that it does hereby prel1m1n&r1ly determine that the public con-:
venience aoo necessity require, and that it 1ntenda to order the
following acquisitions be bad, vork to be done &nd improvements
to be made in aIICl for Ba1d City, to-wit:
1. The 1mprov1ng of Lytton Avenue between Al118 Street and
Emerson Street by the installation therein of electro11ere complete with concrete bases and conc.1u1t and cable.
2. The improving of Lytton Avenue between Bl:lleraon Street and
Cowper Street by acquiring seven feet on e&ch aide thereof for
widening, al'X1 gl'S.d1ng, removal or trees a.f.ld exiat1.ng structures,
reconstructirig cement concrete curba 1 gutters,· sidewalks, &n1
storm water catch basins anc! drs.1n pipe, relocating e~1st1ng hy-
drants vith caat iron pipe connections, eonatructins cement con-
crete baee pavement with an asphalt concrete vear1ng surface, &nCJ

}. The improving or Hamilton Avenue between Alma Street and
Ramona Street by widening, sett1Dg cu1•bs back fO\ll" feet, by gracUng,

catch basins aoo drain pipe, constructing e.n asphalt concrete

4. That Hamilton Avenue between Waverley Street aoo Cowper
Street be improved by acquiring seven feet on each side thereof
tor widening, by gr&ding the eidee, removal or treea and existing
structures, and relocating cement ccncrete curbs, gutters, side-
walks, a.rXJ storm water catch basins and drain pipe, relocating e~1st1ng hydrants with cast iron pipe connect1or..s, the construct-
ion or cement concrete base pavement on either side or the·e~ist1ng
base and an asphalt wearing surface betveen curbs, and the install-
ation of electroliers complete with concrete bases and comuit am cable.
5. That Bryant Street between Lytton Avenue and a line 100
feet northerly of University Avenue be improved by acquiring seven
feet on each side thereof tor widening, by gr&d1.xig on each·t!tide
thereof, removal or trees an£! existing structures, recona~ructing
therein cement concrete curbs, gutters aIXI sidewalks, reconstruct-1ns storm water catch basins ar.a1 drain pipe, reloc4ting hydre.nts

6. That Bryant Street between University Avenue a~ a line
100 feet northerly thereof, ant!! the easterly half thereof between
University Avenue a.D(J a line 110 feet southe~ly thereof be im-
proved by g1-a.d1ng, by removal of trees and existing structu.res,
and reconstructing therein cement concrete curbs, gutters, si~e

half thereof, thence to Hamilton Avenue, by acquiring on the sides
thereof seven feet for -.11den:tng and grading oute1de the pavement,
the removal or trees and existing structures, and reconstructing
the::rein cement concrete curbs, gutters, s1dewalk.e and storm
water catch basir:w a.IX! drain pipe, relocating fire h~dre.nts with
caet iron vater pipe connectiona, the installation or electroliere
complete with concrete bases and conduit and cable, and the
installation therein of asphalt concrete wearing surface over the
existing pavement.

crate base pavement with asphalt1c concrete wearing surface betveon
curbs, and the installation of electroliere complete with concrete
oases and col'ldu1 t and cable.
10. All of said work and improvements are to be constructe~
at the places and in the particular locations, of the forms, sizes,
dimensions and materiale, and to the lines, gre.des, anC! elevations
as shown and delineated upon the :plans, profiles and specifications
prepared therefor, and on .file in the office of the City Engineer
1n the City Hall of said City, reference to ~h1ch is hereby made
for full and dets11e~ description of said proposed work and for
.further particulars.

14. A map or plat of the lands and improvements necessary
or convenient to be ~aken for such proposed improvement .has been
filed ~1th the City Clerk ~Dd approved by the City Council, to
Vh1ch reference 1e hereby made for further particulars.
15. A statement of the total estimated cost or said improve-
ment, stating sepal'6tely the estimated cost of each class of
conetruct1on proposed, and of each parcel or land or improvement
proposed to be acquired, and of the 1nci~ental e~pen.ses or sai~
proceedings and of said acqu1s1t1ons an(! i~rovemente has been
filed with the City Clerk anci approved by the City Council, to
Yhich reference is hereby made for further particulars.
16. The City ~111 contribute toward the cost and expense of said project the following:
a. The cost of all work 1n intersections between property lines e~teooed ..
b. The cost of relocating all utilities 1ncl\Ul1ng f1?'e hydrants am parking meters.
c. The cost of all. tlcqu1s1t1ons and improvements front-
ing on the City Hall Pa.1~k am the City Library.
d. Thirty per cent of the cost or all acquisitions.
e. Thirty per cent of the cost of curb3, gutters, pavement
aoo resurfacing including grading aro removal of trees and e:x1st1ng structures.
17. Said contemplate<:! acquis.1t1one aoo improvements, in the
opinion of this Cou.a~cil, 1s of more than local or ordi.cs.ry public
benef1 t, a.nd the balance of the cost aoo expense ot.• doing ss.1a
. v:crk a.oo the e.xpensea inc1<5ental thereto, shall be made chargeable
upon the district benefited thereby, which district shall consist
of the corusolidnted aod co.m;posite areae of all of the parcels
of property fronting on eaid acquisition and vork, and the ex-
terior bounClaries of said district are hereby declared to be the
coterminous boundarie~ of said composite and consoliclated B.?'ea.
The p!'operties so benefited, and the boundaries thereof, a.re more
particularly shown on tha map or se.ia e.sseeement. district on file
in the Office of the C:tty Clerk of said city, to which reference
1s hereby made for a mo1·e detailed description thereof.
18. That the City Hall Pnrk and the Libre.ry property, and
other publicly owned property in sa1cs assessment d1strtct, sh.all
be a.ueessed for 1te share of the cost of' sail!! benefits and the
amount thereof pa16 in cash by the City. All public streets,
alleys and va.ys in use in the performance of the public function
shall be omitted from the asses$ment hereinafter to be made to
cover the cost of said improvement.
19. Notice is hereby given that serial bo~e to represent
the unpaid auaeaaments ancl bea.r interest at the rate or not to e~ceed four per cent (4~) per annum~ will be issued pursuant to
Part 4, Bond Plan C of Article J:V of the Palo Alto Imprcvement
Procedure Code, the last inatallment or -which shall mature nine
(9) years .from the second day or July next succeeding ten months

of bor.de, all of the above proposed vork shall be "one in pur-
su&nce or the provie!orus ot Article V of said Palo Alto Improvement
Procedure Code.
21. That said acquisition and improvement proceedings are
annlogouo a~ s1m1lar in effect to th.ose provided 1n California
etatutee of 1913 at Page 421 et seq., as amended, alX! said bond
proceedings a.re analogous am similar in effect to thoBe provided
in Division 10 of the CEll1forrJ..1..a Streets and Hlghvay.a Code, and,
e:xcept1.ng as herein otherwise provlded, tl:l.ese proceedings shall
respect1.vely be deeme~ taken pursuant thereto.
22. Notice 1s hereby g1 ven that Monday, the 28th day o.f
April, 19'+7, at the hour or 7:30 o •cloc. P.M., at t.he Counoil
Chllmbere or the City Ccuncil of.' said City in tho City Hall or said
C1t7 are hereby fixed as the time &~ place vhen and where any anes
all persona 1ntere8ted may appear a.ntJ show cause, if a~.;y they
have, vhy th~ City Council should not find al'lCI determine that the
public convenience and necess!ty require the improvements Cescrlb~
and referred to in this resolution, without further compliance v1th
the Special Aesessment Investigation, Limitation and Majority
Protest /1ct of 1931, as prov1c'le<l 1n Article I of said ordinance.
23. The Clerk of the City of Palo Alto shall give notic6
or the adoption of this resolution by publishing a Notice of
Proposed Local Improvemont once in the Palo Alto T1mea, a ~a1ly
newspaper published and circulated 1n said City~ and by posting same
on or near the Council Chamber door of sai~ Council, said posting
a~ publication to be ba~ at least ten days before said ~ate of hearing.
