RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING THE TENTATIVE SUBDIVISION MAP FOR PROPERTY
LOCATED AT 3865 MIDDLEFIELD ROAD IN THE CITY OF PALO
ALTO AND GRANTING EXCEPTIONS SUBJECT TO CONDITIONS
WHEREAs, 4.47 acres of property zoned R-1-B-8 and located
at 3865 Middlefield Road in the City of Palo Alto, being a
portion of the Rincon de San Francisquito, recorded in Book
127, Page 19, Santa Clara County Records, and identified as
Assessor's Parcel No. 127-19-092, hereinafter referred to as
the "subject property" is proposed to be divided into eight (8)
parcels; and
WHEREAS, lots 6 and 7 on a curved cul-de-sac -~re required
by Sectio~ 21.20.110 of the Palo Alto Municipal Code to have a
width of 60 feet at the building setback line and fail to have
this width, requiring an exception from the said requirements.
NOW, THEREFORE, the Council of the City of Palo Alto doe~
RESOLVE as follows:
SECTION 1. The City Council finds that there are special
conditions a!lecting lots 6 and 7 due to the configuration of
the land at the bulb end of the cul-de-sac street and that the
exceptions granted herein are necessary for the preservation and
enjoyment of a substantial property right of the petitioner and
that the exceptions granted herein will not be detrimental to
the public welfare or injurious to other property in the territory
in which this property is situated.
SECTION 2. The City Council hereby approves the tentative
subdivision map for the subject property, as shown on the map
attached hereto and incorporated herein by reference, and grants
the exc~ptions to the requirements of Section 21.20.110 of the
Palo Alto Municipal Code, subject to the following conditions:
1. The subdivider shall construct, at his own expense
and on his own property, a floodwall along the north
property line, immediately adjacent to the Santa Clara
Valley Water District.right-of-way along Adobe Creek.
The height of the wa~~,:shall be at least 11 feet above
the channel bottom. The design of the wall is subject
to approval by the City's Architectural Review Board
and Departme"',t of Public Works, and by the Santa Clar9
Valley Water District. The floodwall shall be incluled
in the agreement for performance of public improvements
required by the subdivision ordinance, and its'
maintenance shall be included in a duly executed deed
restriction upon the properties upon which the wall
will be constructed.
2. The owner shall grant a ten foot public utility easement
along the proposed storm drain which exists into Adobe
Creek. The Santa Clara Valley Water District shall
review and approv~ the drain and its connection to the
creek.
3. The owner shall grant a five foot public utility easement
for power and telephone lines to be located behind the
Mialidlefield Road sidewalk, extending from a point about
55 ·feet southerly of the southerly return of the new
street to a point of intersection with the new street
·right-of-way.

%Ae owner shall execute a grant deed in favor of
the City of Palo Alto for fee title for the proposed
cul-de-sac.
The naming of the new street to be created by the
subdivision shall be referred to the Finance and Public
Works Committee of the Council.
SECTION 3. The City Council hereby finds that the proposed project
Will not have any significant environmental impact.
