76 RESOLUTION NO. 1793 OF INTENTION TO MODIFY PrOCEEDINO3 AND OF PUBLIC CONVENIENCE AND NECESSITY TO MARE AC.UISITIONS CALIFORNIA AVENUE DISTRICT AC,UI$ITION3 PROJECT NO. 48-9i3 RESOLVED, by the Council of the City of Palo Alto, California, that it is the intention of said Council to modify the proceedings under its Resolution of Intention No. 1721 adopted July 26, 1948, as follows: 1. Th&t the public convenience anc+ necessity require and it 13 the intention of this Council to change and modify the proceedings b; eliminating therefrom the easements proposed to be acquired over the following parcels of land situated in the City' of Palo Alto, County of Santa Clara, California, to -wit: ( ) NE 101 of the NW 1251 of SE 1401 of Lot 11, and the SW 101 of the NW 1251 of SE 140' cf Lot 12, Map of Paul Survey, recorded July 9, 1867 at Pale 641, Book C of Miscellaneous Records, Santa Clara County Records. (b) NW 125' of SE 1851 of SW 81 of NE 181 of Lct 46, Map of Paul Survey, recorded July 9, 186; at page 641, Book C of Idiscellaneoi.,s Records, Santa Clara County Records. (c) NW 101 of the NE 50' of Lot 3, and the NW 10+ of SW 501 of Lot 4; Iiap of Paul Survey, re- corded July 9, 1567 at page 641, Book C of Miscellaneous Records, Santa Clara County Records. 2. That the public convenience and necessity require and it is the intention of this Council to change and modify the proceedl;,fj by including; therein the acquisition of easements for alley and pedestrian lane purposes, together with the acquisition or relocation of the improvements thereon, on the following parcels of land sltuate in the City of Palo Alto, County of Santa Clara, California, to -wit: (a) ; triangular parcel of land 10' x 10' x 14.141 whose SEly and Sally dimensions are the shorter dimensions and lie respectively parallel to and 101 NW of the SE line of Lot 2 and 316' SW of the NE Line of Lot 2, Map of Paul Survey recorded July 9, 1367, at pale 641 in Book "C", Miscellaneous Records, Santa Clnra,Couaty Records. That the public convenience and necessity require and that it is the intention of this Ccuncil to change and modify the estimate of cost for said acquisitions to not to exceed $143,256.75. 4. That the public convenience and necessity require aril that it is the intention of this Council to change and modify the assessment by changing the estimated cost of the acquisitions and the incidentol expense. (f) 5. That said changes and modifications be made by the City Engineer upon the face of the plans and estimate of costs on file with the Clerk, cr by filing amended copies thereof or amend- ments thereto. 6. That reference be, and it is hereby, made to the amended plans and amended estimate of cost on file in the office of the City Clerk of said City, to which reference is hereby made for further particulars. 78 7. That the public convenience and necessity require the acquisitions of easements in the proceedings under said Reso- lution of Intention No. 1721 as proposed to be modified pursuant hereto. 8. That Monday, the 10th day of January, 1949, at the hour of 7:30 F.M., at the Council Chamber of the City Council in the City Hall o_" said City are hereby fixed as the time and place when and where any and all persons interested may appear and show cause, if any they have, why the City Council should not change and modify the proceedings as herein proposed, 9. That a copy of this resolution be published once in the Palo Alto Times and posted on the bulletin board at the City Hall, the publication and posting to be at least ten (10) days before the date set for hearing. * * * * * * * I hereby certify that the foregoing resolution vas passed by the City Council of the City of Palo Alto, California, at a regular meeting thereof held on the 13th day of December, 1948, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Sentrott, Blois, Bolander, Cashel, Hill, Linder, Merner, Mitchell, Montrouil, Morten, Thoits, Wickett.
