Hall, 250 Hamilton Avenue, at 7:35 p.m. the regular meeting of April 6, 1981. PRESENT: Bechtel, Fazzino, Fletcher, Henderson, Klein, Renzel, Witherspoon (arrived at 7:37 p.m.) ABSENT: Eyerly, Levy Mayor Henderson announced the need for an executive session regarding litigation which would be held at the end of the. formal meeting. ORAL COMMUNICATIONS 1. Harriot Seifferele, 651 Melville Avenue, referrer' to a let- ter written March 31, 1981, by the President of the Womens Club of Palo Alto to Mayor Henderson and the City Council. .Speaking on behalf of the Womems' Club she requested a stop sign be placed on Homer Avenue and Cowper Street because of the excessive speed driven on the street. Mr. Noguchi is to contact Womens' Club. 2. R. J. Debs, 3145 Flowers Lane, referred to proposal con- tained on March 23, 1981 packet by Mr. Zaner, regarding training City staff in.skills to take to City groups and involvement of Stanford and the Forum, expressed concern and advised against adoption. MINUTES OF JANUARY 19 1981 Mayor Henderson pointed out that on page 598, last paragraph, third line .from the bottom where it refers to the "Water Board Meeting the following Wednesday evening," delete the word "evening." Councilmember Renzel stated she felt actual corrections should appear in subsequent minutes. MOTION: Councilmember Fle eher moved, seconded by Bechtel, that the minutes of January 19 be approved as corrected. MOTION PASSED: The motion passed on a 7-0 vote, Eyerly and Levy absent. MINUTES OF JANUARY 26. 1981 Councilmember Renzel indicated a correction on page 601,, second line, should be he teemed colleague" as opposed to "dear colleague." MOTION: Vice Mayor Fletcher moved, seconded by Witherspoon, that minutes of January 26 be approved as corrected. MOTION PASSED: The motion passedon a 7-0 vote, Eyerly and Levy absent. PALO ALTO EXPRESSING APP1ECIATION TO THE VOLUNTEERS OF PALO ALTO FOR OUTSTANDING PUBLIC SERVICE IN THE FRUIT REMOVAL PROJECT." MOTION PASSED: The motion passed by a vote of 7-0, Eyerly and Levy absent. Mayor Henderson presented the plaque ' to Patricia Riposo, Volunteer Coordinator who gratefully accepted the plaque on behalf of the volunteers. CONSENT CALENDAR Mayor Henderson asked that Item No. 5, regarding Clothesline Prohibitions be removed from the Consent Calendar. Referral Items None Action Items RESOLUTION RE PROJECT MOBILITY AND TRANSPORTATION Staff recommends that Council adopt a resolution requesting allocation of $95,000 in Transportation Development Act Article 4.5 funds in fiscal year 1981-82. MOTION: Councilmember Fazzino moved, seconded by Witherspoon to approve the resolution. MOTION PASSED: The motion passed by a vote of 7-0, Eyerly and Levy absent. RESOLUTION 5896 entitled "RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO •AUTHORIZING THE FILING OF A CLAIM WITH THE METROPOLITAN TRANSPORTATION COMMISSION FOR ALLOCATION OF TRANSPORTATION DEVELOPMENT ACT FUNDS FOR FISCAL YEAR 1981-82." STORES WAREHOUSE FURNACE REPLACEMENT (CMR:203:1) Staff recommends replacing the Stores furnace with a current model, incorporating the latest energy conservation features, at a cost of $18,000. Eyerly and Levy absent. ORDINANCE 3275 entitled -."ORDINANCE. OF THE COUNCIL OF 1H . TC'ITY Or —PALO LTO AMENDING ` THE BUDGET FOR THE FISCAL YEAR 1980.8i TO ESTABLISH CAPITAL IMPROVEMENT PROIiECT NO. 80-95 TO PROVIDE FUNDS FOR REPLACEMENT OF 'THE STORES WAREHOUSE FURNACE." RESOLUTION RE APPLICATION FOR THE STATE FOR FUNDS FOR Staff•° recommends that the Council adopt4A resolution authorizing the City Manager qr. his designee to sign - and submit the appropriate application form to the State of California ,for its Community Development Deferred Payment Rehabilitation Loan Funds for rental units. 7 6 6 4/6/$1 If • ., MOTION: Councilmember Fazzino moved, seconded by Witherspoon, to approve the staff recommendation. MOTION PASSED: The motion passed by a vote of 7-0, Eyerly and Levy absent. RESOLUTION 5897 entitled "RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING AN APPLICATION TO THE STATE OF CALIFORNIA FOR HOUSING AND COMMUNITY DEVELOPMENT DEFERRED PAYMENT REHABILITATION LOAN FUNDS FOR RENTAL PROPERTIES." AMENDMENT 10 CONTRACT FOR REPAIR OF POWER TRANSFORMER AND BUDGET AMENDMENT FOR FUMING Mr. Zaner advised that the transformer had to be repaired. MOTION: Councilmemb.er Bechtel, seconded by Klein, to approve the, amendment to contract and the ordinance amending the budget. MOTION PASSED: Motion passed by a vote of 7-0, Eyerly and Levy absent. AMENDMENT NO. ONE TO CONTRACT NO. 4106 - REPAIR TO POWER TRANSFORMER - Federal Pacific Electric Company ORDINANCE 3276 entitled "ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING THE BUDGET FOR THE FISCAL YEAR 1980-81 TO PROVIDE ADDITIONAL FUNDING FOR THE REPAIR OF A POWER TRANSFORMER." ORDINANCE FORBIDDING CLOTHESLINE PROHIBITIONS tseccind reading) Mayor Henderson advised that his particular condominium is up for sale and that he was no longer directly affected and was riow speaking on behalf of many other citizens in Palo Alto who are directly affected. He corrected a statement made by Vice Mayor Fletcher that there were -monthly savings of 744 kilowatt hours and he commented that his average .use per month, total on electricity, was around 300 kilowatt hours, and he did not think the lack of using the dryer would save 744 kilowatt hours. He pointed out that drying was a small portion of kilowatt hours they use. He felt a chief responsibility of elected officials was to put themselves in the shoes of the people who come before them. He felt that with one exception people would react nega- ti,vely to a 13w which would bring clotheslines and clothes into the views of people outside their liringrooms. He said he could accept a law to prohibit bags on clotheslines in single family and duplex homes, and felt there should not be any resrictions in that event, but hesitated *,o require outside lines in multi- un.i`- projects because there was already a lack i,n open space. He indicated he was willing to propose clothesline areas for new structures if the Council would protect existing developments which would have outdoor' space available. SUBSTITUTE MOTION: Mayor Henderson moved, seconded by Klein, to direct staff to prepare an ordinance which would prohibit restrictions against clotheslines in R-1 and R-2 zones and to require outdoor clothesline facilities in all nevi multi -family, apartment and condominium construction. Vice Mayor Fletcher clarified that the 744 kilowatt hours"was taken from the PG&E., average us.e. She pointed out that Mayor Henderson`s family 'was a very, small famfly -'and said that in a subsidized rental development in the City, she was horrified to learn that mothers with 'babies were -not permitted to hang out a diaper. She felt it was wrong to prohibit people from using the 7 6 7 4/6/81 most logical way to dry clothes. She reminded the Council that the. proposed ordinance permitted the individual _development to regulate where the clotheslines should go so there is no need for anyone to have clotheslines facing front livingroom windows. The condominiums, rental and older multi -family developments have a right to declare that certain areas are off limits. She visited developments in which both Mayor Henderson and Council - member Eyerly advised there were no appropriate places for clotheslines and did find areas that were out of the way. Mayor Henderson. said he was concerned that people would not want them in places where they could not be seen for fear of them being stolen. Vice Mayor F-yetcher felt it should not be assumed that clothes would be stolen, and that it was not a requirement that people use clotheslines, Councilmember Renzel opposed the substitute motion and supported second reading of the original ordinance, because she felt that people were unduly imposing their own value systems on others whhcn they prohibit them from air drying their clothes, she felt that I,eoviding a reasonable access to air drying clothes was a very inexpensive modification to existing facilities and felt if the city is to succeed with its energy reduction programs in the long run they are going to have to look at a lot of things like -this. She felt the ordinance was a small start with a minor impact. Councilmember Fazzino felt there was such adieu about nothing. He felt the idea behind the proposal was good and recognized the civic concerns of Mayor Henderson, but believed they should move forward, and if there were real aesthetic problems in the future, he would be willing to look at the issue again and con- sider altering the scope of the ordinance, but.. at this point it was an exciting concept and applauded the staff for proposing • SUBSTITUTE MOTION FAILED: The substitute motion failed by the following 4-3 vote: AYES: Klein-, Henderson, Witherspoon Noes: Renzel, Fletcher, Fe:zino, Bechtel ABSENT: Eyerly and Levy MOTION: Codncilmember.Fletcher .moved, seconded by Renzel, pass the ordinance for second reading: MOTION PASSED: The motion passed on a 6-1 vote with Henderson voting "no" and Eyerly and Levy absent. ORDINANCE 3277 entitled "ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO ADDING SECTION 18.88.180 TO THE PALO ALTO. MUNICIPAL CODE FOR►iIDDING CLOTHESLINE PROHIBITIONS.' (1st reading 3/16/81, passed 5-3 Eyerly, Klein and Henderson "no," Witherspoon abstain.), ADJOIRNiENT MOTION: Councilmember Klein moved, seconded by Mr. Fazzino, that the Council adjourn the meeting in honorof Frank Rack, a former Planning Commissioner for eight years who had died over the weekend. Mayor Kenderson expressed his appreciation for the service pro- vided to the City by.Mr. Rack. 7 6 8 4/6/81 Councilmember Renzel said she served much of Mr. Rack's eight years with him and also expressed her sorrow at his passing. She commented that he always served with goodwill ar1 was a very amicable colleague on the Commission. MOTION PASSED: The motion passed 7-0, Eyerly and levy absent. The Council meeting adjourned at 8:06 p.m. ATTEST:
