ORDERING AC4UISITIONS
HIGH STREET EXTENSION, ET AL.
PROJECT NO. 48-14
RESOLVED, by the City Council of the City of Palo Alto,
California, the'
WHEREAS, said City Council did on the 9th day of August,
1948, adopt its Resolution of Intention No. 1738 to order certain
acquisitions and abandonments of easements for street purposes, to
be made In said City, under and pursuant to Article III of
Ordinance No. 844 of said City, adopted January 13, 1941, entitled
'Palo Alto Improvement Procedure Code", reference to which Resol-
ution of Intention is hereby made for a particular description of
the acquisitions and abandonments to be made;
WHEREAS, said Resolution of Intention has been duly pub-
lished twice in the Palo Alto Times, a newspaper of general circu-
lation printed and published in said City, and notices of the
passage of said Resolution of Intention headed "Notice of ]?ublic
Improvement" and of the time and place of the hearing as fixed by
said Resolution of Intention, when and where all persons interested,
having any objections to the proposed acquisition and abandonment,
or to the engineer's estimate of the costs and expenses thereof,
may appear before said Council and shoe cause why said proposed
acquisition and abandonment should not be carried out in accord-
ance with said Resolution of Intention, were duly posted within
the time and in the manner provided in said Improvement Procedure
Code, and as directed by said Resolution of Intention, as appears
from the affidavits of posting and publication on file in the
office of the City Clerk of said City;
WHEREAS, at the time and place fixed for said hearing,
no protests or objections were made or presented to the
proposed acquisitions and abandonments, or to the engineer's
estimate of the costs and expenses thereof, and all persons
interested desiring to be heard were given an opportunity to be
heard, and all matters and things pertaining to said proposed
acquisition and abandonment were duly heard and considered by
said eouncil.
WHEREAS, after proceedings to that end duly had and
taken, and on the 8th day of November, 1948, said Council
adopted its Resolution Nc. 1781 ordering modifications of pro-
ceedings;
WHEREAS, all changes and modifications therein directed
to be made have been made; and
WHEREAS, said City Council has acquired jurisdiction to
order said acquisition and abandonment, as modified.
NOW, THEREFORE, said City Council does hereby FIND,
"DETERMINE AND ORDER, as follows:
1. That the plans and specifications, as codified, for
acquisition and abandonment of easements under said Resolution of
Intention, be, ami they are hereby, finally adopted and approved
as the plans and specifications to which said acquisition and
abandonment shall to done'as called for in said Resolution of
Intention.

2. That the engineer's estimate of the itemized and
total estimated cost and expenses for said acquisition and
abandonment of easements, as modified, be, and it is hereby fir i11y
adopted and approved as the engineer's total and detailed estimate
of the costs and expenses of said ecquisitlon and abandonment.
3. That the public interest, necessity and convenience
re.iuire, and said City Council does hereby order the acquisition)
of easements to be made as described in and in accordance with
said Resolution of Intention, as modified, on file in the office
of the City Clerk of said City, reference to which is herebr made
for a more particular description of said acquisitions and disc for
further particulars, pursuant to the provisions of Article III of
said Improvement Procedure Code.
4. All public streets, areas and vzays and other proper-
ty in use in the performance of a public function shall be omitted
from the assessment hereafter to be made to cover the cost or sa1r,
