RESOLVED, by the City Council of the City or Palo Alto, Cal1forn1a, that
WHEREAS, pursuant to proceedings thereunto duly had and taken by this Council, the aa1d City entered into an agreement
with the Union Paving Co., a corporation, dated Auguet 12, 19~,
as the lowest renpona1ble bidder therefor, ror the construction
ot the work and improvements provided to be done under and pur-
suant to Resolution ot Intention Ko. 1516 adopted by this Council on June 10, 1946;
WHEREAS, said contractor failed to undertake said work
and improvements within the time provided therein, IUld this
Council caused notice to be given to said contractor and its
au~ety, the Central Surety & Insurance Company, a corporation,
that said contractor and its surety had failed to undertake
said work within the time provided in said notice and in said contract;
'WHEREAS, new bids have been called for the doing of said
work, as a result or which it appears the lowest respona1ble bid
therefor le considerably higher than the amount ot said contract,
and to award a contract thereon will result in prolonged and ex-
pensive litigation and possible financial loss to said City or
the property owners in the assessment district created under
said Resolution or Intention;
WHEREAS, the Department of Public Works ot th1s City
has determined that 1t 1s for the public welfare and best interest
that sa1d improvements be done by said Department of Public Works
at the prices named in the said contract w1th the Union Paving Co.,
and that sa!d work may be done for less cost than that of the
lowest bid received therefor on June 9, 1947;
NOW, THEREFORE, IT IS ORDERED, as follows:
l. That said City Council hereby rejects all of said
proposals or b1ds received and publicly opened and examined by
said Council on June 9, 1947;
2. That it is for the public welfare and beat interest
that said work be done by the Depart111ent or Public Works or said
City, which Department can do said work tor less coat than that
ot the lowest bid therefor publicly opened, examined and declared
on June 9, 1947, and that a contract ,t'or said work i.a hereby
awarded to said Department of Public Works at the prices named in
said contract dated August 12, 1947 and executed by the said City
of Palo Alto and said Union Paving Co., a corporation;
3. That said Department or Public Works shall be and
constitute the contractor for the performance of said work, a.~d
shall have and exercise the same powers, rights, duties and
obligations as are provided for said contractor under the laws
pursuant to which said contract waa awarded to said Union Paving
Co., and the provla1ons under the Charter and ordinances or the

without any bond given tor aa1d purpose, and aa1d work shall
be done in accordance with the pl&r\a and apec1f1cat1onB
adopted therefor in the ea.me manner and torm as though aa1d
work had been let to the ~owest responsible bidder therefor.
I hereby certify the f orego1ng to be a true copy or
resolution adopted by the City Coune11 of the City or Palo Alto,
Cal1torn1a, at an adjourned regular meeting thereof held on
the 27th da.y or Jun.e, l91J7, b7 the following vote or the mem-
bers thereof:
