Home My WebLink AboutRESO 5239• • ... . • ORIGltJAL RESOLUTION NO. ~39_ RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO GIVING NOTICE OF PROPOSED ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "SILVA AVENUE/ SILVA COURT NO. 2" AND SETTING A TIME AND PLACE FOR HEARING PROTESTS THERETO The Council of the City of Palo Alto does hereby RESOLVE as follows: SECTION 1. Pursuant to the provisions of the "Annexation of Uninhabited Territ?ry Act of 1939", these p~oceedings are initiated by the Council of the City of Palo Alto, on its own motion, to annex to the City of Palo Alto all that certain contiguous unin- habited territory described in Exhibit "A" attached hereto and incorporated herein by this reference. SECTION 2~ said annexation is designated as "Silva Avenue/ Silva Court Annexation No. 2." SECTION 3. On June 2, 1976, Resolution No. 76-113 was adoptt:!d . ' by the Santa Clara County Local Agency Formation Commission approv1119 said annexation. SECTION 4. The 13th ----day of September , 1976, at the hour of 7:30 p.m. in the Council Chambers in the City aall, 250 Hamilton Avenue, in t.be·city 0£ Palo Alto, county of Santa Clara, State of California, is hereby fixed as the time and place when and where any pez:son owning real property within the uninhabited area . > ... above described and proposed to be annexed to the City of Palo Alto, ., and having any objections to the proposed annexation, may appear before the Council of the City of Palo Alto and show cause why such uninhabited territory should not be so annexed to the City of Palo .. Protests must be in wi:·iting, may be filed at any ::!me prior to the close ot the hearing on protests to the propo88d annexation, and shall state the name or ~· of the owner or owners of pro- perty affected and the street address or other deacriptio~ of the .------------------------------------------------- ... • property sufficient to identify it on the last equalized assess- ment roll. SECTION 5. The Council -of the city of Palo Alto desires to annex said territory for the following reasons: All of the land proposed to be annexed is ideally located for inclusion in the city limits. The character and location of the territory is such that it will benefit from the provision of police and fire pro- tection, street maintenance and other municipal services. The territory ~s contiguous to the City of Palo Alto and its proposed annexation will contribute to and facilitate the orderly growth, planning and zoning of both the city and territory proposed to l,,e annexed. SECTION 6. The City Clerk of the City of Palo Alto is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the Palo Alto Times, a newspaper of general circulation published in said City of Palo Alto, the city to which it is proposed to annex the aforesaid territory, and also in_ the Sa.ii_Jos~Mercury a newspaper of general circulation published outside the City of Palo Alto but in the County of Santa Clara, California, the county in which is located the territory proposed to be annexed to the city, said publications to be complete at least twenty days prior to the date set for the hearing. And the said City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to . each person to whoin land within the territory proposed to be annexed was assessed in the last equalized county assessment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to said Clerk, and to any person who has filed his name and address and the desig- nation of-the lands in which he has an interest, either legal or -2- .. . • .. .. or equitable, with said Clerk, such notice to be given not less than twenty days before the public hearing on the proposed annexation1 And the City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto in the manner required by law. SECTION 7. The Council of the City of Palo Alto finds that this is not a project as defined in Section 11.04.130 of the Palo· Alto Municipal Code and, therefore, no environmental impact assessment is necessary.
