RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ADDING SECTION 1502 TO CHAPTER 15 OF THE MERIT SYSTEM
RULES AND REGULATIONS PROVIDING FOR A MEMORANDUM OF
UNDERSTANDING BETWEEN CITY·OF PALO ALTO AND LOCAL
1319, I.A.F.F. RE PROVISION OF FIRE PROTECTION
SERVICES TO STANFORD ONIVERSITY LANDS
The Council of-the City of Palo Alto does RESOLVE as followst
SECTION l. Section 1502 is added to Chapter 15 of the
Merit System"ltules and Regulations to read as followst
"1502. Memorandum of·understand.inq incoz:~rated by reliren~e. That certain memorandum of un~rstand!ng
dated August, 1976, by and between the city of Palo
Alto and Local 1319, International Association of Fire
Fighters, consisting of five pages, is hereby incor-
porated inte these Merit System Rules and Regulations
by reference as though fu)ly set forth herein. Said
memorandum shall apply to all employaes affected by
the provision of fire protection.services to
Stanford University Lands by the City of Palo Alto.
In the case of conflict between this chapter and
any other provisions of the Merit System Rules and
Regulations, this section will prevail over such other
provisibns as to employees represented by said Local
1319, International ASsociation of Fire Fighters.•
SECTION. 2. The Council of the City of ~alo Alto hereby
finds that the enactment of this resoiution is not a-•project•
within the meaning of that term as defined in Section 11.04.130
of the Palo Alto Municipa~ Code and, therefore, no environ-
mental assessment is necessary.

MEMORANDUM OF UNDERSTANDING
Regarding Provision of Fire Protection Services
To Stanford University Lands
CITY OF PALO ALTO and LOCAL 1319, I.A.F.F.
August 1976
This Memorandum of Understanding between the City of Palo Alto, hereinafter
referred to as the 11City11 , and Local 1319, International Association of Fire
Fighters, hereinafter referred to as the 11 Union 11 , has been prepared and entered
into in accordance with Chapter 10, Sections 3500 -3509 of the California
Go~ernment Code and Chapter 12 of the City of Palo Alto Merit System Rules and
Regulations specifically for the purpose of setting forth all understandings
between the City and the Union regard"ing provision of fire protection services
to Stanford University lands herein referred to as "consolidation". Except
as specifically indicated, this Memorandum will not alter the tenns of the
existing Memorandum of Agreement dated December 21, 1975 through December 18,
1976.
ARTICLE I. EFFECT ON RETENTION OF CITY EMPLOYEES
§ection 1. No employee within the Fire Fighter repre$entation unit
employed prior to the operative date of consolidation, and with over
five years of continuous service as a City Fire Fighter as of the
effective date of consol;dation who is employed by the City, would be
laid off directly as a result of the City's assumption of fire service
protection responsibilities for the University regardless of the turn-
over rate the City experiences.
Section 2. No employee within the Fire Fighter representation unit
employed prior to the operative date, but with less than five {5) years of
continuous service as a City.Fire Fighter at the time of consolidation,
who is employed by the City as a Fire Fighter will be laia off as a
d1 rect result of the CUy's assumption of fire protection responsibilities
for the University as long as nonnal turnover rate within the Fire
Department of the City is sufficient. Normal turnaver i·s defined as
sixteen suppression positions within the bargai~ing unit through regular
retirements, resignations. disability retirements, deaths, promotions .
out of the ~rgaining unit, or tenninations for cause within the _bar-
gaining unit of the City's Fire Department by the end of seven (7)_year
period following assumption of fire service responsibilities by the City.

The intention of consolidation is to reduce the number of suppression
positions in the bargaining unit from 122 to 106.
If at the cone l us ion of the seven ( 7) year period, turnover is not sufficient
under this provision to bring about anticipated attrition, reductions
in force will be made in a sufficient number to equal attrition of 13
positions. The remaining three or fewer positions would be retained
for one additional year to see if the necessary attrition occurs before
any further layoffs are made under this provision.
Before any layoffs are made under this provision, the City will make
every effort to provide alternative employment within the City and
within neighboring fire departments. In the event of layoffs under this
provision, those laid off would be offered priority re-employment to
the first fire suppression openings for which they qualify if they are
in the same physical condition as at the time of layoff. Employees would
retain their seniority, benefit accrual rates and their sick leave bal-
ances, if any, would be restored to that level as when they were laid off.
ARTICLE II. OPERATIONAL PLA.N
The operational plan for provision of fire prote_ction services to Stanf-0rd
1ands will be prepared and implemented administratively by Fire Department
management! It is understood that the plan will include but not be
limited to the following:

It is understood that as part of the operational plan:
(1) The Stanford Rescue Van will be designated as Salvage #6.
It is agreed that acting Apparatus Operator pay will be
authorized for one position on Salvage #6 until January 1, 1977.

Experience during the first two months of consolidation will
be the basis for permanent resolution of classifications
assigned to Salvage #6 following January 1, 1977.
(2) Stanford Assistant Chiefs will be classified as Captains and
Y-ra~ed at their current salary as of the date of consolida-
tion.
(3) No students will be part of the consolidation plan.
(4) Acting operators as needed will be appointed by Captains subject
to Battalion Chief approval.
(5) The Stanford master mechanic will be included as a sa.fety member
in the Fire Fighter representation unit. The position will
not continue as part of the Fire Fighter representation unit
beyond the term of the present incumbent.
(6) General orders will be revised as necessary.
ARTICLE III. SENIORITY LIST
The departmental seniority list will be prepared on the following basis:
Palo Alto Fire Fighters will accrue seniority from the date of A-Step
appointment to the Fire Fighter class •. Stanford Fire Fighters will accrue
seniority from the date of first appointment to a Stanford Fire Department
classification.
ARTICLE IV. VACATION SLOTS
The maximum number of vacation slots per platoon available at various
scheduling levels are as follows:

ARTICLE V. PROMOTIONAL OPPORTUNITIES
Section 1. Of the four Paramedic positions to be filled following
~onsolidation, priority will be given in one i>osition to qualified
Palo Alto employees of record prior to the date of consolidation.
The selection process will begin no later than January 15, 1977.
Section 2. Of the four Apparatus Operator positions to be filled
following consolidation, priority will be given in one position to
qualified Palo Alto employees of record prior to the date of consoli-
dation. The Apparatus Operator selection process will be scheduled
not later than February l , 1977, and appointments wi 11 be made not
later than April 1, 1977.
ARTICLE VI. MINIMUM STAFFING
It is agreed that 31 fire suppression personnel (exclusive of the
Battalion Chief) shall be scheduled per shift as a minimum staffing
level. Replacements will be called in whenever it is known that
absences will cause piatoon staffing to fall below 31, except in the
instance of emergency illness after 11:00 p.m. in which case the platoon
may be staffed at 30 until 8:00 a.m.
It is further agreed that in achieving the minimum staffing levels set
forth herein, none of the engine companies shall be reduced from their
level of one Captain. one Apparatus Operator, and one Fire Fighter per
engine company> and no fo-service truck company sha n be staffed w;th
fewer than one Captain and one Apparatus Operator per company. MiniD.RD
staffing on a Paramedic unit is b«> certified Paramedics; and when at
11ini111JD1 staffing, a salvage company shall be staffed with one Apparatus-
Operator and one Fire Fighter.
ARTICLE VII. MISCELLANEOUS PROVISIONS
Seetion 1. The Serra Station and the Stanford linear Accelerator
Station shall be furnished and supplied in an equivalent manner to Palo
Alto Stations as stipulated in existing 111e1110randa of understanding. -

Section 2. Local 1319 officers may use-'~ reasonable amount of on-duty
tin;e to attend to Union business specifically related to consolidation
so long as:
(1) staffing is available
(2) operations are not interrupted
(3) advance approval is obtained from the Battalion Chief
Section 3. Prior to December 1976, representatives of City management
and Local 1319 will meet to review the impact o.f consolidation on the
benchma.rk jurisdictions.
Section 4. The parties agree to share infonnation concerning consoli-
dation. Such information shall include but is not limited to:
(1) PTI Study information
(2) Packet infonnation distributed to the Finance and Public Works
Conmittee and City Council
(3) Cost/savings data··-
Section 5. Maximum retirement age for Fire public safety employees of
record as of the ~ffective date of consolidation is fifty-five (55)
years. Employees entering the fire service subsequent to the date of
consolidation will be subject to the ~rovisions of Section 408 of the
Merit System Rules and Regulations.
