RESOLUTION NO. M~ RESOLUTION OF THE COUNCIL OF ITY OF PA.LO ALTO
AGREEING PURSUANT TO REVENUE AlID TAXATION CODE
SECTION 99 FOR EXCHANGE OF PROPERTY TAX REVENUES
POR TERRITORIES AFFECTED BY A JURISDICTIONAL CHANGE
WHEREAS, subparagraph (b) of Section 99 of the Revenue and
Taxation Code requires that the Board of Supervisors negotiate an
exchange of property tax revenues with cities for territory
affected by a jurisdictional change; and
WHEREAS, the cities and county wish to facilitate orderly and
expeditious jurisdictional changes; and
WHERE.Af,, the cities and the county have reached agreement pur-
suant to thu above referenced code section;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE as follows:
SECTION 18 The annexing city shall receive the proportion of
the one percent (11o) propert~ tax revenue previously received by
the detaching special districtst but not less than the proportion
of the property tax received by the city in that city's tax rate
area composed of the same jurisdictions receiving a portion of the
one percent (11.) property tax.
SECTION 2~ This distribution formula shall be applied to
lurisuictional changes which were effective during fiscal year
978p79 pursuant to subparagraph (d) of Section 99 of the Revenue
and Taxation Code.
SECTION 3. Th.is distribution formula shall be applied to all
pending and future jurisdictional changes.
SECTION 4. The County Auditor be notified of this resolution
pursuant to subparagraph (b) of Section 99 of the above-referenced
Code.
SEC~ION 5. The Council finds that this is not a project under
the Cil1f ornf"a Environmental Quality Act and, therefore, no environ-
mental impact assessment is necessary.
