HomeMy WebLinkAboutRESO 5753,. e ORIGINAL RESOLUTION NO. 5753 RESOLUTIOU OF THE COUNCIL OF THE C"ITY OF PALO ALTO DECLARING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEMBER 6, 1979 WHJ::REAS, on November 6, 1979, the City Council of the City of Palo Alto, County of Santa Clara, did cause to be submitted to the legal voters of said city at a special election, consolidated with the special statewide election of the State of California, duly ~alled and held in and for said city the following questions: CITY OF PALO ALTO MEASURE A "Shall the Charter of the City of l-'alo Alto be amended to provide that the general municipal election for election of councilmembers to the Council of the City of Palo Alto be held in November rather than in May and correspondingly that terms expire when newly elected council- members take office in Januarv rather than in July and that the Mayor and Vice-Mayor be elected from among the councilmembers in January rather than in July?" CITY OF PALO ALTO MEASURE B nshal.l the southeasterly 1. 086 acres of El Camino Park, whose total acreage is 11.54 acres, be discontinued for park use in order to allow remodeling of the presently closed Veterans Building ror purposes of: restaurant use 1 meecing rooms for the veterans and other non- profit groups, and incidental off ice use.'' WHEREAS, due and legal notice of said special election was given as required by law; and WHEREAS, on the 6th day of November, 1979, at the hour of 7:00 o"clock in the morning of said day the polls were duly and regularly opened for said special election in said city and said polls were continuously kept open for said purpose from the time they were so opened until 8:00 o'clock in the evening of said day; and WHEREAS, on December 3, 1979, the Council of the City of Palo Alto met at its usual place of meeting and did then and there can- vass the returns of said special mur1icipal election and declare the results thereof; NOW, THE~ORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION 1. The Council finds and declares that: (a) A special election was duly and regularly held on November ~. 1979, in all things according to the Charter of the City of Palo Alto, Ordinances No. 3148 and No. 3153, and the election laws of the State of California. • • (b) The whole number of votes cast in the City at said con- solidated election, including votes cast upon absentee ballots, as shown on the Abstract of Vote provided by the Registrar of Voters, was 12,782. (c) On the question to amend the Charter of the City of Palo Alto, Article III, Sections 2, 3, 8, and 10 (Measure A), the votes cast thereon were as follows: For the Amendment Against the Amendment 10,985 797 (d) On the question regarding abandonment of a portion of El Camino Park (Measure B),,the votes cast thereon were as follows: For the Amendment Against the Amendment 9,460 2,345 SECTION 2. The Council finds and declares that the question to amend the Charter of the City of Palo Alto by amending Sections 2, 3, 8~ and 10 of Article III did receive the approval of a majority of the electors of the City voting on said question at said special election and that said question has been legally approved and carried and that said Charter sections shall, upon filing with the Secretary of State, be amended to read as shown on the attachment hereto. SECTION 3. The Council finds and declares that the question regarding the abandonment of a portion of El Camino Park did receive the approval of a majority of the electors of the City voting on said question at said special election and that said question has been legally approved and carried. SECTION 4. Attached hereto and incm:poratt:?d herein as EX~UBIT "A" is the statement of the result, as required by Section 229~3 of the Elections Code of the State of California. Numbl'r: term. Commencing July 1. 1971. said council shall be composed of nine members. each of whom shall al the time of assuming such office be an elector and shall have been a resident of the City of Palo Alto for at Jt>ast thirty days next preceding the final filing date for nomination papers for such office. The members of said council shall be known as councilmen, councilwomen, or council members and their terms of office shall be four years, commencing on the first day of January next succeeding their election. The terms of council members who took office on July l, 1977, shall expire on December 31, 1981. "Sec. 3. Iime o[ election. A regular election shail be held in the City of Palo Alto on the first Tuesdav after the first Mondav in November of each odd numbered year, and the same shall be. known as the general municipal election. All other municipal election::; that n:ay be called under the authority of this charter, or by the general laws, shall be known as special elections. "Sec. 8. Mayor; election; duties. The council shall. at its first meeting in January, elect one of its number as its presiding officer, who shall have the title of mayor, and one of its n11mber to be vice mayor, who shall serve for one year after their election, and until their successors are elected and qualified. The mayor and vice- mayor elected in July 1981 shall serve until election ~nd qualification of their successors in January 1982. The mayor shall preside at all meetings of the council, shall sign all official documents when the signature of the council or mayor is required by law, and shall act as official head of the city on public or ceremonial occasions. The mayor shall not have any regular administrative duties but may act as ex officio member of all boards, coromisskms, and committets. The mayor shall vote as other members of the council, but shall have no power of veto. The mayor shall have the power to administer oaths and affirmations. The mayor shall perform such other ;:lutie3 as from time to time are assigned by the council. When the mayor is absent from any meeting of the council or incapable of performing his or her duties, the vice-mayor shall. during such time, have lhe full powers of the mayor. A vacancy in the positions of mayor or vice mayor shall be filled by the council for the unexpired term. "Sec. 10. Vacancy Q!!. s;yuncil. A vacancy on the council may be filled by ~ majority of the remaining members of the council, and the appointee shall hold office until the first day of January succeeding the next election at wh~ch council members are to be elected. At the next election succeeding any vacancy a council member shall be elected to serve for the unexpired term. If the council fails to fill such vacancy within 60 days of such vacancy or the council chooses to fill such vacancy by election. it shall forthwith call a special election, at which a council member shall be elected to serve for the unexpired term." • t i,
