APPOINTING DATE OF REARING OF' PROTESTS AGAINST THE
OP.I<;Nll4G A.ND WIDEN!.NG OF CAUBRIDGE AVENUE.
The Council or the City or Palo Alto DO
RESOLVE as follows:
THAT WHEREAS, protests against the openlng
and widening of Cambridge Avenue in the City of Palo
Alto, as proposed by Ordinance or Intention No. 391
of thie Council, reference to which ordinance is
hereby made, hav@ been filed by GEORGE w. MOFFITT,
JOSEPHINE 3. MOFF! 'IT, EDNA M. GARRIGUS and CATHERINE
B. HARTMAN:
NOW. THEREFORE, this Council does hereby
find and determine that the protests of George w.

owned by the.,, and the protest of Edna M. Garrigun,
as to the property represanted by her as guardian
of the pt:1·sons and estates of Elizabeth Fisht:ir and
J'a:nes F1.sller, minors, and the protest of Catherine
B. Harman, are entirely insufficient and irregular
in that said protests do not comply with Section 4
of the Streot Opening "'-et of 1903 which reads as
:follows:
~Every such protest m~st contain a
description ot the property in which
each signer theI'eof is interested,
sufficient to identify the same, and
must set forth the nature of his interest
therein, and must be accompanied by the
aff1dav1 t o!' one of the sigi1er3 thereof•
that tho signature thereof is the genuine
signature of the person whose name is
thereto subscribed; and 1n case any
signature is made 'by an agent there must
be attach~d to the protest, the affidavit
of the agent that he 1,s duly au.thor1zed
to s1gn such protaet. Any proteet not
oomplying with the foregoing requirements
shall not be considered by the City Council.»
This Council further finds that suoh pr·o-
tests are particularly irregular and insufficient
for the reason that no affidavits of the signers
the:r·eto arc atte.ohed to said protests, aa required
by law: Therefore this Council reserves all legal
rights of the city on account of the 1nsuff1cien¢y
and irregularity of said protests.
THERE!c'ORE, It is Hereby ORDER'ED,, that
the lst day of September+ 1927, at the hour of eight
P. M. of said day, is hereby fixed by said City
Council as th~ time for hearing sa.id protests,
which time is not less than ten day3 after this
meeting or the Council at which said time is ao
fixed: That at said time, all protestants will

be given an opportunity to be heard at the council
chamber in the city hall of the City of Palo Alto.
The City Clerk is hereby directed to
cause a notice of said hearing to be published
at least five days in the Daily Palo Alto T1me3.
The above and foregoing resolution was
duly passed at a meeting of the City Council
held on the 15th day of August, 192'7', by the
following vote:
