OF INTENTION TO MODIFY PROCEEDINGS AND
OF PUBLIC CONVENIENCE AND NECESSITY TO
MANE „C UISITI0N
BARTLEY TRACT ALLEY AC.iUISITION
PROJECT NO. 40-12
RESOLVED, by the Council of the City of Palo Alto,
California, thet it is the intention of said Council to modify the
proceedings under its Resolution of Intention No. 1712 adopted
July 12, 1'548, as fo).lows:
1. That the public convenience and necessity require
and it is the intention of this Council to change rind modify the
proceedings by eliminating therefrom the easements proposed to be
acquired over the following parcels of land situate in the City
of Palo Alto, County of Santa Clara, California,to-wit:
NE 5 ft. of the SV 20 ft. of Lots 25 and 35,
Block 5, Map of the Bartley Tract Subdivision
No. 2,,and amended subdivision of Lots in Blocks
3 and 5 of Bartley Tract Subdivision No. 1,
recorded in the office of the Recorder of Santa
Clara County on Au -gust 8, 1911 in Book N at
poge .5
2. That the public convenience and necessity require
and it is the intention of this Council to change and modify tae
proceedings by including therein the acquisition of easements for
alley purposes, together with the acquisition or relocation of
the improvements thereon, on the following parcels of land situate
in the City of Palo Alto, County cf Santa Clara, California, to -
wit:
NE 5 ft. of Lots 26, 27, 23, 29, 30, 31, 32,
33 and 34, Block 5, map of the Bartley Tract
Subdivision No. 2, and amended subdivision of
Lots in Blocks 3 and 5 of Bartley Tract Sub-
division No. 1, recorded in the office of the
Recorder of Santa Clara County on August 8,
1911 in Book N page 55.
3. That the public convenience and necessity require
and that it is the intention of this Council to change and modify
the estimate of cost for said acquisitions to not to er.ceed
$3,000.00.
4. That the public convenience and necessity require
and that it is the intention of this Council to change and modify
the assessment by charging the estimated cost of the acquisitions
and the .incidental expense.
5. That said changes and modifications be made by the
City Engineer upon the ':'ace of the plans and estimate of costs on
file tith the Clerk, or by filing amended copies thereof or
amendments thereto.
6. That reference be, and it is hereby, made to the
amended plans and amended estimate of cost on file in the office
of the City Clerk of said City, to which reference is hereby
made for further particulars.

7. That the public convenience and necessity require
the acquisitions of easements in the proceedings under said Reso-
lution of Intention No. 1712 as proposed to be modified pursuant
hereto.
8. That Monday, the 10th day of January, 19;9, at the
hour of 7:30 otclock P.M., at the Council Chambers of the City
Council in the City Hall of said City are hereoy fixed as the
time and place when and where any and all persons interested may
appear and :show cause, if any they have, why the City Council
should not change and modify the proceedings as herein proposed.
9. That a copy of thia resolution be published once in
the Palo Alto Times and posted or, the bulletin board at the City
Hall, the publication n:14 posting to be at least ten (10) daye
before the date set for hearing.

I hereby certify the foregoing to be a true copy of
resolution adopted by the City Council of the City of Palo Alto,
California, at a regular meeting thereof held on the 13th day of
December, 149, by the following vote o: the members thereof:
AXES, and in favor thereof, Councilmen:
Bentrott, Blois, Bolander., Cashel, Hil., Linder, Merner,
Mitchell, Montrouil, Morten, Thoits, Wickett.
NOES, Councilmen: None.
ABSENT, Councilmen: Bowden, Freedman, Gaspar.
