PAS~)ING UPON AND OVERRULING PROTESTS MADE AGAINST
THE IMPROVEMENT AND ASSESSMENT DISTRICT AS
CON~:EcPLATli:D Ill ORDINANCE 10. 391 RELATING TO THE
OPEHING AN'.J ~'iIDENING OF CU!BRIDGE .AVBNUE:
The Council of the City of Palo Alto DO
RESOLVE aa tollows:
WHEREAS, in conformity with law, thie Council
did on the first day of September, 1927, at eight
f. M~ m~et in session at the council chamber in the
City of Palo Alto for the purpose, among others, or hearing protests against the improvement and
to the extent of the impro~ement district contem-
plated by Ord1nance of Intention Ho. 311, being
m ordinance for opening and widening Cambridge
Avenue under the Street Opening Act ot 1903,
reference to whioh ordinance for further
,art1oulars is hereby made:
WHEREAS, certain written protests were
received by the City Clerk, and filed and
presented to thia Council; and,
WHEREAS, 1 t ::>.ppe are to this CoWlcil from an
inspection of said protests that said protests are
entirely insufficient and irregular, for the reason
that no affidavits or the signers thereto are
attached to said protests, aa required by Section
4 of the Street Openiug Act or 1903; and
Vt.BEREAS, 1 t also appae.J:•s that the irregular
protests are not signed by the owners or a
majority or the frontage of the property rron.t1ng
upon streets or parts of. streets within said
assessment district; and,
WHEREAS, it appears to this Council by the
affidavit of the principal clerk of the Daily
Palo Al to Times,, that notice of said hearing wae
duly published for at least five days, for the
time &nd in the manner provided. by law, a.nd it
f'urther appearing that said time was r1ot lea•
than ten days a!ter the meeting fixing the hearing
on sa1d matter; and,
WIU."Rl!:AS , this is now the tinm tor passing
upon said protests, this Council having duly
convened in an adjourr.ed regular meeting at eight
P. M. on this lat day of September, 1927, at the
counc~.l chamber in the city hall of the City of
Palo Alto, for consideration or said protests,
and said protests having bean fully and «uly
considered and said objectine; property ownern heard
on said matter:
NOW, THEREFORE, be it RESOLVED, that each
and every one of the protests f1lad and presented
to this Council with reference to the improvement

same are hereby overruled and denied.
The above and foregoing resolution was duly
introduced and pa.ased at the adjourned regular
meeting of the Council of the City of Palo Alto,
held at eight o'clock P. M. in the council ehmnber
at the city hell, on ttie 1st day of September, 1927,
by tho following vote:

Bertsche, Bonn, Christensen, Cottrell, Hobert,
Hoge, Kelly, Lausten, Thomas, Wing, Wood.
None.
ABSENT: Cathcart, Jordsn, Thoits, Whisler.
