RESOLUTION ORDERING WORK
No. 1225
~~EREAS, the City Council or the City of Palo Alt~ did on
the 12th day of September, 19~8, pass 1te resolution of inten-
tion to order ~erta1n work theraln described to be done and
improvements to be made !n eaid city, which resoluUon of in-
tention was duly and legally publish~d ae required by law, as
appears from the affidavit now on file in the office of tr~
City Clerk of sa1d city; and
WHEREAS, notices of the paeeage o! said resolution of
intention headed "Notice of Public Improvement~, were duly and
legally posted along the lines of !aid contemplated work and
improvement, in form and manner as required by law, after the
paet~age of .said resolution or intention, &l!l appeu·ts from the
aff1d'lv1t of Thelo A. Perrott who personally posted the
aa.me under the direction of J. F. By:xbee, the Superintendent ot
Street! of said City of Palo Alto, and who, after the co~ple
tion of thf'J posting ·:>f said notices, Piled hia said affidavit
1n the off:l.ce of the city clerk of said city, ma.k1ng oath that
he completed the posting of eaid notices on the 16th day of September, 1938; and
WHEREAS, notices of the ado·ption of said resolution of ~·intention were duly and legally mailed to all persons owning
real property ')ropos~d t~ be assessed for said work, whose
names and addresses appear on the lG.st equalized assessment
roll for city taxes prior thereto or as known to the clerk ot
said c1.ty, in the timet~ manner and form prescribed by law; and
WHEREAS, all protests or objections to ~aid work or
improvements or to the grades Bt which the same 1e to be cone,
or to the dbtrS.ct to be &.Bses.sed for the col!lta and expenses
thereof have b0en filed and overruled and said e1ty council
has now acquired jurisdiction to o.r-d.er the proposed work and j.mprovement, - -
IT IS HEREBY RESOLVED by the City Council that the public
interest and convenience required the work described in said
resolution of intention, and said city council does hereby
order that the work and improvemente described in said resolu-
tion of intention be made 1n said city, reference being hereby
made to said resolution of :tn tent ion on file in the o!'fice or
the City Clerk of said City, for a full and complete de.sc...-1p-t1on of said work.
That the city clerk 1s hereby directed to po~t a notice
of s&id work conspicuously for !ive {5} days on or near the
council chamber door of said city council, inviting sealed
proposals or bids for do!.ng the work ordered, upon a da;; end
date to be hereafter fixed by this council. She is also direct~d to publiah twice in the Palo Alto Times, a daily news-
paper published and circulated in said City or Palo Alto, and
hereby designated by said City Council for that purpose, a
notice inviting such eealed proposals and referring to the
apeo!ficat!ona on file in the office of 8&id cler·k.
All proposals or bids offered shall be accompanied by a
check payable to the City of Palo Alto ce~tit1ed by a respon-
sible bank, for an amount Which shall not be less thAn ten (10)
per cent of the aggregate of the proposal, or by a bond for the

said amount and so payable, eigned by the b1dd$r and two sureties,
who .ei.'l&ll justify before any offj.cer competent to administer an
oath,. in double the said amount and over and above all statutory exempt1ona.
And it is ~refore further r0solved and ordered by the
City Co\mcil that this hearing be furt~r continued to 7s30
o'clock P.M. of Monday the lOth d-ay of October, 1938, for the
purpo!e of determining and fixing the day and date for the reception
of auch eealed proposala.

I hereby certify that the above and foregoing resolution
was duly and regularly adopted t•y the Ci tr Co1mc 11 of the City
of Palo Alto at an adjourned regular meeting thereof held on the
28th day of September, 1938, by the following votes
AYES: Blois, Bonham, Collins, Cypher, Goddard,
Mrs. Merner, l.:itchell, rt.oaher, Sal3man, Thoits.
NOES: Cashel.
ABSENTt Costello, Richards, Thomas, Wood.
