RESOLUTION NO. 5267
A RESOLUTION DETERMINING TO UNDERTAKE PROCEEDINGS
PURSUANT TO SPECIAL ASSESSMF.NT AND ASSESSMENT
BOND ACTS FOR THE ACQUISITION AND CONSTRUCTION
OF IMPROVEMENTS WITHOUT PROCEEDINGS UNDER DIVI-
SION 4 OF THE STREETS AND HIGHWAYS CODE
SILVA AVENUE -SILVA COURT ASSESSMENT DISTRICT
SANITARY SEWERAGE PROJECT
RESOLVED, by the Council of the City of Palo Alto,
California, that
WHEREAS, all of the owners of more than 60% in area of the
property subject to assessment therefor have signed and filed with
the City Clerk of this City a written petition for undertaking pro-
ceedings pursuant to specia.l assessment &nd assessment bond acts,
and to assess the costs thereof upon the properties benefited by
said improvements, and waiving proceedings under Division 4 of the
Streets and Highways Code, for the hereinafter described acquisi-
tions and improvements;
WHEREAS, the costs and expenses of said contemplated acqui-
sitions and improvements are to be chaTgeable upon an assessment
district, the exterior boundaries of which are the coterminous ex-
terior boundaries of the composite and consolidated area shown on
the map thereof on file in the office of the City Clerk. to which
reference is hereby made for further particulars;
WHEREAS, the public interest and convenience will be served
by the taking of said proceedings; and
WHEREAS, said acquisitions and improvements are more
particularly described as follows> to wit:
a) The construction of sanitary sewer mains,
wye branches, risers, manholes, cleanouts and
laterals, with cast iron manhole and riser fraaes
and covers, in Silva Avenue and Silva Court and in
such easements to be acquired herein as may be
necessary to provide sanitary sewerage service to
the properties hereinafter described.

b) The acquisition ot rights of service and
use in existing sanitary sewerag~ and sewaga dis-
posal facilities of the City of Palo Alto by pay-
ment of connection or other charges duly established
therefor.
c) The acquisition of all lands and easements
and the construction of all work auxiliary to any
of the above and necessary to ~..omplete the same.
NOW~ '111."EREFOBE, IT IS HEREBY FOUND, DETERMINED and ORDERED,
that all of the owners of more than 60% in ~rea of the property
subject to assessment for said proposed acquisitions and improve-
ments have filed with the City Clerk of this City a written peti-
tion for the acquisition and construction of improvements pursuant
to appropriate special assessment and assessment bond acts without
further compliance with the provisions of Division 4 of the Streets
and Highways Code.
IT IS FURTHER FOUND, DETERllINED and ORDERED, that said
proceedings for the acquisition and construction of said improve-
ments shall be had pursuant to Section 13.12.040, Chapter 13.12,
Title 13 of the Palo Alto Municipal Code, and the bonds upon
the unpaid assessments thereof shall be issued pursuant to Section
13.16.110, Chapter 13.16 1 Title 13, Bond Plan B of said··code.
IT IS FURTHER POUND, DETEBllINED and ORDERED, that the
provisions of Division 4 of the Streets and Highways Code be, and
they are hereby dispensed with.

I hereby certify that the foregoing is a full, true and correct
copy of a resolution duly passed and adopted by the Council of the
City of Palo Alto, California, at a meeting thereof held on the 12th
day of Octobe_r~~-' 197_7~, by the following vote of the members
