HomeMy WebLinkAboutRESO 5246• .. • -ORl~INAL RI.SOLUTIOU NO. 5246 ----- RLSOLUTION OF THE COUNCIL OF TUE CITY OF PALO ALTO SllBMIT.i:'ING TO THE ELECTORATE OF THE CITY OF PALO ALTO AT A SPECIAL ELECTION TO BE HELD NOVEMBER 2, 1976, PROPOSED AMENDMENTS TO Tl4E CHARTER OF THE CITY OF PAJ:.O ALTO TO COUFORM TIMING OF RECALL AND INITIATIVE ELECTIONS WITH S'i"ATE Alm FEDERAL LAWS, AND REQUESTING THE BOARD OF SUPERVISORS TO CONSOLIDATE SAID ELECTION WITli THE GEUI:RAL ELlX.I'ION TO BE HELD NOVEMBER 2 1 1976 WHLREAS, the City Council, as provided in Section 3 of Article XI oC the Constitution of the State of California, desires to submit to tile electors at the 1976 general election a proposal for amentiments to the Charter of the City of Palo Alto1 NOW, TliEREFORE, the CoWlcil of the City of Palo Alto does RESOLVE as follows: SECTION l. That the following measure shall be submitted to the electors of the City of Palo Alto at a spec~al election to be held November 2, 1976, to be designated as City of Palo Alto Measure : CITY OF PALO ALTO MEASURE Shall Article VI, Section 1, of the Cha~ter of the City of Palo Alto be amended to establish the period for holding a recall election and nominations for candidates as that provided in the general laws of the State of California, and to amend Section 2 of Article VI of the Charter of the City of Palo Alto to require regular and special elections for ordinances presented by initiative to be held within the period provided by the general laws of the State of California? For the amendment Against the amendment SECTION 2. If a majority of the qualified voters voting at said election shall vote in favor of CITY OF PALO ALTO MEASURE , it shall be deemed ratified, and paragraph 8 of Section 1 (Recall) of Article VI of the Charter of the City of Palo Alto shall, upon filing with the Secretary of State, be amended to read as follows: "If the petition shall be found to be sufficient, the clerk shall submit the same to the council without delay, and the council shall thereupon order and fix a date for holding the said election within the time set by the general laws of the State of California. Candidates for this election shall file with the city clerk within the period set by the general laws of the State of California.• and paragraph 8 of Section 2 (Initiative) of Article VI of the Charter of the City of Palo Alto, ohall upon filing with the Secretary of State, be amended to read as follows: --.. • • "If the petition accompanying the proposed ordinance be signed by qualified and registered electors equal in number to six percentum of the number of registered voters at the last general municipal election, the council must either pass such ordinance without alteration or submit the same to the electorate at the next general municipal election that shall occur at any time after forty-fi•re days from the date of the clerk's certificate of sufficiency. But if such petition is signed by qualified and registered electors equal in number to twelve percentum of said number of registered voters at the last general municipal election and contains a request that such ordinance be submitted to a vote of the people at a special election, then the council must either pass the ordinance without alteration or submit the same to the electorate at a special election to be called within the period pro- vided by the general laws of t:he State or California," S~C'I'ION 3. The City Clerk hereby is directed to cause said proposed charter amendment to be published once in the Palo Alto Times, a newspaper of general circulation within the City of Palo Alto, and all editions thereof during the day of publica- tion, said advertising in said newspaper to be completed not less than forty (40) nor more than sixty (60) days prior to the date fixed for said election; Said City Clerk hereby also is directed to cause copies of said charter amendment to be printed in convenient pamphlet form and in type of not less than 10 point and to cause copies thereof to be mailed to each of the qualified electors of the City of Palo Alto; And said City Clerk also shall publish all such other notices and do all such other things as may be required to submit such measures to said electors at said election. SECTION 4. The Board of Supervisors of the County of santn Clara hereby is requested to order the consolidation of said election with the general election to be held on November 2, 1976, and to authorize the registrar of voters of Santa Clara County to provide necessary services relating to the election.
