work was to be done 1 or to the bonds to be issued to pay the costs and expenses there- of, or to the Engineer's estimate or the costs and expenses thereof, or nea1not the diagram or assessment, and all persons interested desiring to be heard were given an. opportunity to be heard, and ull ma tte:rs and th:i.ngs pertain!ng to said proposed e.cquisi tions and improvements were duly heard and considered by said Co~ncil, and were overruled, and said City Council has acquired Jurisdiction to order snid acquisition and improvements and the confirmation of said assessment to pay the costs and expenses thereof; NOW, THEREFORE, said City Co1;:ncll does hereby FIND., DETERMINE and ORDER, as follows: 1. That the plans and Dpecificat1ons for street improve-nents under said Resolution of Intentj.on, as modified, be, and they ure hereby, finally adopted and approved as the plans and specifications to which said work and improvement Bhall be done as called for in said Resolution of Intention. That the Engineer's estimate of the itemized and total estimated cost and expenses for sa1d acquisitions and improve- ments, as modified, be, and it is hereby, finally adopted and approved as the Engineer's total and detailed estimate ot' the costs and expenses or said acqu.1s1tions and 1mprovepients. 3. All public Gtreets, alleys and ways in use in the performance of the public function shall be omitted from the assess- ment hereinafter to be made to cover the cost of said acquisitions and improvements. 4. That the maps and descriptions of the lands and easements to be acquired, as modified, be, and they are hereby, finally adopted and approved. 5. That the public interest and convenience require, and said City Co1mc11 does hereby ore.er the acquiai tions and im- provements to be made as described in and in accordance with said Resolution of Intention, as modified, on file in the office of the City Clerk of said City, reference to which is hereby made for a more particular description of said acquisitions and improve- ments and also for furtther particulars, purs11ant to the provisions of Article V of said Improvement Procedure Code. 6. That the map of the assessment district, as modified, be, and the same is hereby, finally adopted and approved as the map of the assessment district, and the boundary of said assess- ment district as shown thereon is hereby determined and establish- ed to be the boundary of the assessment district to pay for the costs an.d expenses or said acquisitions and improvements. 7. That the assessment and diagram for the cost and ex- penses of the acquisitions and improveme11ts described in said Resolution of Intention, as modified, bei and the same is he~eby 1 ratified, approved and confirmed as the assessment and diagram to pa~' t.he costs and expenses of said acqu1s1 tions and improvements. 8. That the City Cle1"k of said City shall deliver said diagram and assessment to the Sup~rintend1mt of Streets of said City, together with a certified copy of this resolution thereto attached, and said Superntendent of Streets shall thereupon re- cord such assessment and diagram 1n his office in a suitable book to be kept for that purpose and append the::-eto his certificate cf 'i;he date 01' such recording, and such reclord shall be the a~sessment roll to pay for the costs and axpenses of said ~cquisi­ t:tons and improvements. 9. Immediately upon such recordation aaid Superintendent of Streets shall give notice thereof by two publications in the Palo Alto Times, a newspaper printed and published in said City, which notice shall set forth, among other things, that all sums assessed therein are due and payable at his office immediately, and that payment thereof j.s to be made to him w1 thin tM.rty days after the date of recording said assessment, which date shall be stated in said notice, and such other matte~s as are required by Section 7 of Article V of said Improvement Procedure Code. * ... * * * I hereby certify the f orego1ng to be a true copy or resolution adopted by the City Council of the City of Palo Alto, California, at a regular meeting thereof h'i!'ld on the 13th day of March, 1950, by the following vote of the members thereof J j t :i46 APPROv"ED : AYES, and in favor thereof, Councilmen: Bentrott, Blo1a, Bolander, Bowden, BowerJ.
