RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
FINDING AND DECLARING THAT A MAJORITY PROTEST HAS
NOT BEEN MADE TO THE ANNEXATION OF CERTAIN UNINHABITED
TERRITORY CONTIGUOUS TO THE CITY OF PALO ALTO DESIGNATED
AS "SILVA AVENUE/SILVA COURT ANNEXATION NO. 2" TO THE
CITY OF PALO ALTO
WHEREAS: on the 26th day of July: 1976, the Council of
the City of Palo Alto did pass and adopt Resolution No.. 5239
giving notice of the proposal to annex certain uninhabited
territory to the City of Palo Alto, said territory being
contiguous to the City of Palo Alto and designated as
"Silva Avenue/Silva Court Annexation No. 211 , and said resolution
described the boundaries of the territory proposed to be
annexed7 and
l-JHEREAS, on the 26th day of July~ 1976= the Council of
the Cicy of Palo Alto did set September 13, 1976, as the date
of a public hearing on the annexation of said territory; and
WHEREAS. said Resolution No. 5239 did contain a nrtice,
hour, and place when and where the Council of the City of Palo
Alto would hear protests made by any person owning property
within the City of Palo Alto, said annexation having been
initiated by the Council of the City of Palo Alto, and the
time of said hearihg being not less than forty nor more than
six~days from the date of passage of said Resolution No. 5239;
and
WHEREAS~ on the 13th day of September, 1976, at the hour
of 7:30 p.m. in the Council Chambers in the City Hall of the
City of Palo Altoa County of Santa Clara, State of California,
said time and P.lace being the day, hour and place fixed in
said Resolution No. 5239, for hearing protests to the said
annexation said City Council did hear and pass upon all protests
made to the proposed annexation and did determine that protest
had not been made by public and private owners of one-half of
the value of the territory proposed to be annexed; and
l~iEREAS, said territory is contiguous to the City of Palo
Alto= and is uninhabited territory in the County of Santa
Clara;
NOW, THEREFORE. the Council of the City of Palo Alto does RESOLVE as follows:·
SECTION 1. That the Cou.~cil does hereby find and declare
that a maJority protest has not been made by the owners of
one-half of the value of the territory proposed to be annexed.
SECTION 2. The Council hereby finds that this action does
not constitute a project subject to the California Environmental
Quality Act or Title 11 of the Palo Alto Municipal Code.
