RESOLUTION OF THE COUNCIL OF TR£ CITY OF PALO ALTO
IU OPPOSITION TO THE DISCONTINUANCE OF THE SOUTHERN
PACIFIC COMMUTER SERVICE ALONG THE SAN FRANCISCO BAY
PENINSULA AND REQUESTiliG THAT THE INTERSTATE COMMERCE
C<»m!SSION REJECT TilE DECISION OF THE ADMINISTRATIVE
LAW JUDGE IN THIS REGARD
Wl-lERE.AS. the Interstate COUDllerce Conmission is presently con-
sidering a decision of -Administrative Law Judge Wallace concerning
the Southern Pacific commuter service along th~ San Francisco Bay
Peninsula; and
WHEREAS, the decision of the Achn5.nis trative Law Judge
would allow discontinuance of said commuter service at a time when
the needs of our citizenry for mass transit are very high; and
WHEREAS, discontinuance of thl' service is inconsistent with
President Carter's expressed goal of reducing oii consumption
through greater reliance on transportation alternatives other than
the automobile; and
WHEREAS. a decision to discontinue said service is inappropriate
and untimely in that negotiations are currently in existe~ice between
Southern Pacif i.c and various governm~ntal agencies in an attempt to
res~lve transportation difficulties in the Bay Area; and
WHEREAS. the monetary figures used by the Acbninistrative Law
Judge in his evaluation are out of date and fail to recognize the
large tax savings obtained by Southern Pacific as a result of the
passage of P~oposition 13; and
WHEREAS. the on-going fuel crisis has led to an increase in
the COJ!JllUter service ridership which must be recognized and con-
sidered;
NOW. THEREFORE. the Council of the City of Palo Alto docs
RESOLVE as follows:
SECTION 1. The Council of the Ciry of Palo Alto is committed
to the continuance of the Southern Pacific conmuter service along
the San Francisco Bay Peninsula.
SECTION 2. The Interstate Commerce Commission is requested
to reject the decision of Administrative Law Judge Wallace regard-
ing the service and to allow cu~rent negotiations between Southern
Pacific and various governmental entities to be completed prior
to any Federal ~ecisions on the commuter service.
SECTION ~· The Mayor is directed and authorized to direct a
letter aiong with this resolution to our local legislators re-
questing that resolutions ~f the California Senate and Assembly
be adopted which opposa discontinuance of the Southern Pacific
coauuter service along the Peninsula.
