HomeMy WebLinkAboutRESO 5772• t ORIGINAL RESOLUTION NO. 5772 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO CALLING A SPECIAL ELECTION FOR JUNE 3, 1980, FOR SUBMITTAL OF AN ADVISORY MEASURE REGARDING DISTRIBUTION OF SALES TAX TO THE ELECTORATE, IU:- QUESTING THE SERVICES OF THE REGISTRAR OF VOTERS FOR SAID ELECTION, AND ORDERING THE CONSOLIDATIOU OF SAID ELECTION WHEREAS, this Council has considered placing before the electorate of the City of Palo Alto an advisory measure regarding the distribution of sales tax to municipalities; and WHEREAS, Section 23302 of the Elections Code empowers this Council to request consolidation of a special elec=ion with other elections; and WHEREAS, Section 22003 of the Elections Code empowers this Council to request the assistance of the County Registrar of Voters to provide election services to City; NOW, THEREFORE, the Council of the City of Palo Alto uoes RESOLVE as follows: SECTION 1. A special election is hereby called for the City of Palo Alto t:o be held on June 3, 1980, for submittal of the bel·"JW designated advisory measure to the electorate. The City Clerk ·is directed to do all things required by law to effectuate such election. SECTION 2. Pursuant to the authority of the Charter of the City of Palo Alto and the Elactions Code of the State of California. the City Council submits the following proposal to the electorate; CITY OF PALO ALTO MEASURE Advisory Vote Only w-mlould the Governor and Legislature of the State of california be advised thdt it is the will of the people of the City of Palo Alto that the Governor and the Legislature apportion the existing six cents state sales and use tax so that. two cents, rather than the present one cent, be allocated to cities and counties for local services rather than tq the State for state services?" For the advisory measure Against the advi~ory measure SECTION 3. Pursuant to Section 22063 of the Califorr.;i.a Elections Code, the Council cf the City of Palo Alto hereby requests the Board of Supervisors o~ Santa Clara County to permit the Registrar of Voters to render services to the City of Palo Alto relating to the conduct of said City's municipal election which is called to be held June 3, 1980. .. • • ' • The services shall be of the type normally performed by the Registrar of Voters and assisting the Clerks of municipalities in the conduct of elections including, but not limited to, checking registrations, mailing ballots, hiring election officers, and arranging for polling places, providing and distributing election supplies, and furnishing votomatic machines. Subject to the approval of the Board of Supervisors of Santa Clara County of the foregoing request, the City Clerk is hereby authorized to engage the services of the Registrar of Voters_of the County of Santa Clara to ~id in the conduct of said election and the City Controller is authorized and directed to pay the cost of said services provided that no payment shall be for services which the Registrar of Voters is otherwise required by law to perform. The City Clerk is directed to submit a certified copy of this resolution to the Board of Supervisors of the County of Santa Clara. SECTION 4. Pursuant to the provisions of Election Code Section 23302:-=this Council requests that the special election of the City of Palo Alto on June 3, 1980, which will submit the above advisory measure to the electorate be consolidated with the direct primary election. The City Clerk is directed to file a copy of this re- quest with the Board of Supervisors and the County Clerk of Santa Clara County. SECTION 5. The City Clerk is directed to forward a copy of this reso!ution to the City Attorney who shall prepare an impartial analysis for the above advisory measure. SECTION 6. The Council of the City of Palo Alto finds that this is not a project under the Californi& Enviror.mental Quality Act and, therefore, no environmental impact assessment is nec~ssary.
