RESOLUTION OVERRULING PROTESTS IN PROCEEDING~

WHEREAS, the City Council ot the City of Palo Alto
did on the 12th day of September, 1~38, pass ita resolution o~
1nterst1on to order certain work therein deaor1bed to be done
and 1~provementa to be made in aa1~ city, which reaolut1on or
intention waa duly and.legally publiehGd as required by l¥w,
aa appears !rom the affidavit now on file in the office of the
City Clerk of aaid city; and
WHEREAS, in and by aa1d Reso.lut1on of Intention
notice was duly giv~n that on Wednesday the 28th aay of
September, 1938, at 72 30 P. lt.., at the Council Chambers or the
City 6ounc11 of said City, in the City Hall at the eaid City
of Palo Alto, waa thereby fixed aa the time and place when and·
where any and all peraone having any objections to the work
and improvemente therein proposed or against the d18tr1ct to be
aeseo$ed for the coats and expenses thereof, or against tho
grades at wM.ch eaid work should be done • may appear be tore
&Qid Council and show cause why sa1d improvemente should not
be carried out in accordance with said Resoluti~n of Intention; and

WHEREAS, ea1d matter duly came on for hearing at the
time and. pl.ac.H'l &.t'oreu.id and zrundry pretests and objections to
aa1d ~rk and improvements or to the grades at which the same are
to be done or to the district to be aeeeeeed tor the costa and
exp$naes thereof, were duly filed and duly presented to said
City Couno:n, and sa'd City Council duly heard each and all of
the sat9 prote&ta and duly considered the objections ~nd matters
therein set forth, and being fully advised in the prem1~ee:
IT IS THEREFORE NOW AND f~REBY FOUND AS FOLLOWS, TO-Wl'l's
( 1) That the aforeaa1~. protests are made by owners of
property who (in the aggr6gate) own less th~n a majority of the
prop6rty fronting on the proposed work;
( 2) That the cost or the work and 1mprove:rnents 1a to
be assessed upon preperty within a district, and whic~ said
assessment d1str1.et and the exterior bouna.ariea thereof are more
particularly del1neateQ, indicated, and described upon the plan
or MP enti·l;led, "!lap Showing A!ee~sment District Under Improveo-
lllent Plan No. 60, for the Improvement of Boyce Avenue, et s.l., Septe~ber, 1938, J. F. Byxbee," and which map is made a part
of the above plane, all as more fully set forth 1n the eaid
I\eeolut1on of Intention, to which re1'~rence is made for further
particulars, and that such protests were made by owners w.no, in
the aggregate, own les!l than one-half of the area of the property
to be a:~seseed for said i.mprovem~nts and le.ee thsn one-half of' the property within the district aforesaid.
(3} That ln the judgment of the said Council, and of the member~ thereof, ~~e sa1d protests should be overruled.
WHEREFORE, I'l' IS NOW AND HERE RESOLVED AND ORDEP.:El>
'l'HA'I' the said protel!ts and objections, and each and every of them,
be, and the same are hereby, overruled and denied.
