RESOLVED, by the City Council of the City of Palo .Alto,
Santa Clara County, California, that
'WHEREAS, a?J. aseessment aoo Cl1agram was ma~e am filed
vith the City Clerk of said City, all pursuant to Resolution of
Intention No. 1516 adopted by the City Council of said City on
June 10, 1946, and to the provisions of Article V of Ordinance
841+ adopted '7anuary 13, 1941, entitled •Palo Alto ImpI'ovement
Procedure Code", and said assessment vu1 confirmed by said City
Council o!"' aa1d City on ,July 29, 1946, and ,, rroorded on July 30,
1946, 1n the office of the Super1ntende~1.t of St.r"9ets of sa1d
City; and
WHEREAS, said assees.ments vere irregularly levied, 1Hld
are not enforceable th1·ough the curative provisions in !'elation
thereto;
NOW, THEREFORE ' IT lS ORDEm:D, the t
1. Fabian Miller, City Er..g1neer of said C.· ty, make ar.Jlj
file with this City Council a reassessment of all parcels of
property formerly assessed unCler· ~aid Resolution of Intention;
2. The reasses~ment shall asaess upon and against each
of the lota~ pieces, or parcels of land contained th.ere1n an
e.m~)unt ar1•1 ved at aa follo'WS: The benef1 ts derived, or to be
derived~ by each of said lots, pieces or parcels of larl('!, from
the vork or improvement, est1matei::I e.s of the date of the .filing
of the original asses~ment vith said City Clerk, shall first be
listed. The total of such reaseesment, however, shall not excee~
the cost and expenses of the work and improvement. Said reassess-
ment ahall refer to the original assesament filed, giving the
ante of filing said original a.saessment aoo state that it is
made pursuant to the order of this City Ccuncil, and shall be
e.ccompa.n1ed by a ~1£Lgrarn showing the lots to be reassessed and
their relat101 .. to the work.
IT IS FURTHER ORDERED th.at said reassessment, \Jhen
completed, shall be presented to th1a City Council.
