WhereAs, on the 11th d&y of January, 1937 the City Council passed a resolution determining in genera! the nature,
location and extension ot oe:n;t>in propoae4 improvementm in tke
Lewis Subdivision in the City ot Palo Alto, aaid impl"'T.ementa
to be made under plans and specitioationa prepare~ by the City
Engineer entitled "Improvement Plana No • .53"; and
Whereas, a written report upon the proposed improvements
was me.de by the City EngiD.eer; and, wlutreas, said report die-
closes thet the improvements to be mode under said improvement
plans exceed the limitation of assesem~tnt provisions or the
Special Aaaessmsnt Investigation, Ll~te.tion end Majority
Protest Act or 1931; and
Whereas, a hearing wos held before the Board or Public
Works of the City ot Palo Alto on Monday, April 12, 1937, pur-
suant to the provisions or Section 5 ot said ac~; and

Whereas, the Board of Public Works has rendered its
report thereon; and, whereas~ the City Council is familiar

port ot the Board or Public Works ar1ove referred to~ which
reports fire on tile w1 th the City Clerk of the City ot Palo : 1
Alto; ... I
Now, Therefore, the Council of the City ot Palo Alto
DO RESOLVE as follows:
That the project covering the proposed ir:.provements
set forth in Improvement Plans No. 5) is a feasible one) ~nd
that the land to be assessed will be able to oarrlr the burden
ot such proposed assessment, and that the limitation on the
amounts or assessments provided in the Special Assessment
Investigation, Limitation and ldajor1.ty Protest Act of 1931
be exceeded and dispensed with, both with respect to the
limitation of assesments upon the district e.s a whole ~nd as
to the limitation respecting individual specific assessments.
BE IT FURTHER RESOL'lED the.t the i:npro-vements above
rererred to be made and proceedings had in connection therewith
under the provisions or the Improvement Act of 1911.
The above and foregoing resolution was d11ly ana regu-
larly introduced at a regular meeting ot the City Council of
the City of Palo Alt·o held on Monde.yj the 12th day of J~pl'il,
1937, and was thereafter on Monda.y, the }rd day or Mey, 1937,
duly and regularly passed by the following vote:
AYES: Blois, Bonham, Collins, Costello, Goddard, Judson,
Mitchell, Moeher, Salsman, Stephens, Thoita, Thomas, Wood.
NOES: None •
.ABSENT: Richards.
