RESOLUTION NO. 3846
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
FINDING AND DECLARING THAT A MAJORITY PROTEST HAS
NOT BEEN MADE TO THE ANNEXATION OF CD.TAIN UNINHABITED
TERRITORY DESIGNATED AS EL CAMINO-MAYBELL ANNEXATION

WHEREAS, on the 28th day of June, 1965. the Council of the
City of Palo Alto did pass and adopt Reaolution No. 3333 aiving
notice of the proposal t·;; :11unex certain uninhabited territory
to the City of Palo All: .. :· ·.<';. territory beina therein. deaipated
as "El Camino-Maybell Anr.x&~tion", said Jesolution deac:ribiq
the boundaries of the territory proposed to be annexed; and
WHEREAS, said Resolution No. 3833 did contain a notice of the
day, hour and place when and where the Council of the City would
hear protests made by any peraon owning real property within the
territory proposed to be annexed, the time of said hearina beina
not leat than forty nor more than sixty dtya from the date of
paaaaae of aaid Resolution; and
WHEREAS, on the 9th day of Au,uat, 1965, at the hour of
7:30 p.m. in the Council Chambers in the City Hall of the City of
Palo Alto, County of Santa Clara, State· of California, aaid time
and place being the day, hour .and place fixed in said Reaolution
No. 3833 for hearing protest• to the aaid annexation, said hearins
waa opened and continued to September 27, 1965; and
WHEREAS, on September 27, 1965, said City Council did bear
and pass upon all protests made to the propoae4 annexation and
did determine that protests had not been made by the owners of
one-half of the value of the priv•tely owned territory proposed
to be annexed aa shown by the last equalized asaeaament roll, nor
by the ,?ublic owners of one-half of the valu~ of the publicly
owned territory proposed to be annexed as determtned by said
leaialative body; and

WHEREAS, said territory is contiguous to the City of Palo
Alto. and is uninhabited territory in the County of Santa Clara,
NOW, TK~FORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. That prior to final adjournment of said hearing,
protests against said annexation were £iled by Pietro Buttita,
Trustee, and Janet S. Thain, owners of land anu improvements
within said territory having an assessed valuation of $12.080.00
and $19,570.00 respectivelyt and by Arthur. Y. Chin, a tenant at
526aA Maybell in said territory to whom certain personal property
is assessed on the unsecured roll in the value of $2,440.00, and
Grant S. Denmat·k, .a tenant at 4156 El Camino Real in said ter~
ritory to whom certain personal property is assessed on the
unsecured roll ir1. the value of $840.00; that the value of said
territory as defined in Section 35313 of the Government Code as
shown on the last equalized assessment roll is $64,420.00.
SECTION 2. That the Council does hereby find and declare that
said protests of Arthur Y. Chin and Grant A. Denmark do not con
stitute valid protests as defined in Section 35313 of the Govel~
ment Code, that the protests filed by Pietro Buttita, Trustee, and
Janet S. Thain do not constitute a protest made by private owners
of one-half of the value of the territory proposed to be annexed
and that there i.s no publicly owned property within said territory.
SECTION 3. That the Council does hereby find and declare
that a majority protest against said annexation has not been made.
