RESOLUTION NO. 5242 -----
A RESOLUTION OF INTENTION TO
ACQUIRE ANO OONSTRTJCT IMPROVEMENTS
UNIVERSITY AVENUE AREA OFF-STREET PARKING ASSESSMENT DISTRICT
PROJECT NO. 75-63
RESOLVED, by the Council-of. the City of Palo Alto, California,
as follows:
1. That it does hereby p~eliminarily determine that the
public interest and convenience require, and that it-intends to
order the following work to be done, acquisitions and improvements
to be made, to wit:
a) The acquisition of (i) properties known as 427
and 435 Bryant Street (the "old Safeway lot")
located between Florence Street and Bryant
Street contiguous to and northwesterly of the
alley running from Bryant Street and Florence
Street, and (ii) properties knoWD as 412
and 420 Kipling Street and 424 and
440 Lytton Avenue located at the northerly
corner of Kipling Street and Lytton Avenue.
b) The relocation of persons and businesses lo-
cated on said properties, the demolition of
existing structures and the improving thereof
as public off-street vehicle parking facilities
by grading and the construction therein of base
pavement, wearing surfac~, curbs, gutters,
drainage facilities, lighting fa.cilities,
striping, landscaping and all auxiliary work
necessary to complete the same as off-street
automobile parking facilities.
c) The financing of a feasibility study for and
on behalf of tbe area of the assessment dis-
trict which will encompass the following
matters:
(1) Improvements to on-street parking and
landscaping;
(2) Improvements to oft-street parking;
(3) The feasibility of constructing a
downtown parking structure;
(4) Possible acquisition and improvement of
additional oft-street parking;

Ui) Opportunities for encouraging and pro-
vidin~ for alternative transportation
modes for employees and customers,
including but not limited to van pools,
mini-buses, shuttle buses, bicycles,
handicapped: and pedestrians;
(6) Multiple use of parking properties and
structures, including existing as well
as new ones, taking into account that
. "economics" of parking st-ructures are
short-term considerations in light of
values such as street-life scale,
interest and enclosure; and
(7) Checking or monitoring Saturday parking.
d) The acquisition of all lands, easements and facili-
ties and the construction of all work auxiliary to
any of the above and necessary to complete the same.
2. All of the blocks, streets and alleys herein mentioned
are shown on maps of record in the or fice of the county recorder
of Santa Clara County, state of California, and shall be shown on
the plans berein referred to and to be file4 with the city clerk
of said city.
3. Whenever any public way is herein referred to as running
between two public ways, or from or to any public way, the intersec-
tions of the public ways referred to are included to the extent
that work ~hall be shown on the plans to be done herein.
4. All of said work and improvements are to be construe-
ted at the places and in the particular locations, of the forms,
sizes, dimensions and materials, and at the lines, grades and ele-
vations as abown and delineated upon the plans. profiles and speci-
fications to be-made therefor, as hereinafter provided.
5. There is to be excepted from the work above described
any of such work already done to line and grade and marked excepted
or shown not to be done on ~aid plans, profiles and specifications.
6. Said councir-does' hereby adopt and establish -as the
official grades for s~lid work the grades and elevations to be shown
upon said plans, profile~ and specifications. All such grades
and elevations are to be in feet and decimals thereof with refer-
--ence to the datum plane of the city of Palo Alto.

said grades are hereby changed and that said work will be done to
said changed grades.
8. The deseriptions of the acquisitions and improvements
and the termini or the work contained in this resolution arc
general in naturf'. A1 l items of work do not necessarily extend
for tht? rul 1 len~th of thr> description thereof. The plan::;
and profiles of the wurk-:4nd the map and descriptions of the acqui-
sitions, as contain3d in the Engineer's Report, shall be controlling
as to the correct and detailed description thereof.
9. That the costs and expenses of said acquisitions and
improvements therefor arc hereby made chargeable upon an assess-
ment district, which district said council declares to be the
district benefited by said acquisitions and improvements, and
the exterior boundaries of which are described and shown on the
map identified as "Map Showing Boundaries of Proposed Un~versity
~-~:
Avenue Off-·Street Parking Ass~ssment District, Project No. 75-63,"
on f.ile in the office of the city clerk, which indicates by a
boundary line the extent of the territory included within the
assessment district and which shall govern ror :ill details as to
the extent of said proposed district.
10. Said council further declares that all public streets,
highways, lanes and alleys and other_publicly owned and otherwise . non-taxable property within said assessment district shall be
omitted from the annual benefit assessments hereafter to be made
to pay principal and interest on bonds.
11. Notice is hereby given that it is the intention of the
council to consider adoption of an ordinanc~. authorizing contribu-
t.ions by the city from any sources of revenue not otherwise pro-
hibited by law, _or any specified amount, portion or percentage of

payment of expenses incidental thereto for the use and benefit of
the assessment di.strict, and to consider authorizing appl i.cation
of such revenues as a credit upon the assessment.
12. Notice is hereby given that serial bonds to represent
the total cost of the project shall be issued pursuant to Bond
Plan G, Section 13.16. 150 of Chapter 13.16 of Title 13 of the Palo
Alto Municipal Code, the last installment of which bonds shall
mature not to exceed twenty-four (24) years fro~ the 2nd day of
July next succeeding ten months from their date.
13. The rate of assessment to be levied against taxable
lands and improvements in the ratio of adjusted square footage of
floor areas of non-residential structures, as provided in said
Bond Plan G, shall in no event exceed $ . 09 per adjusted square
foot; provided. that in the event that the proceeds of an assess-
ment levied at the said maximum rate in any year are insufficient
to raise the amount of money necessary to be raised by assessments
to pay principal and interest on said:bonds in said year, the
balance shall be raiRcd by an additional assessment on all taxable
lands (exclusive of improvements) within the parking assessment
district, in the ratio of their land areas.
14. Except as herein oti1erwise provided for the issuance
of bonds, all of said work shall be done as provided in Sections
13.12.040 and 13.12.050 of Chapter 13.12 of Title 13 of said code,
and Division 4 of the Streets and Highways Code of the state of
California. Reference is made to the proceeding9 ta.ken pursuant
to said Division 4 of said Streets and Highways Code on ·file in
the office of the city clerk;
15. Said acquisitions ~d improvements are hereby referred
to the city engineer of said city, as the officer having ch~rge
and control-of tbe acquisition and construction of public improvements

ln and for Raid city or th0 kind described herein, being a competent
person employed by said city for that purpose, and Raid engineer is
hereby dire~ted to make and file with the city clerk of said city
a repcrt in writin~, presenting the following:
(a) Maps and descriptions of lands, easements and rights
to be acquired;
(b) Plans and specifications of the propose,1 irnpro\;ements
to be made pursuant to this resolution; and
(c) Engineer's estimate of the total ~osts and expenses
of said acquisitions and improvements and of the incidental expenses
in connection therewith.
16. Any surplus remaining from the proceeds of sale of the
bonds to be issued under Bond Plan G shall be deposited in the
bond interest and redemption fund for said bonds.
17. Th~ city engineer of said city is hereby designated
as the person to answer inquiries regarding any protest proceedings
to be bad herein, and may be contacted during regular office hours
at ·the City Hall, Sixth Floor, or by calling (415)329-2325.
