RESOLUTION NO. 5763
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO AI.TO
AMENDING SECTIONS 6.08 AND 9.07(a) OF PROCEDURES
FOR IMPLEMEWfATION OF THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
The Council of the City of Palo Alto does RESOLVE as follows:
SECTION 1. Section 6.08 of th~ Procedures for Implementation of
the California Environmental Quality Act is amended to read:
"The EIR process should be combined with the existing plannin9,
review, and project approval process being used by the City,
except that projects for which an EIR has been prepared shall
in all cases be reviewed by the Planning Commission for recom-
mendation to Council. The City as Lead Agency shall include
the EIR as a part of the regular project report which is
used in the existing review and budgetary process.~
SECTION 2. Section 9.07{a) of the Procedures for Implementation
of the Califor~ia Environmental Quality A~t is amenJed to read:
"A public hearing on the environmental impact of a project shall
be held. When an EIR is prepared, a public hearing shall be
held by the Planning Corrunission for recommendation to CouncU .•
The hearing may be held in conjunction ~ith and as a part of
normal planning activities. 1'he hearing should be held at the
optimum point in the project review process for public pdrtici-
pation as determined by the Director of Planning. To as great
a degree as pos~ible, these hearings should include comments
from other governmental agencies."
SECTION 3. The Council finds that this is not a project and,
thererore; no environmental assessment is necessary.
