RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVtNG A REVERSION TO ACREAGE FOR PROPERTIES
KNOWN AS 430 KIPLING AND 431 WAVERLEY AND GRANTING
AN EXCEPTION TO SECTION 21.20.140(SUBDIVISIONS) OF
THE PALO ALTO MUNICIPAL CODE
'WHEREAS, the subject property consists of two separatP.
properties being a 50' by 112.5' lot known as 430 Kipling and a
50' by 105.5' lot known as 431 Waverley Street; and
WHEREAS, an application has been filed for reversion to
acreage involving the above-referenced lots which would require
an exception to Section 21.20.140 of the Palo Alto Municipal
Code inasmuch as the two lots when combined would have double
frontage. '
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. The City Council find$ that there are special
c1rcumstances or conditions affecting the propertyt and that the
exception granted herein is necessary for the preservation and
enjoyment of a subst~ntial property right of the petitioners,
and that the exception granted herein will not be detrimental
to the public welfare or injurious to the_. property in the
territory in which the subject property is situatede
SECTION 2. The Council hereby approves the preliminary
parcel map for the subject property, as shown on the map attached
hereto and incorporated herein by this reference, and grants an
exception to Section 21.20.140 of the Palo Alto Municipal Code,
subject to the following condition: '
.1. The main entranc9 to the building will be 431 Waverley
and the back of the g\dlding will be an employee entrance
plus shipping and receiving and for future assessment purposes
431 Waverley will be considered as-the front and 430 Kipling
will be considered the rear.
SECTION 3. . The Council finds that the proposed project will
not nave~ a 'significant environmental" impact:.
