DETE..~NING T 0 MAD IMPROVJ:Mmr.r WITHOUT COMPLIANCE WITH INVESTIGATION AOJ.1 PROJE()I' NO. 46-2 MELVILLE AVENUE, ET AL RESOLVED, by the Council of the City of Palo Alto, Ca.lifo1~n1a,, that 'WHEREAS, on Ml:y 13, 1946, th1s Council a~opted its Resolution of Prel1m.1.ne.ry Determination No. 1503 to conatruct certain public 1.mp:.·ovements more pe.rt1cula.rly therein described and did fix the~ ~L this date as the time and place when and where any a~ all 'rsons intereute~ ma.y appear and show cause, if any they have~ why the Cit7 Council ehould not f1.nd and determine that the public convenience and necessity :require the improvements described and referred to in ea.id reaolut1on, without compliance with the 5pec1al Assessment Invest1ga.t1.on, Limitation and Majority Protest Act· of 1931; \!REREAS, notice of' the adoption of oa1d preliminary reso- lution and of said time and place or heartng was g1ven by the City Clel'k by publ1ce.t1on and poat1ng for the time and 1n the manner provided 1n 8a1d resolution of preliminary determination and Article I of' the Palo Alto Improvement Procedure Code, as appears from aff1dav1te on file with the Cit1 Clerk; ~S, written objections to the u.n.dertsk1ng or said proceedings vithout first complying v1th the provisions of said Investigation Act have been filed v1th the City Clerk at or before the time fixed for this hearing by persona in- terested, owning or having an interest in real property w1th1n the proposed assessment cUatrict, beaz•1ng their signatures, a description of their property, and a statement of the nature of their interest therein; and 'WHEREAS, all persons interested have been given an oppor- tunity to be and were fully heard, and said Council has duly considered any and all objections and protests made, and the said proposed improvements, and the public convenience and necessJ.ty for making same. follows: NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as l. That the public convenience and necessity require the improvements describe~ in said resolution of preliminary determination; 2. That any ana all objections and protests me.de pursuant to said resolution of preliminary determination be and the same are hereby overruled e.nd denied; 3. That the improvements described in said resolution be made under and pUl"suant to the p1•ovis1ons of the Palo Al to Improvement Procedure Code more particularly referred to in said resolution, And that the $psc1sl Assessment Investigation, Limitation and .Majority Protest Act of 1931 shall not apply to said proceedings.
