of the City of Palo Alto, being the legislative bod7 thereof, aak1ng L
that the t.err1toey descrlbed therein be annexed to the City or Palo
Alto; and
WHEREAS, it appears from the certificate of the City Clerk
attached to ouch pet1t1on that the aame is a1gned bJ one-fourth and
more in numbi)r or the qualified electors reai~ing within the terri-
tory describ~d therein as ahovn by the regiatrat1on of voters 1n
the County of Santa Clara; and~
'WHEREAS prior to the o1rculat1o.n ot the above mentioned
petition the Council or the City or Palo Alto paaae~ a resolution
authorizing pet1t1on~re to circulate the aaid petition and pet1t-
1oners thereafter published a notice or intention to circulate the
same ae preeor1bed by the Anne~at1on Act or 1913 of the State or
California, as amended to date;
NOW, THERKFORE, the Council of the City of Palo Alto DO
RESOLVE as follows:
Section l. 1rhat 1t is hereby found an.cl determined that the
petition asking that the territory hereinafter oeacribed be anne:a~
to the C.ity of Palo Al to is signed by one-fourth and more or the
~ualified electors ~eeiding within tho territory deecr1be~ 1n aa1d
petition and hereinafter set forth aa shown by the registration or
voters of the County of Santa Clara.
Section ~. That the boundaries of the territory so proposed
to be anne~ed to the City of Palo Alto are ae follows, to wit:
All that eerta1n real property situate 1n the Cowity
of Santa Clara, State of California, and bounded by the
following ~escribed line:
Beginni.ng at e. point 1n Newell Road eal(l point being
the point or intersection or the Southeasterly corporate limits
line of the City of Palo Alto with the Northwesterly
prolongation of the Southwesterly boundary line of
Tract No. 195 Newell Park Unit No. l; thence from said
point of beginning North0aaterly along said Southeasterly corpor-
ate l1mtts line to a point in the center line of
San Franc1squito Creek, aa1d point being on the Northerly
line of Tract No. 234, Crescent Park Map #4; thence Raat-
erly along said Northerly line to the most Ee.sterl7 corn~r
of ae1d Traet No. 234; thence southwesterly along the
Southeasterly line of said Tract No. 234 and the south-
easterly line of said Tract No. 195 to the most Southerly
corner of said Tract No. 195; thence Northvesterly along :J

Section 4. That it 1s the intention or the Cowicil or the
City of Palo Al~.o to call a. special election and submit to the
electors residing 1n the territory propos$~ by such petition to be
annexed to the Cit;y of Palo Al to the question of whether such terri-
tory shall be annexod to, incorporated 1n and made a part or the
City or Palo Alto, on Tuesday, the 8th day of October, 1946.
Section 5. Notice 1a hereby given that any person owning
real property within :such territory so proposed to be &rJlleze<.'I and
having any objection to the proposed annexation, may at any time
not lHter t.h.e.n the hour herE11n net for the hearing, make written
protest aga.tnet the proposed aiinexat1on and may appear oerore the
City Council of the City of Palo Alto in the CoWlcil Cnam,~r in
the City Hall of 8&1d city, on Monday, the 12th. day of August, 1946,
at the hour of 7:30 P.M., and show cause why aa1d territory shoul~
~ot be so annexed.
Section 6. That the proceedings for said annexation shall
be had,~ and conducted pursuant to an act ot the Legislature 01' t:10
State ot California cntitle<l •An act to provide for the alteration
of the boundaries or arul for the annexation of territor:r to muni-
cipal corporation, for the incorporation of such annexed territory
in and as a part thereof, a!l(j for the districting, government and
municipal control of such arme.xed terr1 tory •, approvecl Jwie ll,
1913, and all acts amendatory thereto.
Section 7. Reference is hereby made to said petition on file
in. the office of the City CJ.erk or the City of Palo Alto for de-
tails s.s to the bonded 1.ndebteCJness or said city, incurr~ •:>r
authorized, outstanding on the <.'late or the filing of said petition,
for which the territory so propose~ to be annexed to said city
will be subject to taxation in the event of annexation.
Section 8. The City Clerk shall ca.use a copy or th1s resol-
ution to be publishe<J once a week for two successive weeks prior
to the hearing, in the Palo Alto Times) a newspaper of general
circulation, there bE1ing no ne"Wspa.per of general circulation 1n
the territory proposed to be anne~ed.
The above and foregoing resolution was ch.U.y aoo regularly
introduced and passed a.t a 1•egular meeting or the Council oi' the
CJ.ty of Palo Alto held on M('nd•J.y, tl".te 8th day of July, 1946 .. by the following vote:
AYES: Beene, Bentl'ott, Blois, Bolander, Bow<Sen, Cashel, Freedman,
Linder1 Merner, Mitchell, Morten, Richards, Tho1ts, Thome.a.
NOES: None.
