HomeMy WebLinkAboutRESO 5817• ORIGINAL f RESOLUTION NO. 58i7 ------ RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO APPROVING THE APPLICATIOW AND THE PROJECT AGREEMENT FOR HISTORIC PRESERVATION GRANTS-IN-AID FUNDS FOR COMPLETION OF HISTORIC INVENTORY WHEREAS, the Congress under Public Law 89-665 has authorized the estabiishment ot a National Historic Preservation Grants-in-Aid Program, providing matching funds to the State of California and its political subdivisions for historic preservation, survey, planning, development and acquisition projects; and WH~REAS, the State Department of Parks and Recreation is re- sponsible for the administration of the program within the State, setting up necessary rules and procedures governing application by local agencies under the program; and WHEREAS, said adopted procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications and the availability of local matching funds prior to the submission of said applications to the State; NOW, THEREFORE, the ~ouncil of the City of Palo Alto does RESOLVE as follows: SECTION lft The Council hereby approves the filing of an application for the National Historic Preservation Grants-in-Aid assistance for Completion of Historic Inventory. SECTION 2. The City Manager or his authorized representative is hereby directed to coordinate, process and execute all contracts, agreements, amendments or other documents within the scope of the attached application. SECTION 3. The Council hereby certifies the availability of One Thousand Five Hundred Dollars ($lr500} of local w~tching funds for said project. SECTION 4.. The Council finds that this is not a project and, therefore, no environmental impact assessment is necessary. That at said hearing said Council will take evidence and consider the question of whether such undergrounding is in the general pub1 ic interest for one or roore of the following reasons: Such undergrounding wi 11 avoid or eliminate an unusua 1 ly heavy concentration of overhead distribution facilities, or the reconstruction of an existing pole line. Said street or road or right-of-way is extensively used by the general public and carries a heavy volume of pedestrian and vehi~ular traffic. $Jid street or right-of-way is scheduled for major new roadway construction, reconstruction~ or realignment. Said street or road or right of way ad.joins or passes throuqh a civic center. 9. That the City Clerk of this City shall give notice of said hearing by mailing copies of this resoh1tion to all property owners within said proposed district as sh0'1'1'n on the last equalized tax roll of the City, and to all utilities supplying electric, corrmunication or 5imilar or associated services within said proposed district, said mailing to be completed at least thirty (30) days prior to the date of said hearing. 10. That the City Clerk is hereby authorized and directed to include in said notice a statement to the effect that any affected owner has the option of paying the cost of converting his service connection to underground locations over a period of five (5) years~ with interest to be computed at a rate equa 1 to three quarters of one percent ( 3/4 of 1%) in excess of the rate shown in the New York Bond Buyer Index of Municipal Bond Average Yields for 20 bonds for the week next preceding the day on which the underground uti 1 ity district is ordered and formed. 11. That the notice shall also set forth the estimated base cost, incidental expense and special assessment as said terms are defined in Section 12.15.092 of the Palo Alto Municipal Code, and the fact that the City~ upon exercise of the option and the accooipl ishment of the underground construction work as required by Section 12 .16 .090 of said Code,. wil 1 pay the base cost to the owner who accornpl ishes the underground construction, subject to the payment of the airount of the specia 1 assessment in the manner in the manner provided in said Code. * * * * * • * * * * * I hereby certify that the foregoing is a full, true and correct copy of a resolution duly passed and adopted by the Council of the City of Palo Alto, California, at a meeting thereof held on the z.tb. day of July , 1980, by the following vote of the members thereof: -- AYES, and in favor thereof, Councilmerrtiers:Brenner, Eyerly, Fazzino, fletcher, NOES, Counci 1 members: None Henderson, Levy.
