DETERMINING TPAT PUBLIC INTEREST AND NECESSITY REQUIRE TP.E AC~UISITION OF EASEMENTS FOR STREETS AND DIRECTING THE FILING OP EMINENT DOMAIN PROCEEDINGS PROJECT NO. 49-·ll HAMILTON AVENtlE, ET AL RESOLVED, by the City Council Of the City of Palo Alto, California, that WHEREAS, pursuant to Resolution or Intention No. 1926 adopted by this Council on D~cember 12, 1949, this Council did on Janua~y 9, l950, adopt its Resolution No. 1930 ordering acquisition or easements; WHEREAS, said ·Resoll..1t1on of Intention and said Pl"Oceedings were had and taken pursuant to Article III of Ordinance No. 8'~4 of said City commonly designated the Palo Alto Improvement Pro- cedure Code, adopted January 13, 1941; NOW, THEREFORE 1 IT IS FOUNJ), DETERMINED AND ORDERED, as follows: 1. That the public interest and necessity require the acqu1- sit1on, construction and completion, by said City, of the public improvements described in said Resolution or Intention and in the proceedings relating thereto, and that the easements and property proposed to be acquired described therein are necessary therefor; 2. That the public necessity requires said acquisition and improvements, that sa:1.d proposed acquisition and improvements are planned and located in the manner which will be most compatible w1 th the greatest public good and the least private :1.njury, and that all of said acquisitions are located within the t,err1torial li~its or the City of Palo Alto; 3. Th..,,t the City Attorney and the law !'1rm of Messrs. Kirkbr:'.de, Wilson, Harzreld & Wallace, ernployed for that purpose, be, and they are hereby directed to institute and conduct to conclusion an action in eminent domain for the ac~uisition of said easements, and to take such action as 1s necessary ther~:1.n; 4.
