ORDERING WORK AND CONFIRMING ASSESSMENT
LOMA VERDE ANNEX SEWERS
PROJECT NO. 47-5
RESOLVED, by the C:tty Counc:tl of the Gtty of Palo Alto,
Cal 1fo:rn1a, that
WHEREAS, Raid City Council on the 13th day of October, 1947,
adopted its Resolution of Intention No. 1620 to order certain ac-
qu:ts1 tlons and improvement a to be made in said City 1 under• and
pursuant to Article V of Ordinance No. 844 of sa.1.<l City, adopted
January 13, 1941, entitled "Palo Alto Improvement Procedl.4r~ Codt!'0 ~
as amended, and to 1saue bonds 9ursuan.t; to Bond Plan C of Article
IV of' sa1<l Ordinanct·, as amended,, referen<Je tc wh1ch Rt:solutlon of
Intention ls hereby made for a particular descr1ptlon or the im-
provements to be made, the boundaries of the assessment distt>1ct,
and the bonds to Oli~ lssued_;
WHEREAS, sald Resolution of Intentlon has been (.iu.ly pub-
lished twice in the Palo Alto Times, a newspaper of general clrcu-
latlon printed and published in said Ci t;y, and notices of tiJe
pas3age of sald Resolution of Intention h~aded "Notice of Publlc
Im1;rovement" and of the tlme and place of the hearing aa f lx~d by
said reoolut1on of 1ntentlon, when and where all persons interested,
having any objections to the proposed acquisition and improvements
or against the district tc1 01: assessed for the co~ts and expenses
thereof, or to the engineer's estimate of the costs ano expenses
thereof, or against the grades at which said work shall be dont:,
or against the diagram and assessment, may appear before sald
Council and show cause why sald proposed acqu1a1tlon and improv~
ment:;; should not be cax•r·led out 1n accordance with said Re::.olut1on
of Intention, were duly posted w:J.thin the time and :i..n the manner
provided in oalc.i Improvement Procedure Code, and as dirttcted by
oald Rt:solutlon of' Intent.ion, as appears from the ar l'iuavl ts of
postlng and publication on file in the office or the :;1 ty Clei~k

WHEREAS, at the time and place fixed for said hearin~,

matte:rs and things pt:rtaln1ng to sald proposed acquisition and
improvements were duly heard anu considered by said Council and
said protests overruled, and said C1ty Council has acquired J<J.ri~ -
diction to order sald acquisition and improvements and the con-
f lrmatJon of said assessment to pay the costs and expenses thereof;
NOW, THER.EFOHE, said City Counc11 di.)e3 hei-eby FIND
DETERMINE AND OHDE.R .. ac follows:
1. 7i1at the modified plans, profiles and specifications for
improvements under said Resolution of Intention, be, and they are
hereby, finally adopted and approved as the plans and specifications
to which said work and improvement shall be done a~ called for in
said Resolution of Intention.
2. That the engineer's modified estimate of the .itemized
and total estimated cost and expenses for acquisition and improve-
ments Wi.der said Resolution of Intention, be, and 1t is finally
adopted and approv~d, as the engineer's total and detailed estimate

J. That the public interest and conv~n1ence require and
said G1ty Council does hereby order the acqu1sit1on and improv~ments
to be made as described in and in accordance with said Resolution
of Intention, a3 modified on file in the office of the Clty Clerk
of said Clty, reference to which ls hereby made for a more .i;.articu-
lar descr1pt1c.in of said acquisition and lmprovements and also for
fu:rtl·Jer particulars, pursuant to the ;:rov1a1ons of Article V of
sa.ta Improvi.:ment Procedure Co<ie, as amended.
4. Tr.at the modifled asseaament and d.tagrrun .for the cos-c
SQd.expen~ez for said acqu1a1t1on and iraprovements under said
Resolut.ton of Intention, be, and the sam~ is hereby, rat1f1ed,
ai.;proved and confirmed as the as~essn1ent and diagram to pay the
costs and expenses of said acquisj.t1on and improvement.
5. That the Clty Clerk or said Clty shall deliver said
modi.f.led diagram and assessment to the Superintendent of Streets or said City, together with a cert1f1ed copy of this resolution
t.hereto a~tached,, and sa1d Superintendent of Streets shall
tl".el"Ci.~pon record such assessment and diagram in his office in a
suitable book to be kept for that purpose and append thereto his
cert.if 1catc of the date of such recording, and such record shall
be the aeeeament roll to pay .for the costs and expenses of sa.ld prcject.
6. Immediately upon such reccretation sa1d .Superintendent
of Streets shall 61 ·ie notice thereof by two publicatlona in the
Fz...lv Alto Times, a new."lpaper i;rinved and published in said City,
