RESOLUTION NO. 5757
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
PROVIDING FOR THE WITHDRAWAL OF CERTAIN UNINHABITED
TERRITORY DESIGNATED AS SAN ANTONIO 75··138 FROM THE
FREMONT FIRE DISTRICT
WHEREAS, Section 13952 of the California Health and Safety Code
authorizes the withdrawal of territory from a fire district when
such territory is annexed to a city; and
WHEREAS, the Santa Clara County Local Agency Formation
Corrunission by Resolution No. 78-209, passed and adopted on December 6,
1978, directed the City of Palo Alto to withdraw the territory desig-
nated as "San Antonio 75-138tt from the Fremont Fire District within
one year after the annexation of said territory is complete; and
WHEREAS, on April 3, 1979, the Assistant Executive Officer of
the Santa Clara County Local Agency Formation Commission recorded with
the Recorder of the County of Santa Clara a certificate of completion
of said annch~tion, together with required documents attached.
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE
as follows~
SECTION 1. That certairs uninhabited territory known as San
Antonio 75-138, described in Exhibit "A," attacned hereto and incor-
porated by reference herein as though fully set forth, and as shown
on the map, attached hereto as Exhibit "B," and incorporated by ref-
erence herein as though fully set forth, hereby is withdrawn from
the Fremont Fire District effective on December 17, 1979.
SECTION 2. The City Clerk is directed to file a certified copy
of this resolution with the governing body of the Fremont Fire
District, with the tax levying authority of the Fremont Fire District,
the Board of Supervisors of the County of Santa Clara, and the County
Assessor of the County of Santa Clara.
SECTION 3. The Cou1cil of the City of Palo Alto hereby finds
that this proJect will have no significant adverse environmental im-
pact.
