OF PRELIMINARY DETERMINATION
PROJECT NO. 46-1-A
RESOLVED, by the Council of the City or Pelo Plto, California~ that 1t does hereby prel1m1nar1ly determ1.ne that tho
public convenience and necessity reou1re, nnd that it 1nte.r:ds to
order the following ~ork to be done a?XJ improvements to be ma~e
1n and for said City, to-wit:
1. That Pepper Avenue between Bl Camino Reel and First
Street, includ1r.Ag intersections, be improved by con.8truct1.ng
therein grading, criJsher-run base pav~ment end asphalt concrete
wearing surface, Portland cement concrete curbs, gutter8, side-
velks and dr1vevay aprons, a.JXJ sewer, vater soo gen leterals, aod
work inci~entel thereto;
2. That all of said work end 1mprovemente are to be
conetructet'J at the places snd in the particular locations, of' the
forms, sizes, t'Jimell81ons a.J:ld materials, &nC! to the lines, grades,
end elevations as ehovn anCJ delineated upon the plans~ profiles
and specifications prepared therefor, and on file in the otrice
or the City Engineer in tl:a City Hall cf said City, reference to
Vhlch ls hereby ma~e for full snC! detailed t'Jegcr1pt1on o~ sn1d
proposed vork end for further pert1culors;
3. There 18 hereby e~cepted from the above vork thst
Vh1ch is already done to line arii grade end marked "e~cepted• or
sho'Wn "not to be done" on the plens, profiles am spec1f1cnt1ons;
4. The City Council d~es hereby adopt a~ estebli~h es

upon snid plans, profiles or.id specifics tions. All such grades
a~ elevatiorus ere in feet and decimals thereof 1n reference to
the official b6.se a~ datum of' said city;
5. All of said work shall be done ~er the superv1s1on
of the City Engineer of the City of Palo Alto, a~ all or
ssid work and materials shall be done enj furnishe~ to h1s
sa tiafact1on.
6. Said contemplated vork and improvement, in the
opinion of th1a Council, is o: more than local or ordinary
public benefit, a~ the cost sn<.'J expense of doing said work and
the expenses incidental thereto, shall be made chargeable upon
the district benefited thereby which district shell cons1at
of the conao11~ated and composite areas of all of the parcels or property fronting on said work, together v1th all properties
fronting on eny street within one-half block or an 1nteraect1on
~hich is be1;ng improved here~er, a.J:ld the e~terior bo~aries
of' ea1a district are hereby declared to be the coterminou3
bound&r1ee of said composite ar.:1 consolidated area. The propert1Js
so benefited, and the boundaries thereof, are more particularly
shovn on the map of sa1d assessment district on !1le !n the
office of the City Engineer or ssid City, to which reference 1e
hereby made for s more deta11E1<l description thereof;
7. Notice is hereby given thst serial bonds to represent
the unpaid asseaementa a.IX! bear interest at the rate of not to
e:.xceed four per cent (4%) per annum, v1l.l be issued pursuant
to Pe.rt 4, BolXI Plan C of Article !V of the Palo .Alto Improve-
ment Procedure Code~ the last 1natallment or Vhich shall mature
nd..ne (9) years from the seco.J:ld day of July n.e~t succee~ing ten
monthm from their date;

pursuance of the provisions of Article v of ss1d Palo Alto
Improvement Procedure Code;
9. Notice 18 he~eby given that Monday, the 24th day or
February l91i?, at the hour or 7:30 o•clock P.M., at the
Council Cbambers or the City Council or said City 1n the City
Hall of sa1~ City are hereby fixed as the time &Id place When

and dete:rmine that the public convenience and necessity re-
quire the improvements described a~ referre~ to in this res-
olution, ~1thout further oomp11ance vith the Special Assess-
ment Investigation, Limitation and Majority Protest Act of 1931;
10. The Clerk of the City of Palo Alto shall give notice
of the adoption of this resolution by publishing a Notice of
Proposed Local Improvement once in the Palo Alto Times, a
daily nevspaper published and c1raulated 1n said City, and by
posting same on or near the Council Chamber door of aa1d
Council, said posting arXJ publication to be had at least ten
~ays before aaid date of hearing. .. * * .. *
I hereby certify the foregoing to be a true copy of
resolution adopted by the City Council or the City of Pelo Alto,
California, at a regular ~eetir.ig thereof held on the 10th
aay of February, 1947, by the folloving vote of the members
