ORDERING ACQUISITIONS

RESOLVED, by the City Council of the City of Palo Alto,
California, that
WHEREAS, said City Counc11 did on the 12th day or December,
1949~ adopt 1te Resolution Mo. 1926 of Intention to Make Acquisi-
tions, to be made in said City, under and pursuant to .Article III
or 01·dinar1oe No. 844 or said City, adopted January 13, 194 l, en-
titled "Palo Alto Improvement Procedure Code", and to 1aeue bonds
pursuant to Part 4, Bond Plan C of Article IV of said Ordinance,
reference to which Resolution of Intention is hereby made ror a
particular description of the acquisitions to be made;
WHEREAS, said Resolution or Intention has been duly published
twice 1n the Palo Alto Times, a newspaper or general circulation
printed and published in said City, and notices of the passage of
sa1d Resolution of Intention headed "Notice or Public Improvement"
and or the time and place of the hearing ae fixed by sa1d Resolu-
tion or Intention, when and where all persons intere~ted, having
any ob ject1ons to the proposed a.cquis1 t1on, or to the eng1neet-.• s
estimate or the costs and expenses thereof, may appear before
said Co•.mc11 and show cause why said proposed acquis1 t1ons should
not be carried out in accordance with said Resolution or Inten-·
tion, were duly posted within the time and in the manner provided
in said Improvement Procedure Code, and as directed by Baid Reso-
lution of Intention, as appears from the aff1dav1ta of posting
and publication on file in the office or the City Clerk of said
City;
WHEREAS, at the time and place fixed for said hearing, no
protests or objections were made or presented to the proposed
acquisitions, or to the engineer's estimate of the costs and ex-
penses thereof, and all peracns interested desiring to be heard
were given an opportunity to be heard, and all matters and things
pertaining to said proposed acquisitions were duly heard and con-
sidered ·oy said Council, ,
and said City Council has acquired jurisdiction to order said
acquisition.
NOW, THEREFORE, said City Council does hereby FIND, DETERMINE,
AND ORDER, as follows:
1. That the plans and specifications for acquisition or
easements under said Reaolutton of Int~nt1on, be, and they are
hereby, finally adopted and approved as the plans and specifica-
tions to wh1ch eaid acquisition ehall be done aa called for in
'· said Resolution of Intention.
2. That the engineer's estimate of the itemized and total
estimated cost and expenses for said acqu1s1t1on of easements be,

and 1t is hereby, finally Rdopted and approved aa the engineer's j
total and detailed estimate of the costs and expenses of said ·
acquisition.
3. That the public interest, necessity and convenience re-
quire, and said City Council does hereby ord.er the acqu1s:t tion of
easements to be made ae described in and in accordance with said
Resolution of. Intention, on file in the office of the City Clerk

of said City, reference to which is hereby made for !urther par-
ticulars, pursuant to the provisions of frt1cle III of said Im-
provement Procedure Cede.
4. All public streetu, areas and ways and other property 1n
use in the perf'ormance of a public function shall be om1 tted from
the asf3essment hereafter to be made to cover the cost o.f' said
acquisitions.

California, at a. regulo.l'.' meeting thereof held on the 9th day of
