' • RESOLUTION NO. 5754 RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ADOPTING AN AME1'iDMEN'l' TO THE CCMPREHENSIVE PLAN FOR THE CEVELOPMENT OF 'IHE CITY OF PALO ALTO OR~Glt~AL· WHEREAS, the Planning Ccaaission conducted a review and on October 17, 1979, held a properly noticed public hearing to consider amendment to the Palo ~lto comprehensive Plan; and WHEREAS, the City Council held a properly noticed public hearing to consider amendment to the Palo Alto Comprehensive Plan on November 5, 1979. HCM, THEREFORE, the COWlcil of the City of Palo Alto does RESOLVE as follows: SECTION 1. Th.a City Council finds that changed conditions and the public interest, health, safety and welfare require that certain amendment to the Palo Alto Comprehensive Plan set forth in Section 2 hereof. SECTION 2. The Palo Alto Ccrprehensive Plan is hereby amended as follows: a. on page 61, Wlder "Major Institution/Multiple Family Residential", modify the second paragraph to read: .,This designation is applied to Peter Coutts Hill in antici- pation of a Stanford faculty hm!sing development of approxi- mately 125-140 units, most of which will be available at below market rates. This housing is to be comb:.i.ned with a contiguous, reasonably-shaped open space area of approximately 4-6 acres, including the top of the hill, and accessible t~ the public." SECTION 3. The City Council hereby finds that the adoption of the amendment to the Palo Alto Comprehensive Plan set forth in Section 2 hereof will not cause any significant adverse environmental impact. (c) On the question to amend the Charter of the City of Palo Alto, Article III, Sections 2, 3, 8, and 10 (Measure A), the votes cast thereon were as follows: For the Amendment Against the Amendment 10,985 797 (d) On the question regarding abandonment of a portion of El Camino Par.k (Measure B),;the votes cast thereon wer~ as follows: For the Amendment Against the Amendment 9,460 2,345 SECTION 2. The Council finds and declares that the question to amend the ~harter of the City of Palo Alto by amending Sections 2, 3, 8, and 10 of Article III did receive the approval of a majority of the electors of the City voting on said question at said special election and that said question has been legally approved and carried and that said Charter sections shall, upon filing with the Secretary of State, be amended to read as shown on the attachment hereto. SECTION 3. The Council finds and declares that the question rega=ding the abandonment of a portion of El Camino Park did receive the approval of a majority of the electors of the City voting on said question at said special election and that said question has been legally approved and carried. "Sec. :?. Numb€'r: t-:'rm. Commencing July 1. 1971. said council shall be composed of nine members. each of whom shall at the time of assuming such office be an elector and shall have been a resident of the City of P;:;lo Alto for at least thirty days next preceding the final filing date for nomination papers for such office. The members of said council shall be known as councilmen, councilwomen, or council members and their terms of office shall be four years. commencing on the first day of January next succeeding their election. The terms of councH members who took office on July l, 1977, shall expire on December 31, 1981. "Sec. 3. Ii me of election.. A regular election shall be held in the City of Palo Alto on the first Tuesdc.v after the first Mondav in November of each odd numbered year, and the same shall be' known as the general municipal electilln. All other mnnicipal electious that rr.ay be called under the uuthority of this charter, or by the general laws, shall be known as Spl'cial elections. "Sec. 8. Mayor; election; duties. The council shall. at its first meeting in . .January, elect one of its number as its presiding officer, who shall have the title of mayor, and one of its m.unber to be vice mayor, who shall serve for one year after their ele('tion, and until their successors are elected and qualified. The mayor and vice- mayor elected in July 1981 shall serve until election c.:nd qualification of their successors in January 1982. The mayor shall preside at all meetings of the council, shall sign all official documents when the signature of the council or mayor is required by law, and shall act as official head of the city on publkor ceremonial occasions. The mayor shall not have any reglilar administrative duties but may act as ex offido member of all boards, commissions, and committees. The mayor shall vote as other members of the council, but shall have no power of veto. The mayor shall have the power to admini:-;ter oaths and affirmations. The mayor shall perform such other dutie.s as from time to time are assigned by the councii. When the mayor is absent from any meeting of the council or incapable of performing his or her duties, the vice-mayor shall, during such time, have the full powers of the mayor. A vacancy in the positions of mayor or vice mayor shall be filled by the council for the unexpired term . .. Sec. !O. Y.s!&,~ on council. A. vacancy on the council may be filled by ~ majority of the remaining member.s of the council, and the appointee shall hold office until the first day of January succeeding the next election at whkh council members are to be elected. At the next election succeeding any vacancy a council member shall be elected to serve for the unexpired term. If the council fails to fill such vacancy within 60 days of such vacancy or the council chooses to fill such vacancy by election. it shall forthwith call a special election, at which a council member shall be elected to serve for the unexpired term.'' .• r • l t i,
